SUBJECT: Employee Recognition Award
I an extremely pleased to nominate Stan Burkman, Park Enforcement Officer, for the
City's Employee Recognition Award.
On September 30, 2004, while writing tickets in the 3200 block of Milton, Officer
Burkman found a wallet on the street containing a large amount of cash, various credit
cards and personal identification belonging to Cheryl Markey. Officer Burkman made
contact with Ms. Markey, verified that she had indeed lost a wallet and made
arrangements with her to return it. Upon its return, Ms. Markey stated that it contained
$500.00 in cash. The cash along with her credit cards and other personal papers were all
accounted for.
Officer Burkman exhibited his honesty and integrity by returning the money to its owner.
I want not only to personally thank him for his actions, but ask the City Council to provide
him with their public appreciation.

WEDNESDAY, OCTOBER 20, 2004, 7:30 A.M.
Mayor Blackie Holmes opened the meeting of the City Council. Present were Mayor Pro
Tempore Jim Roberts and Councilmembers Harry Shawver, Kelly Walker and Syd Carter. Also
in attendance were City Attorney Rob Dillard, Finance Director Kent Austin substituting for City
Manager Bob Livingston and City Secretary Nina Wilson. City Manager Bob Livingston was
absent and excused.
Mayor Pro Tem Roberts moved acceptance of the Consent Agenda. Councilmember Walker
seconded, and the vote was unanimous to approve the following:

CONSIDER APPROVAL OF CITY COUNCIL MEETiNG MINUTES: For October 5, 2004.
MAIN AGENDA
PUBLIC HEARING REGARDING PARKING AMENDMENTS FOR SOUTHERN
METHODIST UNIVERSITY CAMPUS DISTRICT: Mayor Holmes opened the public hearing.
Building & Zoning Administrator Wade McLaurin stated that, as a result of the construction of
Ford Stadium, as well as additional parking structures on the SMU campus, the regulations found
in the Zoning Ordinance regarding on-campus parking must be amended to appropriately address
the conditions that currently exist. The proposed amendments include a "credit" for students,
stafl} or faculty who have the ability to use mass transit as provided by DART. In addition to the
parking regulations, Section 14-206 of the Zoning Ordinance is also being created to better
define the approved activities at Ford Stadium. This new section mirrors the previous
requirements of Ownby Stadium, but allows for the stadium to be used for high school football
two (2) days out of the academic year, in addition to high school football playoff games. This
will allow for the continued use of the stadium for the Tom Landry Classic high school football
event at Ford Stadium and will also bring the Zoning Ordinance up-to-date. There was no
further discussion and Mayor Holmes closed the public hearing. Councilmember Shawver
moved to approve the ordinance regarding parking amendments to Southern Methodist
University Campus District. Councilmember Carter seconded, and the vote was unanimous to
approve the ordinance. City Attorney Rob Dillard asked if Councilmember Shawver meant both
ordinances, so Councilmember Shawver moved to amend his motion to include both ordinances.
Councilmember Walker seconded, and the vote was unanimous to approve both ordinances
regarding parking amendments to the University Campus District.
ORDINANCE NO. 04/31
AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, REPEALING
SECTION 24-500, "PARKING REQUIREMENTS IN UC-1 AND UC-2", SUBSECTIONS (1)
THROUGH (6) OF THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF
UNIVERSITY PARK, AS HERETOFORE AMENDED, IN ITS ENTIRETY, AND UPDATING
AND REPLACING THE SAME WITH THE PROVISIONS SET OUT HEREIN, PROVIDING
FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO
THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN
EFFECTIVE DATE.

AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF UNIVERSITY PARK, AS
HERETOFORE AMENDED, BY ADDING SUBSECTION (4), "FORD STADIUM", TO
SECTION 14-206, "ADDITIONAL REGULATIONS"; PROVIDING FOR THE REPEAL OF
ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING
FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS
($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
CONSIDER PURCHASE OF CodeRED NOTIFICATION SYSTEM CONTRACT: Fire Chief
David Ledbetter stated that in an emergency, especially after hours, notifying staff members and
crews to respond in a timely manner once they have gone home is a serious challenge. If citizens
have to be notified, the only method is to go door-to-door. CodeRED is a web-based emergency
notification system with the capacity to launch more than 60,000 telephone calls to homes and
businesses in less than one hour. Emergency messages can be initiated from homes, offices, or
anywhere an internet connection is available. The system is not limited to employee notification
but can be used for a variety of needs to notify citizens such as evacuations, hazardous material
Spills, fire and flood disasters, missing children/persons, major weather alerts, terrorism alerts,
street closings and water main breaks, etc. The cost of the service is available in a two-year
contract and provides the City with 15,000 minutes of usage each year for $5,000.00 per year.
Additional minutes are provided free of charge for training purposes. Councilmember Walker
moved acceptance of the contract. Councilmember Carter seconded, and the vote was
unanimous to approve the contract for the CodeRED Notification System.
DISCUSS UDADAC'S RECOMMENDATIONS REGARDING ARCHITECTURAL DESIGN
OF NORTHWEST HIGHWAY SCREENING WALL: Considerable discussion ensued
regarding the use of both brick and concrete facades. Director of Public Works Bud Smallwood
reported that the Committee would like to have the "portal" structures, proposed for the
southeast and southwest corners at Hillcrest, physically connected to the wall rather than
standing free. One Committee member suggested that long term maintenance issues should be
considered before deciding to incorporate the use of brick. The cost to repair or rebuild brick
sections of the wall would be considerably higher than that of concrete. The same would hold
true in the removal of graffiti. UDADAC unanimously recommended that the City Council
direct staff to proceed with the project except for the use of brick. The City Council agreed and
directed staff to proceed with the design using solid concrete rather than brick, giving the wall a
stucco look.
DISCUSS PILOT PROGRAM FOR NEWSPAPER RACKS IN SNIDER PLAZA: Assistant to
the Public Works Director Robbie Corder stated that business owners along Snider Plaza and
City staff members have voiced concern about the proliferation of individual news boxes in this
retail area. In Snider Plaza, they have created issues concerning pedestrian and vehicle safety,
litter, graffiti, and emergency access. In 2003, Snider Plaza had a total of 61 individual news
boxes. In July, 2004, the number of news boxes in Snider Plaza had increased 26% for a total of
77 boxes. To address concerns related to the proliferation of separate news boxes, staff proposes
the City purchase news racks that hold multiple publications and install the units at fixed
locations in Snider Plaza. Individual news boxes would not be allowed in the Snider Plaza area.
The City will then lease individual boxes within the news racks to the publications to recover a
portion of the cost. If successful, the pilot program along Snider Plaza could be expanded to
other retail areas in the City. The total number of publications in Snider Plaza would be reduced
from 77 to 54. Council directed staff to proceed with the pilot program to include further
discussions with vendors of the news boxes.
CONSIDER BID AND AWARD OF CONTRACT TO SYB CONSTRUCTION COMPANY
FOR WATER, SANITARY AND STORM SEWER IMPROVEMENTS, ALLEY AND
STREET PAVING IN THE AREA NORTH OF HILLCREST AND SOUTHWESTERN,
PROJECT NO. 46310: The locations to be included in this project are Centenary/Marquette
Alley from Airline Road to Hillcrest Road; Colgate/Camth Alley from Airline Road to Turtle
Creek Blvd.; Camth Blvd. from Airline Road to Hillcrest Road; Greenbrier/Southwestern Alley
from Airline Road to Hillcrest Road; Hillcrest Road from Camth Blvd. to
Greenbrier/Southwestern Alley; and Camth Park Parking Lot. Mayor Pro Tem Roberts moved
acceptance of the bid. Councilmember Carter seconded, and the vote was unanimous to approve
the awarding of the contract to SYB Construction Company for Project No. 46310 in the amount
of $2,253,957.
CONSIDER ORDINANCE ABANDONING CERTAIN STREET RIGHT-OF-WAY
ADJACENT TO 7064 TURTLE CREEK LANE: The ordinance will abandon certain right-of-
way along the Lovers Lane frontage of the property at 7064 Turtle Creek Lane, the southeast
comer of Lovers Lane and Turtle Creek Lane, owned by Mr. Steve Houghton. It includes a
3,729 square foot parcel and the fair market value is $101,839. After approval of the subject
ordinance, a certified copy of the ordinance must be filed at Dallas County, and Mr. Houghton
must incorporate the parcel with his property at 7064 Turtle Creek Lane via amending the plat.
Councilmember Shaxwer moved approval of the ordinance. Mayor Pro Tem Roberts seconded,
and the vote was unanimous to approve the abandonment of the right-of-way adjacent to 7064
Turtle Creek Lane to Mr. Steve Houghton.
CONSIDER ZONING ORDINANCE ADVISORY COMMITTEE'S (ZOAC)
RECOMMENDATION AND REQUEST FOR REZONING OF DUPLEX ZONING
DISTRICTS: Two separate requests were received requesting the City consider the potential
benefits that might result from rezoning existing duplex districts to another zoning district that
might encourage redevelopment. The first request was to rezone the north side of the 3200 &
3300 blocks of Rosedale from Duplex 2 (D-2) to Multi-Family District 3 (MF-3). The purpose
would be to encourage redevelopment in those blocks that would be similar in use to that on the
south side of Rosedale. The second request was to rezone all of the duplex districts within the
City to Single Family Attached (SF-A). The purpose would be to encourage redevelopment
throughout the City similar to what has taken place around the Middle School and provide more
owner-occupied properties rather than the rental properties that currently exist in the duplex
districts. The duplex districts cannot subdivide their lots and sell them off separately. ZOAC did
not believe it was in the City's best interest to rezone the properties along Rosedale from D-2 to
MF-3. They felt that this would be a "stepping down" in zoning classification and that the
current D-2 properties provide a buff'er between the MF-3 properties to the south and the Single
Family district to the north. However, the Committee believes that the idea of rezoning the
duplex districts to SFA is a worthwhile idea. The duplex and SFA structures are virtually
identical, and would provide the City and its' neighborhoods with more owner-occupied
residences. The Committee also felt that rather than a "blanket" rezoning of all the duplex
districts in the City, these districts should be handled on a case-by-case basis as areas, but not as
individual lots. ZOAC recommends that future applicants be sent to the Planning & Zoning
Commission for approval of their rezoning request. Mayor Pro Tem Roberts moved approval of
ZOAC's recommendation, which is to make a decision on a case-by-case basis if an individual or
the City makes a request. Councilmember Shawver seconded, and the vote was unanimous to
approve the recommendation.
CONSIDER DEADLINE FOR KENNETH CROZIER, 4305 GREENBRIER: A hearing was
held on August 3, 2004 before the City Council regarding the condition of the property at 4305
Greenbrier, owned by Mr. Kenneth D. Crozier. After reviewing photos and staff files, the
Council determined that the property was a public nuisance as a result of the overgrowth and
junk that had been allowed to accumulate on the property. Mr. Crozier was given 60 days to
bring the property into compliance. Mr. Crozier was then contacted on October 4th by Code
Enforcement Officer Mike Brackin to set up a time in which he could inspect Mr. Crozier's
property to determine if all of the violations had been corrected. Mr. Crozier agreed to meet Mr.
Brackin at 9:00 a.m., October 11th, to inspect the property. Mr. Crozier then appeared at the
October 5th City Council meeting under Items From the Floor without the knowledge of the
Building Department staff and requested an extension of the original deadline. Since the Council
cannot take action on issued discussed on Items From The Floor, he was requested to return on
October 20th when the item could be placed on the agenda. At the October 20th meeting, staff
recommended no additional time be granted to Mr. Crozier and that the Council ask the City
Attorney how best to proceed. Mr. Crozier addressed the Council and stated that the Dallas
Public Health Department had given him a report stating his property was in compliance. Mayor
Holmes then requested Building and Zoning Supervisor Wade McLaurin to contact the Health
Department for a copy of their report. Councilmembers Carter and Walker, along with a Code
Enforcement Officer, will contact Mr. Crozier to set an appointment to see his property. The
extension was denied. A decision will be made at the next council meeting on November 2,
2004 after Councilmembers Carter and Walker have viewed the property.
DISCUSS REQUEST TO PUT NAME OF ADVISORY COMMITTEE MEMBERS ON THE
CITY WEB SITE: The Information Services staff recently received a request to consider adding
membership and scheduling information to the section of the City web site that lists all citizen
advisory committees. Currently, that section of the web contains a paragraph explaining the
purpose of the committees in general and directs the citizen as to the process for applying for
membership on one of the committees. Staff asked Council to provide direction as to the type of
information that should be included in the citizen committee section of the web site. Council
directed Department Directors to make inquiry of their committee members as to their opinions
on the subject and return to a future council meeting with that information.

SUBJECT: APPOINTMENT OF ALTERNATE MUNICIPAL
COURT JUDGE
The Mayor and City Council recently met with Mr. Dan Hagood. Mayor Holmes and
Judge Barklow have proposed appointing Mr. Hagood as an alternate judge in the
University Park Municipal Court.
RECOMMENDATION:
The appointment is a function of the Mayor and Council. If you wish to proceed with the
appointment, Council should authorize the addition of Mr. Hagood to the list of alternate
judges.

Signage for Christmas Carriage Rides
BACKGROUND:
On September 22nd, the City Council gave approval to Max-A-Million Horse-Drawn Carriage to operate in
Snider Plaza during this upcoming holiday season. The owner of the carriage business was surprised to
leam afterward that this approval did not include any type of advertising or temporary signage. She is
asking the Council to amend the approval to allow two (2) "A" frame signs to be placed within the Plaza.
PUBLIC NOTICE: N/A
RECOMMENDATION:
Staff has no issue with the Council giving special permission to allow the two (2) "A" frame signs as shown,
as long as they do not obstruct traffic or sight lines. It is apparent that the carriage operator feels that it is a
necessity for her business to have this signage for advertising.

11/_02/04 Council Meetinq: Christmas Carriages in Snider Plaza
To all Town of University Park Officials:
On October 15th, I picked up the two (2) A-frame signs
that I had professionally made for our Christmas carriage
business in Snider Plaza, and placed them prominently in
the Snider Plaza Shopping Center. These simple signs,
the only source needed for my customers to know this
exciting news, my phone started ringing with the Snider
Plaza shoppers before I couJd even start my drive home.
People were, and are, tremendously excited to hear the
news of these Christmas carriages in The Town of
University Park. There is, however, a slight snag in this
Christmas carriage business of Snider Plaza that we have
worked so hard to now begin together. I trust though, that
we will work out this small problem to the benefit of the
Christmas carriage operation, and to the Town of
University Park alike.
I've been told these signs are not allowed. This news has
got to be some of the most devastating, and shocking,
news I've ever experienced in my entire professional
carriage career! I know from my 9 years of success at the
Chili's Restaurant location what people respond to for this
carriage business operation.., and these A-frame signs are
a simple, clean and effective means of this Christmas
carriage advertising. Please give me special permission to
use these two signs for this Christmas carriage operation
in Snider Plaza! They will only be there 3 months out of
the year... October, November and December.

and/or newspaper advertising, and I do not have a store
front to represent my business in Snider Plaza! I do have
the experience in this carriage industry that you have

I have enclosed a copy of the design of these signs. The
signs are a beautifu], simple and elegant, heavy ply-wood,
4 ff. tall by 2 ff. wide, and A-frame design, with smooth
white background and this enclosed design on both sides
of the signs We have just spent almost $700. on these
tw'o signs.., a large investment for my little company.., and
an investment I expected to have earned it's keep for
many years to come.
I had no idea the Town of University Park had this
ordinance to not allow any signs such as these. I have
been informed that you have before given special
permission to a parking company that worked in Snider
Plaza for their company's A4rame signs to be used in the
shopping center. I pray you will do the same for this very
special Christmas carriage business that will be such a
blessing for so many. The response I'm already getting is
absolutely unbelievable! It's still early in the season, and
I'm already getting an average of 15 phone calls per day
for these Snider Plaza Christmas carriages.., and it will do
nothing but get much busier as Christmas gets closer!
This success is all coming from these 2 little signs, and the
continued success depends on these very simple signs! I
beg of you, please let the signs stay! Let's please discuss
the location you could allow them to advertise this
Christmas carriage business that you have voted in to
operate in Snider Plaza.

SUBJECT: Hearing for Abatement of Nuisances at 4021 Marquette
BACKGROUND:
Our records indicate that the city has had complaints regarding the condition of the property at
4021 Marquette as far back as 1995, as a result of junk vehicles, defective sidewalks, or other
deteriorating conditions on the property. In each of these cases, the property owner, Mr. Cloyde
Buchanan Jr., was issued a citation for not bringing his property into compliance. In each of these
he failed to accept the citation or appear in court.
Mr. Buchanan had to be transported by ambulance to the hospital in April for breathing difficulties
and allowed a neighbor access to his home. The neighbor brought to our attention the fact that the
interior of the house was in a complete state of disrepair. Mr. Buchanan's daughter, Linda
Maclver, who was in town during her father's hospital stay asked for city assistance in getting
some of the debris removed from the home, which she received.
Since city building inspection staff has not been permitted to formally inspect the inside of the
residence by the property owner, but only through the description and photos fumished by the
neighbor, the following concems exist within the structure:
· Electrical Hazards
· Unsanitary Conditions resulting from rodent infestation
· Mold in walls and flooring as a result of holes in roof
· Roof, walls, floors, windows, and doors not properly sealed from outside.
As stated previously, we have not been able to perform a thorough inspection of the interior of the
residence, and more than likely would be able to add many more things to the above list. Section
3.201 of the University Code of Ordinances defines items such as those listed above as "public
nuisances" and states that such shall be abated, repaired, rehabilitated, demolished, or removed.
PUBLIC NOTICE: Notice to Property Owner as Required
RECOMMENDATION:
Staff recommends that the Council order the complete elimination of the stated nuisances on the
property at 4021 Marquette within thirty (30) days. In the event that the property owner does not
meet the Council imposed deadline, the City will proceed to carry out the work called for by the
Council's order and the cost of such work shall be levied as a tax against the premises.

ORDER FOR ABATEMENT OF PUBLIC NUISANCE
On the 2nd day of November 2004, the City Council of the City of University Park,
Texas, considered a notification by the Director of Public Works that a public nuisance
existed at 4021 Marquette and that the owner, Cloyde Buchanan, Jr., or occupant had
failed, neglected or refused to comply with notice from the Director of Public Works to
commence the required demolition, improvement or repairs, and the City Council, having
considered the complaint of the Director and the response of the owner at the public
hearing on this date, finds and determines that:
1. The buildings on the property contain an accumulation of trash, debris, refuse
and junk which tend to block ingress and egress, pollute the atmosphere, and
are dangerous to the health and welfare of the community because they have
become a haven for rats and mosquitoes; and
2. The buildings on the property are unsightly due to lack of paint and general
condition, are dangerous due to structurally unsafe roof and floor members left
open to the elements; and
3. Unsanitary conditions exist inside the structure(s) as a result of rodent
infestation, mold, damp conditions, and being left open to the elements; and
3. That the condition of the property constitutes a public nuisance within the
meaning of Section 3.201 (b) of the University Park Code of Ordinances.
The City Council further finds that the owner has been given notice as required by
Section 3.202 of the University Park Code of Ordinances and has failed, neglected or
refused to comply with said notice to remedy, remove, or correct the above violations at
4021 Marquette, all of which constitute public nuisances.
The City Council further finds that a diligent effort has been made to discover each
mortgagee and lien holder having an interest in the building or in the property on which the
building is located, and has determined that there are no mortgagees or lien holders having
any such interest.
It is therefore ordered that the owner, Cloyde Buchanan, Jr., and any occupant
proceed with the work specified in the notice given to the owner to remedy, remove, or
correct the above nuisances on the premises at 4021 Marquette, and if the owner or
occupant of said premises fails or refuses to do so within days after a copy of this
Order has been delivered to the owner in person or sent by letter to his last known address
by certified mail, the Director of Public Works is directed to perform such work and the

cost of such work shall be levied as a tax against the premises and the owner thereof,
which cost shall be and become immediately due thereon.
This Order has been passed by a vote of the City Council of the City of University
Park, Texas, Council Members voting in favor of such Order, and
Council Members voting against such Order, on this 2nd day of November
2004.

Extension of deadline for 4305 Greenbrier - Kelmeth Crozier
BACKGROUND:
Mr. Kenneth Crozier appeared at the October 20th City Council meeting unable to explain why he
had not met the sixty (60) day deadline for correcting the violations on his property that had been
imposed by the Council in August. The violations specifically consist of the need to eliminate the
junk, debris and overgrowth on the property, as well as painting all of the exposed wood on his
house and detached structures. When asked why he refused to allow city staff on his property to
inspect for compliance, Mr. Crozier stated that he believed that he would be opening himself to
possible additional prosecution. He insisted that he could correct all of the problems if he was
given enough time. It was noted again at this meeting that staff had been working with Mr.
Crozier on this matter since October of last year.
Council Members Walker and Carter agreed to set up an appointment with Mr. Crozier which they
could walk the subject property with him and observe the progress that he has made in the clean up
since being contacted by Code Enforcement. I encouraged them to include my additional Code
Enforcement Officer, Russell Craig, whenever they were able to agree upon a date and time to
inspect the property.
PUBLIC NOTICE: N/A
RECOMMENDATION:
We will determine the current status of Mr. Crozier's property based on observations made by Kelly
Walker and Syd Carter. The Council can determine if further time is warranted or if the city should
hire a contractor to immediately correct the violations.

Request for twol5 minute parking spaces at 4347 Lovers Lane
The owner of Avon Cleaners located at 4347 Lovers Lane has submitted a request for two
(2) fifteen minute parking spaces on the south side of Lovers Lane. The spaces are
currently subject to a two hour time limit. The owner, Stacy Godo, has collected
signatures from a majority of property owners along the 4300 block indicating their
approval of the proposed fifteen minute parking spaces.
Modifying the current two hour time limit to a fifteen minute limit requires Council
approval of an ordinance specifying the exact location of the proposed parking spaces.
RECOMMENDATION:
Staff recommends Council approve the request.

park a motor vehicle for an amount of time exceeding fifteen minutes in the two parking spaces
along the south side of the 4300 block of Lovers Lane and immediately adjacent to 4347 Lovers
Lane, said parking spaces being depicted in Exhibit "A" attached hereto and made a part hereof.
SECTION 2. That all provisions of other ordinances of the City of University Park in
conflict with the provisions of this ordinance be, and the same are hereby, repealed.
SECTION 3. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not
affect the validity of this ordinance as a whole, or any part or provision thereof, other than the part
decided to be invalid, illegal or unconstitutional.
SECTION 4. That any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of
University Park, Texas, shall be subject to a fine not to exceed the sum of two hundred dollars
($200.00) for each offense.

SECTION 5. That this ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide. The parking
restriction set out herein shall not be effective until appropriate signs giving notice thereof shall
have been erected as provided by the Code of Ordinances.

ITEM:
The November 2, 2004, City Council agenda includes an ordinance that would amend the
FY2005 budget to carry forward $545,293.97 encumbered at the end of FY04, thus
making the funds available for expenditure in the current fiscal year. The specific amounts
per department and line-item account are provided in the attached exhibit. Overall, the
totals by fund are:
· General Fund $362,591.22
· Utility Fund $181,307.10
· Sanitation Fund $ 1,395.65
By comparison, total encumbrances for last year amounted to $1,104,513, including
$659,590 from the General Fund, $428,436 from the Utility Fund, and $16,487 from the
Sanitation Fund. Without this amendment, the City could not expend these funds without
exceeding the adopted budget.
RECOMMENDATION:
The encumbrance carryforward is presented to the Council each year as a routine item.
City staff recommends approval of the attached ordinance.

Acceptance of Renewal Quote for Individual Stop Loss Coverage for Self
Insured Health Plan
As part of the normal renewal process for our health plan, our broker, The Jensen Company,
obtains quotes for individual and specific stop loss coverage. For the current year, we have
coverage that limits our liability to $60,000 for individual claims as well as aggregate stop-loss
coverage. We have not received firm quotations regarding the aggregate coverage. The broker
has obtained an individual stop loss quote from the current carrier, National Benefit Resources, for
$263,892 (current year cost $216,600). The quote is valid until November 15th. After that date, it
is subject to review and adjustment based on additional claim information.
Acceptance of the bid will freeze the cost of the coverage but will allow the City to continue to
shop the coverage for better quotations at the current and alternative stop loss points. If one is
obtained from another carrier, we can change. Presently, we do not recommend increasing to the
$75,000 loss point provided as an altemative in the National Benefit Resources quotation.
We have reviewed the quote with Bill Clifton, Chair, and Roger Lamboum of the Employee
Benefits. Both recommended that we accept the bid and execute the necessary documents.
RECOMMENDATION:
Staffrecommends authorizing the acceptance of the bid. If additional information is
needed, please let us know.

Art Objects in the Front Yard
BACKGROUND:
As a result of the placement of the "horse & rider" in the front yard of the new home at 4000
University Blvd., I have been asked to bring the issue of art objects located in the front yard of
residential properties before the Council. Section 8-608 (3) of the Zoning Ordinance permits
"Free standing colunms, statuaries, bird baths, pedestals, and other art objects" to be located in the
required front yard in residential districts. Since there is no definition for "other art objects",
sculptures or statues similar to the one in question or larger, or located closer to the street cannot
be regulated as long as they are on private property.
PUBLIC NOTICE: N/A
RECOMMENDATION:
If the Council sees a need for discussion, the Zoning Ordinance Advisory Committee (ZOAC) would
have to recommend any amendment of Section 8-608. The results of that discussion will be brought
back to the Council at a future meeting.

Dear City Officials,
I want to report a possible stolen item that is right down the street from
you. It looks like a statue from the Dallas Convention Center's" Cattle
Drive" has landed in the front yard of a house down the block on
University. If this is indeed not stolen property then University Park with all
it's strict codes must have one against putting such an eyesore in one's
front yard. I am a Rock and Roll fan and if I were to put a larger than life
statue of Elvis Presley in my yard I suspect a city official would pay me a
visit about my "eyesore". Or maybe I am a fan of Surfing instead of
Cowboys and I put a 10 foot surfer riding a wave in my yard. Is that OK? If
the property owner had a house in the Volk estates and wanted it in the
back yard then that should be his business. But to put such a ridiculous
piece that is so out of proportion to the lot size in a front yard makes the
block as well as the community a laughing stock. I pity the poor neighbors
who have to see such a joke outside their window every day and watch as
cars slow down to gawk at such extreme bad taste.
Unfortunately, it is people like this that move into the Park Cities and feel
the need to show off their bad taste to get attention that degrades such a
beautiful community for the rest of us. I am sorry for everyone on
University Blvd. that has to deal with such an eyesore on a daily basis.

SUBJECT: Presentation of wastewater flow monitoring results.
Background. In 1996 GSWW Consulting Engineers performed extensive testing and
monitoring of the City's sanitary sewer collection system to identify sources of extraneous
flows (stormwater / groundwater) infiltrating into the system. That infiltration/inflow (I/I)
coupled with the City's normal wastewater flows and other factors resulted in downstream
capacity issues (i.e., overflows from surcharging manholes). That study identified a
considerable list of locations in need of replacement, which has served as a source of high
priority capital improvements for the past eight years. Virtually all of the aforementioned
priority replacements have been completed and we contracted with GSWW to perform
additional monitoring to determine whether our replacement program has been successful
in reducing the amount of I/I in our system.
Discussion. Charles Wilmut, President of GSWW, will provide a brief presentation to
the Council regarding his analysis of the infiltration/inflow in the City's collection system.

issue and that the city requires sidewalk repair or installation when a building permit is

Public Works Director Bud Smallwood indicated that the costs given to the committee
were a worse case scenario, and that the tax increase would not be as high as the report
indicated.
Ms. Davidson questioned how many people actually know it is the property owner's
responsibility for sidewalk maintenance.
Mr. Pulliam indicated that he favors the city taking over responsibility since the use of
sidewalks is a community interest, not just an interest for each individual property
owners.
A discussion also ensued regarding what other cities do for sidewalk maintenance. The
City of Highland Park maintains the sidewalk; Plano requires citizen maintenance; and
Mesquite pays for half of the costs associated with sidewalk repair and installation.
A motion was made by Mr. Walsh, seconded by Mr. Moore that the city continues its
current practice of requiring the property owner to repair and install sidewalks. The
motion passed with 6 in favor and 2 against (Mr. Hagens and Mr. Pulliam).
