AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF UNIVERSITY PARK, AS
HERETOFORE AMENDED, BY AMENDING SECTION 21-100 (4) TO ADD SUBSECTION
(e) TO PROVIDE FRONT ARTICULATION INCENTIVES IN SINGLE-FAMILY
DWELLING DISTRICTS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN
CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF
FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR
EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission of the City of University Park and the City
Council of the City of University Park, in compliance with the laws of the State of Texas with
reference to the granting of zoning classifications and changes, have given the requisite notices by
publication and otherwise, and have held due hearings and have afforded a full and fair hearing to all
property owners generally, and City Council of the City of University Park is of the opinion and finds
that said zoning changes should be granted and that the Comprehensive Zoning Ordinance should be
amended; Now, Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK,
TEXAS:
SECTION 1. That Section 21-100 (4) (e) of the Comprehensive Zoning Ordinance of the City
of University Park, Texas, is hereby amended to add subsection (e) read as follows:
"21-100 Single-Family Dwelling Districts
(4) Special Yard Requirements
(e) Front Articulation Incentives
i. To provide incentives for articulation on the front fa~ade of single-family homes on lots less than
sixty feet (60') in width, a design based upon the illustrations shown below may be used as an
alternative to the Front Yard and Rear Yard requirements of this section:
1. In Alternative 1(see illustration below):
a. Area B must be larger than Area A;
b. Area C cannot exceed Area B;
c. Area B must be behind the Front Building Line;
d. No front fa~ade wall plane shall exceed 60% of the entire front fa~ade width;
e. All other side massing and roof requirements shall apply; and,
f. When an extension into the required rear yard is a result of the use of this alternative, the
42% vertical side wall length in excess of twelve feet six inches (12' 6") and the vertical
wall surfaces exceeding twelve feet six inches (12' 6") located closer than 40 feet to the
rear property line, may be reduced only to achieve the extension, not to exceed 3', into
the required rear yard. (Refer to Section 21-100 (3) (a))
2. In Alternative 2A (see illustration below):
a. Area B must be at least 50 % of Area A;
b. Area B must be behind the Front Building Line;
c. No front fa~ade wall plane width shall exceed 60% of the entire front fa~ade width; and,
d. All other side massing and roof requirements shall apply.
3. In alternative 2B (see illustration below):
a. Area B must be at least 50 % of Area A;
b. Area B must be behind the Front Building Line;
c. No front fa~ade wall plane width shall exceed 60% of the entire front fa~ade width; and,
d. All other side massing and roof requirements shall apply.

When the extension into the rear yard is a result of
this facade articulation incentive, the 42% slde wall
length requirement and the 40'-foot rear setback
requirement may be reduced only to achieve the
3'-foot extension into the rear yard.

SECTION 2. All ordinances of the City of University Park in conflict with the provisions of
this ordinance are hereby repealed.
SECTION 3. Should any word, sentence, paragraph, subdivision, clause, phrase or section of
this ordinance, or the Comprehensive Zoning Ordinance, as amended hereby, be adjudged or held to be
unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or
any part or provision thereof, other than the part so declared to be invalid, illegal or unconstitutional,
and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole.
SECTION 4. That any person, firm or corporation violating any of the provisions of this
ordinance or the Comprehensive Zoning Ordinance, as amended hereby, shall be deemed guilty of a
misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas, shall
be punished by a fine to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each
and every day such violation shall continue shall be deemed to constitute a separate offense.
SECTION 7. This ordinance shall take effect immediately from and after its passage and the
publication of the caption, as the law and Charter in such cases provide.
DULY PASSED by the City Council of the City of University Park, Texas, on the 17t" day of
June 2008.
