convened into Closed Executive Session for the purp ose of seeking confidential legal advice

SUBJECT: Combination of One - Half Days of at Christmas and New Year
The City’s holiday schedu le calls for employees to have paid holidays on Christmas Day
and New Year’s Day along with one - half day on both Christmas and New Year’s Eve.
For 2003, Christmas is on Thursday. I am recommending that we modify and schedule a
th
full day off on Friday, Dec ember 26 . This would mean all City facilities would be
th th
closed on Thursday and Friday, December 25 and 26 . Police and Fire would continue
to operate in their normal manner. Sanitation, which normally works 10 - hour days on
Monday, Tuesday, Thursday , and Friday, would work Friday and Saturday but would
have all day Wednesday along with Thursday off. Any employee working a holiday has
the option to either receive an alternative day off or be paid for the day.

SUBJECT: Bid #03 - 12, Annual Contract for Bulk and Bagged Cement
Bid #03 - 12 for the purc hase of bulk and bagged cement on an annual contract basis was
opened October 2, 2003. This bid was posted on RFP Depot: 72 vendors received e - mail
or fax notice about the bid; 13 vendors viewed the bid. Three vendors returned bids.
Cemex submitted the l ow bid of $5.55 per bag on the bagged Type 1 Portland cement.
This price is $0.10/bag lower than last year's price. TXI submitted the low bid of $78.00
per ton on bulk Type 1 Portland cement. This price is $10.00/ton cheaper than last year's
price.
Bas ed on cement purchases in 2002, the City will spend approximately $42,500.00
through these contracts.
RECOMMENDATION:
Staff recommends accepting the low bids of Cemex and TXI to provide bulk and bagged
cement on an annual contract basis. A bid tabulati on and price history are attached.

Bid #03 - 13 for the purchase of ready - mix concrete on an annual contract basis was opened
October 2, 2003. This bid was posted on RFP Depot: 40 vendors received e - mail or fax
notice about the bid; 12 vendors downloaded a copy of the bid; five vendors returned bids.
Beall Concrete su bmitted the low bid of $65.00 per cubic yard. This price is $4.00 per
cubic yard less than last year's contract price. Collins Concrete submitted the second low
bid of $67.00 per cubic yard, and the Street Department would like to list them as a
secondar y, back - up vendor.
RECOMMENDATION:
Staff recommends accepting the low bid of Beall Concrete as the primary vendor to
provide ready - mix concrete on an annual contract basis. In addition, staff recommends
accepting the second low bid of Collins Concrete as the secondary vendor for this
commodity. A bid tabulation with price history is attached.

On September 15, 2003, the Planning & Zoning Commission approved a request by the
Highland Park Independent School District to allow an extension for the continued use of
existing portable classrooms through July 2008.

AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP OF THE
CITY OF UNIVERSITY PARK, AS HERETOFORE AMENDED, BY AMENDING THE
APPROVED SITE PLAN FOR PLANNED DEVELOPMENT DISTRICT NO. 17 FOR
THE HIGHLAND PARK HIGH SCHOOL AT 7015 WESTCHESTER DRIVE, MORE
PARTICULARLY DESCRIBED AS LOTS 1 - 9, BLOCK 9, OF METHODIST
UNIVERSITY ADDITION AND BLOCKS 1 AND 2 OF THE OXFORD MANOR
ADDITION, ADDITIONS TO THE CITY OF UNIVERSITY PARK, DALLAS COUNTY,
TEXAS; PROVIDING FOR THE REP EAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE

WHEREAS,
the Planning and Zoning Commission o f the City of University Park and the
City Council of the City of University Park, in compliance with the laws of the State of Texas
with reference to the granting of zoning classifications and changes, have given the requisite
notices by publication and o therwise, and have held due hearings and afforded a full and fair
hearing to all property owners generally and to all persons interested and situated in the affected
area and in the vicinity thereof, and the City Council of the City of University Park is o f the
opinion and finds that a zoning change should be granted and that the Comprehensive Zoning
Ordinance and Map should
be amended; Now, Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1.
That the Compr ehensive Zoning Ordinance and Map of the City of
University Park, Texas, as heretofore amended, be, and the same are hereby amended, by
amending the special conditions applicable to Planned Development District No. 17 for the
Highland Park High School, on property described as Blocks 1 and 2 of Oxford Manor Addition
and Lots 1 - 9, Block 9, of Methodist University Addition, additions to the City of University Park,
Dallas County, Texas, and more commonly known as 7015 Westchester Drive.
SECTION 2
. That the s pecial conditions applicable to Planned Development District No.
17 be, and are hereby, amended by providing that the portable building depicted on Exhibit “A”
attached to Ordinance 91/28 granting Planned Development District No. 17, the approved site
plan for the Highland Park High School, will be removed from the property by the property owner
not later than the first day of July 2008. That except as so revised, the special conditions and site
plan applicable to Planned Development District No. 17 shall remain in full force and effect.
SECTION 3.
That all ordinances of the City of University Park in conflict with the
provisions of this ordinance or the Comprehensive Zoning Ordinance as amended hereby be, and

the same are hereby, repealed.
SECTION 4.
Tha t should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, be adjudged or
held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this
ordinance or the Comprehensive Zoning Ordinance as a whole, or any part or provision thereof,
other than the part decided to be invalid, illegal or unconstitutional.
SECTION 5.
That any person, firm or corporation violating any of the provisions or
t erms of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, shall be
subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of
University Park, Texas, and upon conviction in the municipal court of the City of University Park,
Texas, shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for
each offense, and each and every day such violation is continued shall be deemed to constitute a
separate offense.
SECTION 6.
Th at this ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide.

approval of an amended site plan for Planned Development District N o. 19 for the Highland Park
Middle School/McCulloch Intermediate School, on property described as Block E of the
University Annex Addition, First Installment, an addition to the City of University Park, Dallas
County, Texas, and more commonly known as 3555 Granada.

SECTION 2 . That the amended site plan setting forth the land uses proposed for the
property is attached hereto as Exhibit “A” and made a part hereof for all purposes, the same as if
fully copied herein. That such amended site plan contains the data required by Sections 22 - 300
and 22 - 500 of the Comprehensive Zoning Ordinance.
SECTION 3. That the granting of the amended site plan for Planned
Development District No. 19 is subject to the following special conditions:
(a) That the portable class room buildings depicted on Exhibit “A” will be removed
from the property by the property owner not later than the first day of July, 2003;
(b) That all previous special conditions approved in the granting of Planned
Development District No. 19, shall rem ain in full force and effect, except as specifically amended
hereby.
SECTION 4. That all ordinances of the City of University Park in conflict with
the provisions of this ordinance or the Comprehensive Zoning Ordinance as amended hereby be,
and the same are hereby, repealed.

WHEREAS, the Planning and Zoning Commission of the City of University Park and the
City Council of the City of University Park, in compliance with the laws of the State of Texas
with reference to the granting of zoning classifications and changes, have given the requisite
notices by publication and otherwise, and have held due hearings and afforded a full and fair
hearing to all property owners generally and to all persons interested and situated in the affected
area and in the vicinity thereof, and the City Council of the City of University Park is of the
opinion and finds that a zoning change should be granted and that the Comprehensive Zoning
Ordinance and Map should
be amended; Now, Therefore,
BE IT ORDAIN ED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of
University Park, Texas, as heretofore amended, be, and the same are hereby, amended by
approval of an amended site pla n for Planned Development District No. 16 for the Robert S. Hyer
Elementary School, on property described as Lots 1 - 18, Block 39 of the University Heights No. 4
Addition, an addition to the City of University Park, Dallas County, Texas, and more commonly
k nown as 3920 Caruth.

SECTION 2 . That the amended site plan setting forth the land uses proposed for the
property is attached hereto as Exhibit “A” and made a part hereof for all purposes, the same as if
fully copied herein. That such amended site plan co ntains the data required by Sections 22 - 300
and 22 - 500 of the Comprehensive Zoning Ordinance.
SECTION 3. That the granting of the amended site plan for Planned
Development District No. 16 is subject to the following special conditions:
(a) That the por table buildings depicted on Exhibit “A” will be removed from the
property by the property owner not later than the first day of July, 2008;
(b) That all previous special conditions approved in the granting of Planned
Development District No. 16, as heret ofore amended, shall remain in full force and effect, except
as specifically amended hereby.
SECTION 4. That all ordinances of the City of University Park in conflict with
the provisions of this ordinance, or the Comprehensive Zoning Ordinance as amende d hereby, be,
and the same are hereby, repealed.
SECTION 5. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, be adjudged or
held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this
ordinance or the Comprehensive Zoning Ordinance as a whole, or any part or provision thereof,
other than the part decided to be invalid, illegal or unconstitutional.
SECTION 6. That any person, firm or corporation violating any of the provisions or
terms of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, shall be
subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of
Unive rsity Park, Texas, and upon conviction in the municipal court of the City of University Park,

Texas, shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for
each offense, and each and every day such violation is continued shall be deemed to constitute a
separate offense.
SECTION 7. That this ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide.

A recommendation was made by the Planning & Zoning Commission on March 17, 2003 to place
the following height restrictions on commercial properties:

PD - 2 - R (Miracle Mile) – 26 feet, with an additional 9 foot allowance for equip. &

Over the last several weeks, discussions have taken place with a number of Snider Plaza property
owners regarding the impact that the proposed height restrictions would have on their properties,
their ability to build on their property, or their ability to sell their property. After reviewing the
comments and suggestions from these property owners, it was suggested that staff, the Planning &
Zoning Commission, and the City Council exp lore other design opportunities for these retail
districts. A few height design options were presented by Taylor Armstrong, who had been asked to
assist in these discussions. It appears that an opportunity exists to implement various height
“restrictions ” that may result in more favorable roof and facade designs.

ITEM:
The Watermark Community Church has requested the use of Burleson Park for a
church picnic on November 2"a from 10:30AM until 2:00PM. They are expecting up
to 700 to attend. Since parking for so many will be a problem, the church was asked
to see if SMU would allow them to use the parking garage at the corner of Airline
and Daniel. They say they talked to SMU and were told that the garage was a
public facility and available for their use.
Attached is their letter outlining the activities and equipment they would plan to
have at the park.
RECOMMENDATION:
As long as the church uses the parking garage and pay the appropriate fees, staff is
willing to grant their request.

SUBJECT: Discuss utility replacement issues associated with the
reconstructi on of Lovers Lane.
Background. During the recent design of Lovers Lane (Hillcrest to NCE) staff
discovered an existing sanitary sewer in the intersection of Hillcrest and Lovers Lane
that is so shallow that it will interfere with the reconstruction of t he pavement. After
considerable review of the matter, we find that the only solution is to install a new
sanitary sewer from Thackery to Hillcrest. Thackery is the closest location with
sufficient depth to correct the problem.
An alternative would be to n ot reconstruct the Hillcrest intersection at this time, and
address the issue when the Hillcrest / Thackery section of Lovers Lane is
reconstructed at some future date. That certainly is a quick solution to the problem.
However, at that time, the traffic a t Central Expressway will not be blocked off, and
dealing with Hillcrest and Lovers Lane traffic will be a "real opportunity".
We will have more detailed information at Wednesday's Council meeting regarding
an estimate of the additional cost to the proje ct, proposed scheduling, and traffic
issues near UP Elementary School.
Recommendation. Staff would solicit direction from the City Council regarding this
matter.

SUBJECT: Discussion Regarding Proposed Storm Water Utility
ITEM:
An unfunded federal mand ate promulgated by the Environmental Protection Agency will
take effect for local governments beginning in 2004. The mandate, administered by the
Texas Commission on Environmental Quality (TCEQ), requires cities to initiate several
new activities aimed at improving the quality of storm water. The City contracted with
HDR Engineering to assist us with the creation of a storm water management plan, which
must be submitted to the TCEQ. Compliance with the new law will mean increased
expenditures for the Cit y of University Park. A significant portion of the hard surfaces,
which contribute to storm water runoff, within the City are owned by entities which do not
contribute tax dollars to the City. Consequently, the financial burden of complying with
the new legislation falls entirely on those individuals and businesses that currently pay
property taxes.
In an attempt to make the financial burden of this new program more representative of the
contributions to the problem, staff has pursued the feasibility o f a storm water utility that
would be paid by all property owners within the City (governmental entities, city and
HPISD excluded). HDR's scope of work was expanded to include a feasibility study for
the creation of a storm water utility. HDR has worked with staff to develop a proposed
storm water utility rate structure. Great effort was made to ensure that the fee charged to
each resident would be uniformly based on the property's contribution to storm water
runoff. HDR representatives will be present at the meeting to discuss their process and
findings. There is a significant amount of data collection involved in this process. Staff is
still collecting that data and forwarding it to HDR. When the data collection is complete,
HDR will provide the Cit y with a final report on its findings. We hope to have that report

available to the Council for review prior to the meeting on the 22 . Given Council
direction, staff is prepared to present HDR's report to the Finance and Public Works
Advisory Committee s within the next couple of weeks. We would then bring the item,
along with committee recommendations, back before the Council for action.

SUBJECT: Consider proposal from GSWW, Inc to provide engineering
services as sociated with sanitary sewer collection system flow
metering and analysis.
Background. In 1996, GSWW, Inc. developed a report that identified certain
deficiencies in the City's sanitary sewer collection system. Specifically, the
consultant performed met ering and smoke - testing to locate sources of extraneous
flows (groundwater and runoff from rainfall events) and compared flow data during
dry and wet - weather periods.
In the seven years since the aforementioned Study, staff has administered several
projec ts involving reconstruction of identified sources of infiltration - inflow (I/I). The
attached proposal, in the amount of $38,080, details the engineering services
associated with quantifying the anticipated reduction in I/I in our sanitary sewer
system. The results should also address wet - weather flows / capacity in the trunk
sewer through Highland Park.
Recommendation. Staff recommends City Council approval of the proposal from
GSWW, Inc to provide engineering services associated with sanitary sewer
collec tion system flow metering and analysis.

The October 22, 2003 City Council agenda includes an ordina nce that would amend the
FY2004 budget for two reasons:
1. To carry forward funds encumbered at the end of FY03, thus making them
available for expenditure in the current fiscal year. The total encumbrances of
$1,104,513 include $659,590 from the General Fu nd, $428,436 from the Utility
Fund, and $16,487 from the Sanitation Fund. By comparison, encumbrances
carried forward last year totaled $645,034. A list of the specific accounts,
vendors, and amounts is attached. Without this amendment, the City could n ot
expend these funds without exceeding the adopted budget.
2. To authorize the transfer of $4,549,308 from the annual operating budget to the
Capital Projects Fund ($2,681,063 General Fund; $1,868,245 Utility Fund). The
use of these funds for capital proje cts was approved as part of the budget adoption
process; the attached ordinance merely formalizes the transfer. The amounts and
intended projects are listed in the attached exhibit.
RECOMMENDATION:
Both the encumbrance carryforward and the capital proje ct transfers are presented to the
Council each year as a routine item. City staff recommends approval of the attached
ordinance.

WHEREAS, the City Council of the City of University Park has determin ed that it

2004 general fund and utility fund into the capital projects fund; Now , Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

SECTION 1. That Ordinance No. 03/22, the 2003 - 2004 fiscal year budget
ordinance of the City of University Park, Texas, be, and the same is hereby, amended to
carry f orward to the 2003 - 2004 fiscal year encumbrances authorized in the 2002 - 2003
budget, but not expended during such fiscal year. That a complete listing of such
encumbrances, as they existed as of the beginning of the current fiscal year, is attached
hereto as Exhibit “A” and made a part hereof for all purposes. That all of such
encumbrances, totaling $659,590.34 of general fund encumbrances, $428,435.77 of utility
fund encumbrances, and $16,486.53 be, and the same are hereby, approved and carried
forward i nto and made a part of the 2003 - 2004 fiscal year budget of the City.
SECTION 2. That a general fund appropriation in the amount of $2,681,063 and
a utility fund appropriation in the amount of $1,868,245 are hereby made to be designated
for the capital pro jects fund, and to be used for the projects listed in Exhibit “B” attached

Attached are memos from Jim Ga u, Jr., Fleet Manager, describing a 16 - yard rear loader
(Sanitation) and three 5 - 6 yard dump trucks (one for Streets, two for Utilities) scheduled
for replacement this year. Replacement vehicles are available through the Houston -
Galveston Area Council of Governments (H - GAC) Cooperative Purchasing Program. The
City has had an interlocal agreement for cooperative purchasing with H - GAC since 1994.
Purchases made through H - GAC fulfill all competitive bidding requirements.
The rear loader purchase price is $84,664.85 from Santex Truck Center in San Antonio.
This is 4% more than the last rear loader purchased in December 2001 for $81,043.00 via
Bid #02 - 02.
The purchase price for each of the three dump trucks is $51,975.92 ($155,927.76 total).
This is $5,73 2.08 less per truck than the last dump truck purchase in February 2001 via
Bid #01 - 03. The specifications in both instances are identical.
The total cost for all four vehicles is $236,970.76.
RECOMMENDATION:
Staff recommends purchasing these vehicles through H - GAC in the total amount of
$236,970.76.

Attached please find the requisition, HGAC pricing, and specifications to purchase a
16 - yard rear loader for the Sanitation Department. This unit will replace Unit 1625,
which is a 1992 GMC that went into service in November of 1991.
This purchase is being made through the Houston Galveston Purchasing
Cooperative and Santex Truck Center, their approved dealer in San Antonio, Texas.
The price of the chassis is $ 47,739.85 and the body is priced at $ 36,925.00. This
m akes the total cost for the new unit $ 84,664.85. This is an increase of $ 3,621.85,
which is roughly a 4% increase in two years.
The last rear loader we purchased was in December of 2001 and we paid
$ 81,043.00 for that unit.
It is requ ested that this item be placed on the next council agenda as the current
HGAC contract expires at the end of the month and the new contract, which begins
November first, will have a $1,700.00 price increase associated with it. The P.O. will
need to be date d prior to November first to avoid the price increase.

S ubject: Purchase of 5 - 6 Yard Dump Trucks
Units 1811, 2539, and 2739 are 1988, 1987, and 1989 five - yard dump trucks that
are being replaced this fiscal year. We are using the exact specifications on these
replacements that we have used for the past ten yea rs. These specifications are
providing us with good units that are performing well for the City. We expect at least
fifteen years of service from each of these units.
We are purchasing these through Houston - Galveston Buying Cooperative and they
are priced at $ 51,975.92 each. These are International 4300 Series trucks of which
we have several, and they have provided excellent service for us.
We last purchased trucks with these specifications, 2002 Sterling Aceteras, in
February 2001 and paid $ 57,708.00 per truck.
Attached please find a requisition for the purchase of these trucks. The contract
through HGAC runs out on October 31, 2003 and the P.O. needs to be received prior
to that date so please place on next weeks Council Agenda. I am advised the pri ce
will increase 1,700.00 after that date, on the next contract.
