AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS,
AMENDING THE CODE OF ORDINANCES OF THE CITY OF UNIVERSITY
PARK, AS HERETOFORE AMENDED, BY AMENDING ARTICLE 2.300 OF
THE CODE OF ORDINANCES TO PROVIDE REGULATIONS FOR THE
KEEPING OF FOWL; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR
THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A
SEVERABILITY UNDRED DOLLARSG($500.0 ) FOR EACH OFFEN EO AND
EXCEED FIVE H
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
UNIVERSITY PARK, TEXAS:
SECTION 1. That Article 2.300 of the Code of Ordinances, City of University
Park, is amended to read as follows:
"ARTICLE 2.300 FOWL
A person commits an offense if he possesses, keeps, or harbors a chicken, rooster, chick,
turkey, duck, duckling, pigeon, or any other fowl within the city."
SECTION 2. All ordinances of the City of University Park in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 3. An offense committed or permit issued before the effective date of
this Ordinance is governed by prior law and the provisions of the Code of Ordinances in
effect when the offense was committed and the former law is continued in effect for this
purpose.
SECTION 4. Should any word, sentence, paragraph, subdivision, clause, phrase
or section of this ordinance, or the Code of Ordinances, as amended hereby, be adjudged
or held to be unconstitutional, illegal or invalid, the same sha11 not affect the validity of
this ordinance as a whole or any part or provision thereof, other than the part so declared
to be invalid, illegal or unconstitutional, and shall not affect the validity of the Code of
Ordinances as a whole.
SECTION 5. Any person violating any of the provisions of this ordinance of the
Code of Ordinances as amended hereby shall be deemed guilty of a misdemeanor and,
upon conviction in the Municipal Court, fined in an amount not to exceed five hundred
dollars ($500.00) for each offense.
SECTION 6. This ordinance shall take effect immediately from and after its
passage, as the law and Charter in such cases provide.
DULY PASSED by the City Council of the City of University Park, Texas, on
the 20~" day of May 2008.
