The City Council met in an open work session to receive briefings from staff on agenda items.
Director of Public Works Bud Smallwood discussed the proposal on the agenda to create short-term
parking in specific areas of one block of Hillcrest. Mayor Pro Tem Grable said he had concerns
that if time limits were shortened in front of specific businesses as requested by shop owners, then
other businesses may want the same option. Mr. Smallwood stated that he had recently brought an
ordinance to the Council, which they approved, that was intended to bring more cohesive parking
time limits to Snider Plaza. Councilmember Begert asked if the limits were changed to 30 minutes
and found to be unworkable or unenforceable, could they be returned to the standard 2-hour limit.
Mr. Smallwood said yes.
Director of Parks Gerry Bradley reviewed the proposals for landscape renovations to Barns and
Williams Parks with the Council. He mentioned that after using the TIPS/TAPS bid process that
the total proposed costs were less than previously estimated to the Council. Mr. Bradley said he
would plan for the Williams Park project to be completed before the July 4 event in Goar Park and
for the Barns Park project to be completed by the end of July 2012.
Director of Finance Kent Austin discussed the proposed resolution amending the FY2012 Capital
Budget. He said the budget will be reduced by $495,000, due primarily to the postponement of a
$1,000,000 joint project with Highland Park until the next fiscal year.
Director of Human Resources Luanne Hanford briefed the Council about the potential contract with
a recruitment firm to assist the city in hiring a library director.

Manager George Ertle, City Secretary Liz Spector, Director of Public Works Bud
Smallwood, Director of Information Services Jim Criswell, and Community Information
Officer Steve Mace.
The Regular City Council Meeting was called into session at 5:00 p.m. in the Council Chamber at
City Hall. Present were Councilmember Begert, Councilmember Clark, Mayor Pro Tem Grable,
and Councilmember Stewart. Also in attendance were City Attorney Dillard, and City Manager
Livingston.
Mayor Davis was excused from the meeting due to illness.
Resident and business owner Lauren Sharng requested to address Item B on the consent
agenda. Mayor Pro Tem Grable called her to the lectern.
Lauren Sharng addressed the Council. She stated she owns a pilates studio in Snider Plaza
located at 6915 Hillcrest Ave. She said she received phone call earlier in the afternoon
informing her that the Council was taking action on a request to change parking times near
her business from a 2 hour maximum to a 30 minute maximum. Ms. Sharng said the classes
at her studio last 50 minutes. She told the Council that such a reduction of allowed parking
times would have a very negative impact on her business because her clients would have
nowhere to park. She said that her clients are usually parked for only one hour. Ms. Sharng
also mentioned that most of her business is conducted during off-peak times for the other
businesses in that area. She said the majority of her classes are scheduled between 6 and 10
in the morning and after 5 in the evening. She also stated her employees park behind the
studio.
Ms. Sharng said the property owner from whom she leases her space also owns the property
for some of the shop owners who are requesting the change. She said he was not aware of
the petition until this afternoon when she contacted him. Ms. Sharng said he said he was not
supportive of the request to change parking times.
Mayor Pro Tem Grable asked Ms. Sharng how many students are in each class. She said
there are 12 machines so there are no more than 12 students at one time.
Councilmember Begert asked Ms. Sharng how many classes per day she conducted. She
responded that some days there may only be three or four classes but some days there may be
eight.
Mayor Pro Tem Grable mentioned to Ms. Sharng that the three spaces in front of her business
would remain 2 hour spaces. Ms. Sharng said she was aware of that however, those
spaces would not be limited for use by her clients only, so this is not necessarily beneficial
II. CONSENT AGENDA
A. CONSIDER AND ACT: on minutes of the March 20, 2012 City Council Meeting

6900 block of Hillcrest and along the 4300 block of Lovers Lane

Ms. Sharng implored the Council to defer action on this item until she had time to speak with
others involved in the request to change the time limits.
Mayor Pro Tem Grable asked Director of Public Works Bud Smallwood if it was acceptable
to him if the Council tabled the request for further discussion and study. Mr. Smallwood said
it that was acceptable to him.
Councilmember Begert made a motion to approve Item A and table Item B of the Consent Agenda.
Councilmember Clark seconded, and the motion carried unanimously.
Director of Parks Gerry Bradley addressed the Council about their previous discussions
related to plans for landscape improvements to Barns Park and to Williams Park. He
said original cost estimates for improvements at both parks totalled $185,000 but by working
within the TIPS/TAPS Cooperative Purchasing Contract, the bids came in significantly less
at $150,000. Mr. Bradley said that bid was received from Gallagher Construction.
Mr. Bradley asked the Council to consider approval of those expenditures at this time which
would allow substantial portions of the Williams Park improvements to be completed before
the July 4 festivities at Goar Park. He said it would also allow the Barns Park improvements
to be completed by the end of July.
Mayor Pro Tem Grable asked if the Council had any questions for Mr. Bradley. Finding
none, he asked for a motion.
Councilmember Stewart made a motion to approve the proposed budget of $150,000 for
landscape improvements to Barns and Williams Parks. Councilmember Clark seconded, and
the motion carried unanimously.
Director of Finance Kent Austin addressed the Council regarding proposed modifications to
the FY2012 capital budget. Mr. Austin said the net result of the modifications is a reduction
of the FY2012 budget by $495,000 to $13.4 million.
Mr. Austin said staff reviewed the proposed changes with the Capital Projects Review
Committee at their March 19, 2012 meeting and the committee approved the changes.
Mr. Austin said the changes impacted the FY2012 capital budgets of Information
Technology, Parks, Public Safety and Public Works.
Councilmember Stewart asked about the large reduction. Mr. Austin said the reduction
largely results from deferring $1 million of a Public Works project to the next fiscal year. He
stated that the project is underway, but is behind schedule.
Mayor Pro Tem Grable asked if there were any other questions for Mr. Austin. There were

RESOLUTION NO. 12-02
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS, AMENDING THE FY2012 CAPITAL PROJECTS BUDGET FOR
THE CITY; AND PROVIDING AN EFFECTIVE DATE.
Luanne Hanford addressed the Council. She said in anticipation of the University Park
Public Library becoming a City department in October 2012, staff will need to recruit a new
library director. Ms. Hanford said the current director has indicated he will stay no longer
than the end of the year.
Ms. Hanford said she contacted several people for recommendations for a library recruiter
and Dan Bradbury & Associates was on the top of several lists. Ms. Hanford requested a
proposal from Mr. Bradbury and she said the proposal was very thorough and the fees
reasonable.
Councilmember Clark asked if using a recruiter was consistent with other hiring searches for
department directors. Ms. Hanford said recruiters were used to assist in hiring the current
police chief and current fire chief.
Councilmember Stewart asked how the cost of this contract compared with previous
recruitment firms. Ms. Hanford said the $18,000 contract was less than the city previously
paid for this level of recruitment.
As there were no other questions, Mayor Pro Tem Grable asked for a motion.
Councilmember Begert made a motion to approve a proposal in the amount of $18,000 plus
expenses from Dan Bradbury of Bradbury Associates to conduct a search for a new Library
Director. Councilmember Clark seconded, and the motion carried unanimously.
City Manager Bob Livingston addressed the Council regarding the request to hold a Special
Council Meeting on May 22, 2012 to canvass the May 12, 2012 General Election results.
He said the Council Meeting scheduled immediately following the Election is too soon after
the Election for the City Secretary to receive the certified results from the Dallas County
Commissioners Court as it is only two business days later. Mr. Livingston said the official
results must be received before canvassing the Election. He said this is why staff is
requesting a third May Council Meeting.
There were no questions and Mayor Pro Tem Grable asked for a motion.

THE CITY OF UNIVERSITY PARK, AS HERETOFORE AMENDED, BY
AMENDING PLANNED DEVELOPMENT DISTRICT NO. 10, MORE
PARTICULARLY DESCRIBED AS LOTS 1 AND 2, ROBERT JOHN SON
SUBDIVISION, AN ADDITION TO THE CITY OF UNIVERSITY PARK,
DALLAS COUNTY, TEXAS, AND COMMONLY KNOWN AS 6400
NORTH CENTRAL EXPRESSWAY; APPROVING A DETAILED SITE
PLAN AND LANDSCAPE DEVELOPMENT PLAN FOR PD-10; PROVID ING
SPECIAL CONDITIONS; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE;

WHEREAS, the Planning and Zoning Commission of the City of University Park and
the City Council of the City of University Park, in compliance with the laws of the State of
Texas with reference to the granting of zoning classifications and changes, have given the
requisite notices by publication and otherwise, and have held due hearings and afforded a full
and fair hearing to all property owners generally and to all persons interested and situated
in the affected area and in the vicinity thereof, and the City Council of the City of
University Park is of the opinion and finds that a zoning change should be granted and that
the Comprehensive Zoning Ordinance and Map should be amended; Now, Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
UNIVERSITY PARK, TEXAS;
SECTION 1. The Comprehensive Zoning Ordinance and Map of the City of
University Park, Texas, as heretofore amended, are hereby amended by amending
Planned Development District No. 10 for Lots 1 and 2, Robert Johnson Subdivision,
"Johnson Square", an addition to the City of University Park, Dallas County, Texas, more
commonly known as 6400 North Central Expressway, University Park, Texas, by adopting a
detailed site plan setting forth the land uses proposed for the amended PD-10, attached
hereto as Exhibit "A”, and a landscape development plan, attached hereto as Exhibit "B",
both made a part hereof for all purposes, the same as if fully copied herein. That such

detailed site plan and landscape development plan contain the data required by Section 17-
101(2) of the Comprehensive Zoning Ordinance, and are hereby approved in all respects.
SECTION 2. Approval of the detailed site plan and landscape development plan for
Planned Development District No. 10 is subject to the following special conditions:
A. Development of the property shall be in accordance with the detailed site
plan and landscape development plan submitted and approved in accordance with Section
17-101(2) and all other provisions of the Comprehensive Zoning Ordinance of the City of
University Park, as amended hereby, and, unless otherwise defined herein, all terms used shall
have the respective definitions assigned to them in the Comprehensive Zoning Ordinance;
B. The uses on the property shall be those allowed in the Commercial District,
except “household appliance service and repair”, “newsstand”, “pet shop and pet grooming
facility”, “repair shop for appliances, TVs etc.”, “studio for photographer, musician or
artist”, “animal clinic or hospital”, “college or university”, “building material sales”,
“cleaning and dyeing plants (commercial)”, “plumbing shops and electric shops”,
“scientific or research laboratory” and “places of worship”. Commercial uses shall not
exceed 4,500 square feet in area. Uses allowed in the Multi-family Dwelling Districts shall
be permitted; the various types of units, floor area layout and sizes shall be shown on the
final building plans. The configuration of one, two, and three bedroom units, sizes and floor
area layout may be changed by the owner prior to issuance of a building permit, provided
there shall be no more than 238 dwelling units. A Leasing Office, Lobby and other related
uses incidental to the maintenance and operation of the building may be provided, not to
exceed 5,150 square feet in area;
C. The buildings are subject to the conditions listed as follows:
1. Building Setbacks:
a. All building setbacks are measured from the property line;
b. A maximum of 20% of the total number of balconies may project a maximum of five
feet (5’) into a required setback;
c. The minimum front yard setback along U. S. 75 Service Road shall be 20 feet for

90% of the frontage and 15 feet for a maximum of 10% of the frontage;
d. Side yard setback on the south property line will be not less than 20 feet;
e. Side yard setback on Fondren Drive will be not less than 14 feet on the ground floor
and 10 feet for all other floors; and
f. Rear yard setback on the east property line will be variable: a minimum of 7 feet 3
inches on the south side of the building and a minimum of 21 feet 7 inches on the
north side of the building.
2. Building footprint, Gross Floor Area, Height, and Lot Coverage:
a. Maximum building footprint shall not exceed 78,000 square feet;
b. Gross floor area: Gross floor area shall not exceed 241,250 square feet;
c. Number of Stories and Maximum Height: The building will be a maximum of six
stories, including penthouse, not to exceed 80 feet in height; and
d. Maximum coverage: Maximum lot coverage is 78%.
3. Parking Standards:
a. The detailed site plan shall include a maximum of 44 compact spaces and a minimum
of 6 handicapped accessible spaces;
b. Multi-family units will provide 1 parking space per bedroom, with tandem parking
allowed for not to exceed 5% of all spaces permitted for multi-family uses,
provided all tandem spaces are clearly marked with the assigned unit number;
c. Retail uses will provide not less than 1 parking space per 200 square feet of gross
floor area;
d. Restaurant and personal services uses will provide not less than 1 parking space per
100 square feet of gross floor area; and
e. Office uses will provide not less than 1 parking space per 300 square feet of gross
floor area.
4. Landscaping: Development of the landscaping mu st be in substantial
conformance with the attached Landscape Development Plan.
5. Signage: All existing nonconforming signs on the property will be removed
within thirty (30) days after a building permit is i ssued for a new habitable
structure on the premises. All new signs on the site must follow the sign
regulations of the City in effect at the time of th e sign permit application.
Alternatively, the owner may request approval of a special sign district for the
property in accordance with Section 3.09.191 of the Code of Ordinances.

6. Dumpsters: Dumpsters shall be located as shown on the approved detailed site plan.
Residential trash will be picked up on the north east corner of the property and
commercial trash will be picked up on the south east corner. However, if DART does
not permit use of its right-of-way on the east side of the property, the owner will move
all trash collection to the north east corner of the property, to be accessed from Fondren
Drive, as shown on the approved detailed site plan. The final design of the placement of
the dumpsters is subject to the approval of the Director of Public Works.
7. Storm water capacity: Storm water capacity must be verified and coordinated with the
City of Dallas and detailed plans and calculations must be submitted to and approved by
the Director of Public Works before the issuance of a building permit.
8. The size and location of all water and sewer taps for the development must be reviewed
and approved by the Director of Public Works prior to the issuance of a building permit.
9. External Walls: In order to minimize any adverse impacts on motorists, pedestrians and
neighboring buildings, glass used for the glazing of the external walls of any building on
the property shall not have a reflectivity factor in excess of 27%. The plans submitted for
a building permit shall include the description and specifications relating to reflectivity
from the manufacturer of the materials to be used for glazing the external walls.
10. Access and Fire Lane:
Option A: In order to obtain a building permit, the owner must submit to the Director of
Public Works a formal approval from Dallas Area Rapid Transit (“DART”) granting an
easement or license for use of the DART right-of-way on the east side of the property for
access and the required fire lane.
Option B: In the event DART denies an easement or license, the owner will extend the
fire lane on the south west corner along the south property line, subject to approval of the
fire marshal.
11. Building Site: The property must be replatted into one lot before a building permit is
issued.
12. Overhead wires located on the property will be relocated or abandoned, except the
overhead wires along the south property line.
SECTION 4. That all ordinances of the City of University Park in conflict with the
provisions of this ordinance or the Comprehensive Zoning Ordinance as amended hereby
are hereby repealed.
SECTION 5. That should any sentence, paragraph, subdivision, clause, phrase or
section of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same
shall not affect the validity of this ordinance as a whole, or any part or provision thereof other

than the part decided to be invalid, illegal or unconstitutional, and the same shall not affect
the validity of the Comprehensive Zoning Ordinance as a whole.
SECTION 6 . That any person, firm or corporation violating an y of the
provisions or terms of this ordinance or of the Comprehensive Zoning Ordinance, as
amended hereby, shall be subject to the same penalt y as provided for in the
Comprehensive Zoning Ordinance of the City of University Park, Texas, as heretofore
amended, and upon conviction shall be punished by a fine not to exceed the sum of two
thousand dollars ($2,000,00) for each offense, and each and every day such a violation is
continued shall be deemed to constitute a separate offense.
SECTION 7. That this ordinance shall take effect immediately from and after its
passage and the publication of the caption, as the law and Charter in such cases provide.

The Planning and Zoning Commission of the City of University Park met on Tuesday. March 13,
201 2 at 5:00 pm in the City of University Park Council Chambers, located at 3800 University
Boulevard. University Park, Texas. The following are minutes of that meeting.

Mr. West opened the gubIic hearing at 5:00 PM. He intmduced everyone in attendance Mr. West then
read the case before the commission:
PZ 1 2-00 I : Prescott Realty Group, Inc, representing MC 6420 NCE LP, requesting approval of a
detailed site plan to amend Planned Development District PD-10, to develop the subject site for
rnulti family, restaurant. retail, office and personal services in a single building with a maximum
building height of 80 feet. The subject tract is zoned PD- I0 and Focatd on the southeast corner of
Fondren Drive and US Highway 75 and situated at 6400 North Central Expressway in the City of
University Park. Dallas County, Texas.
Mr, Persaud provided a Powerpoint presentation showing the site. He noted to the commission
that nine notices had been mailed out to properly owners with no responses. Mr. Persaud stated
that he had received a phone call from Windle Turley in regard to the proposed setback on
Fondren.
Mr. West asked the commission if they had any questions Tor staff. With none, Mr. West invited
the applicant to speak in favor of the request.
Mr. Taylor Stone, Prescott Realty Group approached the podium. He stated that the present site
consists of Cafe Brazil, Park Cities Motors and the Johnson Square Office Building. This site was
acquired by the group in 2006. He stated that their intent is to produce a building with features as
seen along the 75 corridor.
Mr. Biddle ask4 if there was a 14' side yard setback discussed for the 1 " floor along Fondren.
Mr. Stone responded, -'Yes sir". Mr. Aldredge asked Mr. Stone if any other discussions had
occurred with regard to the trash collection on the property and if they could foresee a problem

with it. Mr. Stone responded, "Yes, discussions have occurred and we foresee no problems" He
stated that the problems presented are the perpetual nature of a development and the group
supports any contingency plan for the future.
Mr. West asked about the changes in the event the City of DaIlas does away with any of the
DART alley. Mr. Aldredge also asked about the change and how it changed. Mr. Stone reiterated
that the changes would occur if the Right of Way area were lost along the DART rail line or the
South portion ofthe site. Mr. AIdredge asked what would happen if the developer sold the
building. Mr. Stone replied that the PD was part of zoning and the requirement goes with the
property. Mr. Diltard asked about 'option B'. Ms. Stone responded thnt he thought it had been
presented. Mr. Persaud responded that the drawing for the at ternate fire Fane would be explained
in the ordinance.
Ms. Farley asked for explanation of the trash collection along Fondrcn. Mr. Persaud explained
the different location for both residential trash and commercial trash. Mr. Stone explained about
the current roll out containers planned for the site. He added that everything was of course
subject to approval from the Public Works Director. Mr. Dillard asked if the statement for the
trash collection alternative would be on the site plan. Mr. Persaud stated that it would be included
on the site plan presented to the City Council.
Mr. West asked Mr. Stone again if the alternative trash location for commercial tmsh would 'be on
the north east comer of the building along Fondren, in case the DART alley Right of Wny was not
available. Mr. Stone replied, "Yes". Mr. Kohla asked, "'I assume you will know the
location
before the construction*?" And, "that the building will be constructed to accommodate alternative
features in the future if needed?" Mr. Stone replied, "'Yes".
Mr. Pmaud stated that the Public Works Department is currently looking at a possible trash
compactor service. He added:
1. The details for this service will be worked out later.
2. The tmsh and fire lane agreement had not been worked out until aRer the PIanning &
Zoning Commission packets were sent out.
Discussion ensued among the commission as to additional changes.
Mr. West asked if there were further questions.
Mr. Biddle motioned to approve the detailed site plan for the Planned Development District PD-
10, subject to changes in the proposed zoning changes:
1. 6. (63 (3) The side yard setback along Fandren shall be 14' instead of 10' on the ground
floor, but with a 10' side yard setback above the ground floor.
2. 6. (m) Except those located on the South property line.
Ms. Farley seconded the motion. With a 5-0 vote, the motion passed.
