HomeMy WebLinkAboutOrdinance No. 05 37 Rl Est SignORDINANCE NO. 0 5 / 3 7 AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF UNIVERSITY PARK, CHAPTER 12, SIGN REGULATIONS, BY AMENDING SECTION 12.202 TO AMEND THE DEFINITION OF REAL ESTATE SIGN; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. That Chapter 12, Article 12.200, Section 12.202, of the Code of Ordinances, City of University Park, Texas, is hereby amended in part to add the following: "Sec. 12.202 Definitions (22) Real Estate Sign(such as a "For Sale," "For Lease," "For Rent," Sign). Shall mean a sign indicating that the premises on which the sign is located, or any portion thereof, is for sale, for lease, or for rent, and containing any of the following information: a description of the premises offered for sa!e, lease, or rent; special facilities or appurtenances; and, the n.ame, 'address, and telephone number of the owner, broker, or other person offering the same for sale, lease, or rent. The sign may include information with respect to the availability of special financing and the stares of the sale of the subject property, such as "sold" or "contract pending". SECTION 2. All provisions of the Code of Ordinances of the City of University Park, Texas, in conflict with the provisions of this ordinance are hereby repealed. SECTION3. That should any word, sentence, paragraph, subdivision, 77613 clause, phrase or section of this ordinance or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION4. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas, shall be punished by a fine not to exceed the stan of five hundred dollars ($500.00) for each offense, and each and every day any such violation shall continue shall be deemed to constitute a separate offense. SECTION 5. This ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide.
