CITY COUNCIL MEETING
CITY OF UNIVERSITY PARK, TEXAS
COUNCIL CHAMBER - CITY HALL MODULAR BUILDING
TUESDAY, MAY 13, 2008, 4:15 P.M.
Mayor Holmes opened the special City Council Meeting at 4:15 p.m. in the Fire Department
Training Room in City Hall. Present were Mayor Pro-Tempore Harry Shawver and
Councilmembers Syd Carter, Jerry Grable and Kelly Walker. Also in attendance were City
Manager Bob Livingston and City Secretary Kate Smith.
MAIN AGENDA
PUBLIC HEARING ON AN ORDINANCE AMENDING SECTION 22-101 (4) (B) VI TO
REGULATE GARAGE ENTRIES FACING A SIDE STREET IN MULTIPLE-FAMILY
DWELLING DISTRICTS. Residents in the multi-family neighborhood west of Snider Pla.za have
addressed the City Council in recent meetings regarding the current construction policies in the
multi-family districts and that they allow for garage doors facing the side street. The cumulative
result on the corner the lots presents the appearance of a"warehouse use" that negatively impacts
the neighborhood. Council received a report on February 12, 2008 and provided direction to staff
to amend the current zoning ordinance to prohibit garage doors that face a side street in the multi
family districts. This item was discussed with the Multi-Family Development Standards Committee
on Monday March 17, 2008 and then reviewed with the Zoning Ordinance Advisory Committee on
Tuesday April 22, 2008. Both Committees unanimously recommended approval. Mayor Holmes
sought clarification from Community Development Manager Harry Persaud that this ordinance
would not allow garage doors to face the streets in the multi-family districts. Mr. Persaud
confirmed that fact. Councilmember Carter verified that this restriction was city-wide, not just in
the multi-family area adjacent to Snider Plaza. Mr. Persaud confirmed. Mayor Holmes opened the
public hearing. Seeing no one present to speak on the issue, Mayor Holmes closed the public
hearing.
CONSIDER AND ACT ON AN ORDINANCE AMENDING SECTION 22-101 (4) (B) VI TO

DWELLING DISTRICTS. Councilmember Grable moved approval of the ordinance amending
section 22-101 (4) (b) vi to regulate garage entries facing a side street in multiple-family dwelling
districts. Councilmember Carter seconded, and the vote was unanimous to approve the ordinance

COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF UNNERSITY PARK, AS
HERETOFORE AMENDED, BY AMENDING SECTION 22-101 (4) (b) vi TO REGULATE
GARAGE ENTRIES FROM SIDE STREETS IN MULTIPLE-FAMILY DWELLING
DISTRICTS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT;

PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO
EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE;
AND PROVIDING AN EFFECTIVE DATE.
CONSIDER AND ACT ON AN ORDINANCE AMENDING SECTION 22-101 OF THE
ZONING ORDINANCE TO ADD SUBSECTION (5) TO PROVIDE STANDARDS FOR
SINGLE-FAMILY ATTACHED (SF-A) DEVELOPMENT IN MULTIPLE-FAMILY
DWELLING DISTRICTS. The current development trend in the multi-family district is
characterized by the demolition of existing duplexes and the construction of new four unit
buildings. The result is a dramatic change of existing neighborhoods with larger buildings and
higher densities. Over the past year, following direction from the City Council, ordinances were
put in place in the multi-family districts, to require additional off-street parking, limit the number
and spacing of driveways, and to establish minimum standards for driveway ramps to underground
parking garages. The current zoning ordinance allows for duplex (D-1) and single family attached
(SF- A) developments in the multi-family districts. The proposed ordinance provides detailed
development standards for promoting single family (SF-A) construction in the multi-family
districts. This item was discussed by the Multi-Family Development Standards Committee on
March 17, 2008 and then reviewed with the Zoning Ordinance Advisory Committee on Tuesday
April 22, 2008. Community Development Manager Harry Persaud noted that the permeable
coverage is the same; it has just been rearrange to allow for approximately 70% of structures to be
built in the rear. Mayor Holmes clarified with Mr. Persaud that the builders were in favor of this
amendment. Mr. Persaud stated that they were. Mayor Holmes noted that this ordinance should
work to reduce density in the area. He noted that, over time, if it does not, the City may want to
look into re-zoning the properties to reduce density. Mayor Holmes asked Mr. Persaud to keep the
City Council updated on this issue. Mayor Holmes opened the public hearing. Seeing no one
present to speak on the issue, Mayor Holmes closed the public hearing.

ordinance amending section 22-101 of the zoning ordinance to add subsection (5) to provide
standards for single-family attached (sf-a) development in multiple-family dwelling districts.
Councilmember Walker seconded, and the vote was unanimous to approve the ordinance amending

INAUGURATION AND RECEPTION FOR NEW CITY COUNCIL
At 5:00 p.m. the City Council Inauguration was held in the Fire Department Day Room. Municipal
Court Judge James P. Barklow, Jr. swore in the 2008-2010 City Council which includes: Mayor
James H. Holmes, III, Councilmember Kelly Walker, Councilmember Syd Carter, Councilmember
Jerry Grable and Councilmember Robert Clark. Mayor Pro Tempore Harry Shawver stepped down
due to term limitations. Mayor Holmes thanked Mr. Shawver for his service to the City of
University Park and presented him with his nameplate and rocking chair. City Manager Bob
Livingston also thanked Mr. Shawver for his service and presented him with a watch and street
sign. Following remarks by Mayor Holmes, the inauguration ceremony adjourned and a reception
was held in honor of the new City Council.
