Councilmembermayrespondwithastatementofspecificfactualinformationora
recitationofexistingpolicy.ItistheCouncil’spolicytorequestthatcitizensnotaddress
itemsthatarecurrentlyscheduledforafutureagendaorpublichearing.Instead,theCouncil
requeststhatcitizensattendthatspecificmeetingtoexpresstheiropinions,orcommentto
theCouncilbye-mailatCity-Council@uptexas.orgorletteraddressedtotheMayorand

alongthesouthsideofMcFarlin,westfromHighSc hooltoGolfandforthe
parkingspacessurroundingBurlesonPark.
BACKGROUND:
Perresidentrequests,staffhasdirectedtheCity Attorneytodevelopanordinanceenabling2-hour
parking,MondaythroughFriday;8a.m.to5p.m.;e xceptholidays,intwolocationsinthecity.
Thefirstlocationrequestedbyresidentsisalong thesouthsideofthe3500and3600blocksof
McFarlin,westfromHighSchooltoGolf.Afterrec eivingtheinitialrequest,staffsurveyed
neighborhoodresidents.Inresponsetothesurvey,eighty-four(84%)percentoftherespondentswere
infavoroftheparkinglimitdesignation.
Thesecondlocationinvolvescontinuingcomplaints fromresidentsregardingthelackofparking
availableatBurlesonPark.Virtuallyallofthes pacesareutilizedbySMUstudentsonadailybasis ,
andattimes,ParkDepartmentemployeesmustfindi nnovativewaystoaccesstheparkforroutine
maintenance.Studentsapparentlyusethespacesal ongtheperimeteroftheparkbecauseof
convenienceoron-campusparkingfees.Theresult islackofparkingfortheCity'sresidents.
Followingdiscussionofalternatives,staffrecom mendsdesignatingtheparkingspacessurrounding
BurlesonParktwo-hourparkingasfollows:thenor thsideofUniversityfromDublinwestto
Durham,theeastsideofDurham,fromUniversityno rthtoDaniel,thesouthsideofDaniel,from
DurhameasttoDublin,and,thewestsideofDublin fromDanielsouthtoUniversity.
Theincludedordinanceaddressesbothrequestsfor twohourparkingrestrictions.
RECOMMENDATION:
StaffrecommendsCityCouncilapprovaloftheordin anceestablishinga2-hourparkinglimitsas
detailedabove.

The City of University Park is in receipt of a request to designate “2-HOUR PARKING,
Monday – Friday / 8a.m. to 5 p.m.” along the south side of McFarlin Blvd, west from High
School to Golf. Procedurally, a clear majority of the residents must be in favor of the change.
To that end, please provide your opinion on the space provide below:

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That it shall be unlawful and an offense for any person to leave, stand or
park any motor vehicle on the South side of McFarlin between High School and Golf, on the South
side of Daniel between Dublin and Durham, on the East side of Durham between University and
Daniel, on the North side of University between Dublin and Durham, and on the West side of
Dublin between Daniel and University, in excess of two hours at any time from 8:00 a. m. to 5:00 p.
m., Monday through Friday, except holidays.
SECTION 2. That all ordinances of the City of University Park in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 3. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not
affect the validity of this ordinance as a whole, or any part or provision thereof, other than the part
decided to be invalid, illegal or unconstitutional.
SECTION 4. That any person violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of

University Park, Texas, shall be subject to a fine not to exceed the sum of two hundred dollars
($200.00) for each offense.
SECTION 7. That this ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide. The parking
restrictions set out herein shall not be effective until appropriate signs giving notice thereof shall
have been erected as provided by the Code of Ordinances.

Attached you will find a frnal invoice for engineering serviccs on this project. The following is
an explanation of fees included in this invoice.
As discussed. Nathan D. Maier Engineers. Inc. (NDM) provided engineering services beyond our
scope of services to investigate the NSF 61 ccrtiflcation process.'fhis was required due to claims
made by the Contractor that NSF 6l certification could not be obtained. NDM reviewed TCEQ
gr"ridelines fbr metalizing wire and contacted -fCEQ personnel directly to discuss the
ccrlification. NDM conf-rrmed the certification r.vas required. NDM contacted wire suppliers
around the country. NDM also contacted NSIr International and determined all the necessary
procedures and fees required to obtair-r the certification and transmitted that to the Contractor.
NDM's total investment for this work was $7.600.00.
Overtime inspection was required fbr hours beyond a normal working day and weekend work
over the duration of the construction project. NDM and our sub-consultant, Tank Industries
Consultants (TfC) invested additional man hours to provide and manage the overtime inspection.
NDM and TIC total investment for oveftime inspection was $ 15,257.27.
The Contractor did not complete the project within the contract time. I{e was 37 days over the
contract limit. NDM and TIC incurred costs to provide and manage inspection during that time.
The cost for that inspection was $28,447.00.
The total amount for work beyond the original contract scope of work as listed above is
$51,304.27.

City Manager Livingston summarized the consent agenda items for the audience.
He stated that any item may be removed for individual consideration if requested by any
Councilmember.
No items were requested to be considered separately and Mayor Davis asked for a motion.
Councilmember Clark made a motion to approve the Consent Agenda. Councilmember
Stewart seconded, and the motion carried unanimously.
City Manager Livingston asked Public Works Director Bud Smallwood to address the
Council with more details related to the sanitary sewer overflow into the residence
located at 2927 Lovers Lane on April 29, 2011.
Mr. Smallwood displayed a map which depicted the locations of the manholes and
cleanouts near the address in question. He said once the homeowner reported the
backup he sent a crew to the site to check the manhole and found it full of wastewater.
Mr. Smallwood said once the correct flow direction of the wastewater was determined,
the line was cleared using a high-pressure hose and appropriate flow was returned.
During the clearing of the line, naturally occurring waste debris along with a brick was
pulled from the sanitary sewer. Mr. Smallwood stated that the brick was the probable
cause of the blocked line.
Mr. Smallwood also stated that none of the manholes in that area are constructed with
brick. He also stated that the day after the line was cleared, staff televised the sewer line
and found it was in very good condition, with no cracks or misaligned joints. He said
the same line had been televised two years before during routine maintenance and it was
in the same condition at that time.
Mr. Smallwood said the following week, staff returned to the site to repair where the
cap had been removed on the east side of the manhole in question. At that time, he said
staff decided as long as excavation was going to be done, a new line could be laid from
the manhole west of the home in question through the alley to the sewer line in
Dublin, connecting that portion of sanitary sewer to a more direct route. Mr.
Smallwood stated the existing line was then cut and plugged between the two homes.
He said that line now acts only as a service line to the adjacent property.
Councilmember Begert asked Mr. Smallwood about the gravel that the homeowner said
was found in the sewer line. Mr. Smallwood said that when the crew initially went to

unblock the line, they went to the closest cleanout, thinking that was the direction of
flow, but they then determined that it was not. He said the crew had attempted to run
the cleanout in a direction that there was no line and that was where the gravel came
from. He said it was not connected to the line that caused the backup.
Mayor Davis asked the homeowner to address the Council. Mrs. Higley, 2927
Lovers Lane, addressed the Council. She requested the Council authorize
reimbursement of $3,952.21 for expenses she incurred cleaning up the sewage backup
into her home. She said her insurance will not cover the event and she said that there
was negligence involved causing the backup.
Councilmember Clark asked about the debris that was removed from the homeowner’s
sewer line. Mr. Smallwood said the debris that was found did not come from anything
staff had done and was expected wastewater debris, with the exception of the brick. He
said both manholes are pre-cast manholes and no bricks are used in their construction.
Mr. Smallwood stated that all Infrastructure Maintenance staff have access to the sewer
cleanouts, but the cleanouts are also vulnerable to vandalism.
Councilmember Begert asked if that had been other instances of overflow damage to
homes in the City. Mr. Smallwood said there had been several sewer backups over the
years, but no waiver of immunity had ever been granted. Risk Manager Luanne
Hanford agreed.
Mayor Davis asked if there were any more questions from the Council. There were
none, and Mayor Davis asked for a motion.
Councilmember Begert made a motion to deny the request for reimbursement. Mayor
Pro Tem Grable seconded, and the motion carried unanimously.
Public Works Director Bud Smallwood addressed the Council. He said the owners of
6517 Hillcrest and its adjacent parking lot requested the City abandon the Haynie/Daniel
alley running parallel to Hillcrest which bisects the two properties. Mr. Smallwood
said the alley right-of-way was valued by an outside appraiser at $125 per square foot.
Mayor Davis asked if there was any discussion from the Council on this request.
Councilmember Stewart said he didn’t see any need for the City to abandon this right-
of-way as there were no development plans underway. He said he would make a
motion.
Councilmember Stewart made a motion to not enter into discussions related to selling
the alley right-of-way until such time that there is a City-approved development plan for
properties located to the east and/or west of the alley that incorporates use of the alley.
Mayor Pro Tem Grable seconded, and the motion carried unanimously.
Finance Director Kent Austin addressed the Council regarding Senate Bill 1 (SB1),
recently passed by the state legislature. He said this bill includes an exemption for
property taxes on business personal property, such as inventory, temporarily stored in

public warehouses, also known as goods-in-transit. Mr. Austin said although there are
no public warehouses in the City at this time, there may be some in the future. He said
unless the taxing entity (City) chooses to opt out, this exemption will take effect at the
end of the year.
Mr. Austin said staff and the Finance Advisory Committee recommend opting out of
this exemption. He said this law has little or no current impact on the City’s tax
revenue, but there could be a future development that would make it applicable.
Mayor Davis asked if there were any questions related to this item. There were none,
and Mayor Davis asked for a motion.
Councilmember Clark made a motion to approve the ordinance opting out of the goods-
in-transit exemption. Councilmember Begert seconded, and the motion carried
unanimously.
City Manager Livingston addressed the Council regarding the Council's vote for the
fourth member of the Dallas Central Appraisal District Board of Directors. He said this
member would represent the suburban cities on the Board. He said the Council should
vote for either Michael Hurtt, the current representative nominated by the cities of
DeSoto, Sachse, Seagoville, Farmers Branch and Richardson, or Paul Norman,
nominated by the City of Combine.
Councilmember Begert made a motion to approve a resolution casting the
Council’s vote for the fourth member of the Board of Directors of the Dallas Central
Appraisal District (DCAD) for Mr. Michael Hurtt. Mayor Pro Tem Grable seconded,
and the motion carried unanimously.
City Manager Livingston addressed the audience regarding addressing the Council during
open session. He also mentioned that he received a request from the Dallas Metropolitan
Ballet to address the Council, but that their representative did not attend the meeting.
As there were no requests to address the Council, Mayor Davis adjourned the meeting.

UNIVERSITY PARK, AS HERETOFORE AMENDED, SO AS TO GRANT PLANNED
DEVELOPMENT DISTRICT NO. 37 FOR THE PROPERTY DESCRIBED AS ALL OF
LOTS 14 AND 15, BLOCK 2, UNIVERSITY COURT ADDITION, IN THE CITY OF
UNIVERSITY PARK, DALLAS COUNTY, TEXAS; APPROVING A DETAILED SITE
PLAN ATTACHED AS EXHIBIT “A”; PROVIDING SPECIAL CONDITIONS AND
DEVELOPMENT STANDARDS; PROVIDING FOR THE REPEAL OF ALL
ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING

WHEREAS, the Planning and Zoning Commission of the City of University Park and the
City Council of the City of University Park, in compliance with the laws of the State of Texas with
reference to the granting of zoning classifications and changes, have given the requisite notices by
publication and otherwise, and have held due hearings and afforded a full and fair hearing to all
property owners generally and to all persons interested and situated in the affected area and in the
vicinity thereof, and the City Council of the City of University Park is of the opinion and finds that
said zoning change should be granted and that the Comprehensive Zoning Ordinance and Map
should be amended; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of
University Park, Texas, are hereby amended to grant Planned Development District No. 37 (“PD-
37”) for the property described as Lots 14 and 15, Block 2, University Court Addition, an Addition
to the City of University Park, Dallas County, Texas, and located on the south west corner of Dublin
Street and University Boulevard (the “Property”).
SECTION 2. The Detailed Site Plan for PD-37 (“Site Plan”), attached hereto as Exhibit
“A” and made a part hereof for all purposes, the same as if fully copied herein, is approved as the
Detailed Site Plan for said Planned Development District as required by Section 17-101 (2) of the

Comprehensive Zoning Ordinance of the City of University Park, Texas. Approval of the Site Plan
is subject to the following special conditions:
A. The property shall be developed only in conformance with the requirements of this Planned
Development District 37 and the approved Site Plan;
B. The Property may be used for a surface parking lot only, containing 27 parking spaces and
drives as shown on the Site Plan;
C. Additional Conditions:
1. The detailed landscape plan included in the Detailed Site Plan shall provide the species,
caliper, specific location and height of trees to be retained or installed on the site,
including three (3) 4” caliper oak, 16’ in height at the time of installation, to be added
on the east side of the Property as shown on the Site Plan. The three (3) existing oak
trees, two 30” and one 32” caliper on the north side and one (1) 20” caliper Pecan tree
on the southeast corner of the Property, shall be retained. Landscaping around the
monument sign shall include 4 East Palatka Holly trees, a minimum 8 feet in height
with a minimum canopy of 4 feet at the time of installation, a hedge of Indian
Hawthorne, and a planting bed as shown on the approved landscape plan. The tree
preservation and removal plan is approved and attached hereto as an exhibit and
incorporated into the Site Plan. All plant material must be irrigated and maintained in a
healthy condition at all times;
2. A 30 to 32” high earthen berm, 13 ‘ 10” in width, with landscaping as shown by the
Site Plan, will be added along the street frontage on Dublin Street;
3. An externally lighted campus identity monument sign, 16 feet long and 5’ 4” in height,
of masonry construction, with landscaping at the base as shown on the Site Plan, will be
added to the north east corner of the Property;
4. The wood screening fence along the alley west of the Property will be extended from its
present terminus east to the front of the last parking space on the south east corner of
the Property;
5. Lighting will be added to the Property in accordance with the Site Plan and shall
comply with the photometric layout attached to the Site Plan;
6. No construction vehicles or SMU-owned service vehicles may be parked within the
Property.
SECTION 3. All ordinances of the City of University Park in conflict with the provisions
of this ordinance are hereby repealed.

SECTION 4. Should any sentence, paragraph, subdivision, clause, phrase or section of this
ordinance or the Comprehensive Zoning Ordinance and Map, as amended hereby, be adjudged or
held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance
as a whole or any part or provision thereof, other than the part so declared to be invalid, illegal or
unconstitutional, and shall not affect the validity of the Comprehensive Zoning Ordinance as a
whole.
SECTION 5. Any person, firm or corporation violating any of the provisions of this
ordinance or the Comprehensive Zoning Ordinance and Map, as amended hereby, shall be deemed
guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park,
Texas, shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for
each offense, and each and every day any such violation shall continue shall be deemed to constitute
a separate offense.
SECTION 6. This ordinance shall take effect immediately from and after its passage and
the publication of the caption, as the law and Charter in such cases provide.

The Planning and Zoning Commission of the City of University Park met on Tuesday, August 9,
2011 at 5:00 pm in the City of University Park Council Chambers, located at 3800 University
Boulevard, University Park, Texas. The following are minutes of that meeting.

Mr. Biddle opened the public hearing at 5:00 PM. Mr. Biddle then read the first case before the
commission:
PZ 11-006: Hold a public hearing and consider a request by SMU to change the zoning from
Single Family “SF-4” to University Campus, UC-2 zoning district classification in accordance
with the comprehensive zoning ordinance. The subject tract is approx. 0.3074 acre more or less
and described as Lots 14 and 15, Block 2, University Court Addition and located on the south
west corner of University Boulevard and Dublin Street, City of University Park, Dallas County,
Texas.
Mr. Persaud provided a PowerPoint presentation showing the site with certain uses permitted by
right including a parking structure. He outlined the use table located in the zoning ordinance
provided with information in the Planning & Zoning Commission packet.
Mr. Biddle asked if anyone wished to speak in favor. Mr. Paul Ward, General Counsel for
Southern Methodist University came forward and introduced other staff present in the room. He
stated that SMU looked at the parking capacity for the university and outlined a history of their
existing parking. Mr. Ward stated that there would be additional 60-66 spaces provided in the
new lot. Mr. Ward stated that SMU understood the opposition for the proposed lot and happily
welcomed any questions.
Ms. Moore asked about the usage of the lot because it never seems full. She added that it must
be commuting, not sorority students parking in it. She asked Mr. Ward to explain. He stated that
it was fully used during certain times of the day and they felt that 60 more spaces would alleviate
some of that demand. He added that it would be available for all students of SMU.

Ms. Farley asked Mr. Ward if any study had been done to change the zoning. Mr. Ward
responded, “No, there has been enough parking at the right time and in the right location. The
lot has been actively used during the school year.”
Mr. Kohler asked if the lot had been considered for any other type of parking. Perhaps the
building of a parking garage? Mr. Ward responded that a parking lot would provide the most
optimal use for the foreseeable future. Mr. Kohler asked again, “No other?” Mr. Ward
responded, “Correct”.
Ms. Farley asked Mr. Ward if they could leave the area as a buffer and build a parking garage on
the existing parking lot. Mr. Ward responded that they try to provide good will to that part of the
campus. He added that using this particular lot should be seen as an increase to alleviate strain
on that part of the campus. Ms. Moore asked Mr. Ward if non-approval of the parking lot would
result in a parking structure. Mr. Ward responded that a parking structure is very expensive to
build and that it was not safe to say if a fair trade.
Mr. Kohler felt that it might be a reasonable trade 6 months down the road though, with more
additional heavy construction already projected for the campus. Mr. Ward responded, “Yes”.
Mr. Kohler asked again for the applicant to demonstrate the need. Ms. Farley reiterated that she
had never seen the lot full. Although not there all the time, she asked about the last 5-10 years
and if there had been an increase in the percent of commuter students. Mr. Ward stated that the
target freshman class continues to be 1400 students and 1200-1300 transfer students. He added
that there is no way to predict the percentage of new commuters and that SMU had no intension
to increase their student population.
Mr. Biddle asked Mr. Ward about the buffer with the neighborhood and if a Planned
Development would be a possibility for the University. Mr. Ward replied “No” but that a lot of
attention had been given to the Residential Commons project. He also stated that many SMU
offices had been relocated to the expressway tower in order to alleviate problems with growth
and parking problems primarily on the East side of the campus.
Mr. Ward then explained the various sites on the campus in relation to planning and parking
needs on campus. Mr. Aldredge asked Mr. Ward about the screening onsite. Mr. Ward
explained that there would be a significant amount of trees remaining with additional trees
planted along Dublin, as well as an installation of a monument sign. Mr. Aldredge asked if there
would be a wall. Mr. Ward responded, “No” and that his understanding was that there would be
considerable landscaping. Ms. Farley asked about landscaping on the north side of the site and
there was further discussion amongst the commission.
Mr. Biddle then asked if anyone else wished to speak in favor of the request. There was none.
He asked if anyone wished to speak in opposition.
Ms. Jennifer Calhoun who resides at 2936 University approached the podium. Ms Calhoun
expressed a concern with Mr. Ward’s presentation. She stated that the neighbors will never
agree to a UC-2 zoning change and that the City Council meeting to discuss this item should be
changed from the 9/6/11 agenda. Ms. Calhoun also expressed a concern for the number of
notices mailed by the City of University Park to property owners located within 200’. She stated
that due to the recent economy, home valuations have reduced with less tax dollars going to the

city and the local school district. She spoke about the area traffic and street construction. Ms.
Calhoun agreed with Ms. Farley with her experiences of driving by the site being similar. She
expressed concern that there would be a reduced aesthetic look with SMU bulldozing trees and
landscaping. Also, there would be more traffic where children live and are always present. Ms.
Calhoun felt that the approval of SMU’s request would affect the quality of life and provide
more traffic to the area where children are present daily. She also noted that the approval would
not stop an eventual parking garage from being built and felt there was no reason to approve the
request. She added that there are large amounts of trash on site during football weekends and
that all 16 responses in favor are from SMU.
Mr. Biddle asked if anyone else wished to speak in opposition.
Mr. Mike Joy who resides at 2924 University Blvd approached the podium. He stated that
University Park had changed a lot since 1989. He added that the traffic counts had degraded the
quality of life in the city. Currently, he felt that the lot is an eyesore and should be brought back
to residential use. He asked that the commission not give SMU the keys to proceed.
Mr. Lyle Walker who resides at 2945 Fondren since 1982 approached the podium. He stated that
while there are beautiful trees with lots of children, an increase in traffic has created a huge
amount of concern for the neighborhood. He claimed that SMU knew the residential homes
existed there when they bought the property, so the corner of Dublin and University should
remain residential. Mr. Walker added that he respect SMU, but this zoning change is not
necessary and there is no need to extend the parking lot all the way to Dublin.
Ms. Mary Lacey who resides at 2945 University approached the podium. She explained the
history of her neighbors’ home and asked about the address of 3009 University. Mr. Persaud
explained the city’s mailing list and the tracts of land. He also explained the process of the open
records act.
Mr. Dillard stated that all property owners within 200’ receive a public meeting notice, including
SMU. If 20% or more oppose, there is 4/5 City Council vote required.
Mr. Jeffrey Smith who resides at 2925 University approached the podium and asked a question
about the 200’ notification requirement.
Ms. Charlotte Hayden who resides at 3000 Fondren approached the podium and asked about the
reasoning for their request.
Mr Steve Metzger who resides at 2941 Daniel approached the podium and confirmed the
neighbors concern with respect to 3001 University and its unknown affects. Mr. Metzger felt too
that the current parking lot is rarely full. He suggested that the city look at the Planned
Development and if its appropriate to do a study concerning what might be necessary. Mr.
Metzger felt that even if the lot was opened up for parking, that won’t make the students park
there. He indicated that it is a good idea but not sure if it would be used for what its intended.
Mr. Biddle closed the public hearing and asked for comments from the commission members.

Ms. Moore asked Mr. Persaud if the city has control over the uses of the property. Mr. Persaud
advised Ms. Moore that they do for obvious traffic reasons and that the city could look at issues
related to curb cuts, etc. Mr. Persaud added that the need is not a determinant factor in land use.
He advised the Planning & Zoning commission that they should focus on land use impacts and
the mitigation of those impacts on the neighborhoods quality of life.
Ms. Moore asked if it’s possible to control the use with a Planned Development. Mr. Persaud
advised Ms. Moore that if the city thinks a parking garage is going to be placed on the site, the
ultimate decision will rest with the City Council.
Mr. Ward introduced Mr. Phillip Jabor with SMU. He cleared an issue stating that there are
some maintenance vehicles on the site which the university is working to dispose of for auction,
but that it is only temporary. He added that there would be no new curb cuts on Dublin and they
would maintain the current curb cuts along University.
Mr. Biddle asked for further discussion.
Mr. Aldredge mentioned that he had trouble with changing the zoning to UC-2 and the
possibility of a parking garage on that street. Mr. Aldredge then made a motion to deny the
request without prejudice. Ms. Farley seconded the motion. With a vote of 5-0, the request for
rezoning was denied.

comprehensive zoning ordinance to provide regulations relating to the height of a fence and
retaining wall located in the rear yard in the Single Family, Single Family Attached, Duplex and
Multi Family zoning districts.
Mr. Persaud reviewed the case with a PowerPoint presentation explaining the requirements of the
existing ordinance. He stated that staff had received a request for direction from the City
Council. With the assistance of staff, the issue was reviewed by the Zoning Ordinance Advisory
Committee with a recommendation made to the Planning & Zoning Commission. With no
questions and no opposition, the public hearing was closed.
Mr. Kohler motioned to recommend approval of the proposed amendment to Section 28-105 of
the comprehensive zoning ordinance. Ms. Moore seconded the motion. With a 5-0 vote, the
motion was approved unanimously.
Minutes of the June 14, 2011 Planning & Zoning Commission meeting were reviewed. Ms.
Farley made a motion to approve the minutes, and Mr. Kohler seconded the motion. With a vote
of 5-0, the minutes were approved. With there being no further business before the board, Mr.
West adjourned the meeting at 5:57 PM.

The Planning and Zoning Commission of the City of University Park met on Tuesday, October
11, 2011 at 5:00 pm in the City of University Park Council Chambers, located at 3800 University
Boulevard, University Park, Texas. The following are minutes of that meeting.

Mr. West opened the public hearing at 5:00 PM. Mr. West then read the case before the commission:
PZ 11-008: Hold a public hearing and consider a request by SMU to change the zoning from
Single Family “SF-4” to Planned Development District, “PD-37” and consideration of a
detailed site plan for the expansion of an existing surface parking lot, in accordance with the
comprehensive zoning ordinance. The subject tract is approx. 0.3074 acre more or less and
described as Lots 14 and 15, Block 2, University Court Addition and located on the south west
corner of University Boulevard and Dublin Street, City of University Park, Dallas County,
Texas.
Mr. Persaud provided a PowerPoint presentation showing the site and advised the commission
that the case had been heard previously on 8/9/11. Since then, the city had been working with
SMU for a new proposal of a Planned Development District. He reviewed the size of the
property and its proximity to other zoning districts. Mr. Persaud provided pictures of some of
the surrounding properties and their relation to the subject site.
He then introduced the SMU group present who would be presenting the case and answering any
questions for the commission. The group consisted of: Paul Ward-V.P. of Legal Affairs, Phillip
Jabour, Associate V.P. of Planning & Construction, Trisha Mehis, Senior Project Manager,
Christopher Miller, Landscape Architect and Stuart Markeson, SMU Construction Manager.
Mr. Ward reviewed the property site again with the commission, advised the commission of what
was stated by opposition at the last meeting of allowing a “structure”. He reviewed the parking
spaces of:
221 current existing spaces
275 total with future spaces (54 additional)

27 spaces within the proposed planned development district
Mr. Ward stated that there would be no access into the parking lot from Dublin St. and no
additional access points from University Blvd. He addressed the previous meetings comment
that the lots are currently underutilized. Mr. Ward advised the commission that the lots are
frequently fully occupied.
Mr. Jabour approached the podium and addressed the landscape berm. He stated that it would be
maintained with ornamental grass in order to screen the parking lot while still maintaining
visibility for safety. He reviewed the street lighting along Dublin with the photometric plan and
advised the commission of the traditional monument sign proposed for the campus, designed
around the Georgian architectural style.
Mr. Aldredge asked Mr. Jabour if there would be a fence along the edge of the berm. Mr. Jabour
stated, “Yes”. Mr. Roach asked how long the property had been vacant. Mr. Jabour responded
that he didn’t recall but about 4 years, but that the home had been removed this past summer.
Mr. West asked if anyone else wished to speak in favor. With none he asked if anyone wished to
speak in opposition.
Ms. Jennifer Calhoun, resident at 2936 University approached the podium and stated she had
been advised not to construct a circular drive due to permeability issued. She stated that they put
in a drive of $17,000 brick pavers instead. Ms. Calhoun added that the parking lots are full
Tuesday and Thursday only.
Ms. Calhoun stated that the resident complaint is about the quality of life and the increase in
traffic that a larger parking lot will generate. She asked for the commission to not make a
decision on this date due to:
1. There is no compelling reason for needing spaces.
2. The university has recently dug up cement for a fountain and increased landscaping.
She stated that the residents are very unhappy with the traffic from the GWBPC construction
site. She added that they say “No” to “only 27 spaces”. In addition she asked that the cit y let the
students park on the street.
Ms. Charlotte Hayden, resident at 3000 Fondren approached the podium and stated that she had
lived in University Park for over 25 years. She voiced her concerns over potential traffic and
how it would change the area to non residential status. She presented a petition of 60 neighbors
not wanting a change from residential.
Ms. Mary Lacy, resident at 2945 University approached the podium and discussed a professor
who had left SMU and left property to SMU and provided pictures of the site. She stated that it
was a stark contrast to the beauty of the City Park across the street from the site and that it was
not what one would expect to see in University Park. Ms. Lacy felt that the parking lot would de-
value the property and their neighborhood.
Mr. Mike Joy, resident at 2924 University Blvd approached the podium and spoke about how
many regard a parking lot as temporary but that it is really permanent. He stated that the existing

parking lot is currently underutilized. While the university claims that it won’t increase
enrollment, Mr Joy asked why there was a request for more spaces and why the university is not
expanding their spaces east when all of their development is to the east.
Mr. Joel Hyden, resident at 3000 Fondren approached the podium. He stated that SMU uses an
institutional approach in their petition. Mr. Hyden stated that there have been disagreements
between residents and SMU for 20-25 years, that it was always a give and take situation, but that
60 neighborhood residents had signed a petition. He disagrees with one of the speakers that the
parking lot is frequently full. He stated that he has never seen it full. Mr. Hyden felt that the
number of unhappy residents could fill the city council chambers. He stated to the Planning &
Zoning Commissioners that “people who make promises are honorable, but can we rely on
them?” Mr. Hyden asked that residents have the opportunity to see the plans because the amount
of traffic was a huge concern. He added that the parking lot is usually a “staging area” for SMU
events such as football games.
Ms. Teresa Snider, resident at 2944 University approached the podium and stated that she had
lived in University Park for 15 years and has had a daughters car dented and a dog killed when
hit by a car. She then added that she would not have bought the home had she known what it
would be ultimately used for.
Mr. Roach motioned to table the item until the next Planning & Zoning Commission meeting.
Mr. Aldredge interjected that he had a question in reference to the signage. He asked the SMU
representatives if they were receptive to re-designing the proposed monument sign on the site.
Ms. Moore quickly asked if they needed signage at all. Mr. Jabour responded that they could
look at the re-design, but that the monument sign would be a marker for the campus. Otherwise
it looks just like a standard parking lot.
Ms. Moore stated that the sign doesn’t bother her and that the city park and SMU signs help to
enhance the city. She then asked Mr. Persaud what else could be done to enhance the sign,
specifically with the zoning of the 2 lots.
Mr. Persaud responded in regard to zoning allowance in the UC-2 district. Ms. Moore asked if
the increased traffic potential is still there. Mr. Persaud responded that the traffic is a
accumulative issue. He stated that he had reviewed the traffic study of the George W. Bush
Presidential Center. He added that there are issues to be realized in the future and that the
neighborhood is frustrated with the accumulative impact overtime. Mr. Persaud stated that if
traffic problems develop within 18 months of the issue of a CO, GWBPC will need to mitigate
for those problems.
Ms. Moore stated that the university has the option to leave the lots and do nothing. Mr. Persaud
stated that he didn’t think that it was appropriate to ask SMU for a traffic study for 27 additional
spaces.
Mr. West addressed all in attendance in regard to the options of what can or cannot be done. Mr.
Persaud answered some questions in regard to GWBPC and Mr. West provided his personal
opinion.

Ms. Moore stated that it might be acceptable with the landscaping and berm. She added that she
likes the atmosphere and design of what SMU is trying to accomplish. Although safety is an
issue, she stated that SMU must make sure that everybody is safe in the area, not just SMU
students.
Mr. Persaud stated that it is important for some screening of the site but not complete screening
and that it is not the SMU culture for complete screening.
Mr. Biddle stated that he had a huge concern for the parking structure reviewed in the last
Planning & Zoning meeting and that valid opposing points had been brought up by the
surrounding neighbors. He added though that a PD would allow for better control over the site.
Mr. West asked for a motion. Ms. Moore stated that she was in favor of the Planned
Development. Mr. Biddle seconded the motion. Mr. West reviewed the motion but Mr. Biddle
asked how the signage could be amended for SMU to decrease the size of the sign. Mr. West
suggested that they match it with the Burleson Park sign. Mr. Jabour felt that the two signs were
similar. Mr. West asked Mr. Jabour if SMU would be willing to match the signs and still give
identity to SMU. There was discussion amongst SMU representatives and the Planning &
Zoning Commission members.
Ms. Moore asked that it be scalable with the berm and the character of the area. She asked SMU
representatives about trying to keep similar with other SMU signs. Representatives for SMU
addressed the placement of the sign in the berm and then advised the Commission that it
wouldn’t work. Mr. Ward stated that the structure would be higher with planting below the
lettering. He added that the sign might not look symmetric, but that it was alright to make it
scalable.
Mr. West stressed that it must remain scalable. He added that he felt that the sign was too large
for a corner property. Mr. Biddle amended the motion for the signage on the southwest corner to
be comparable for height, same as or similar to the sign across the street at Burleson Park.
Ms. Moore accepted Mr. Biddle’s motion to move forward. With a vote of 4-1, the request for a
recommendation of a Planned Development (PD-37) was approved. Mr. Doug Roach opposed.
Minutes of the August 9, 2011 Planning & Zoning Commission meeting were reviewed. Mr.
Aldredge made a motion to approve the minutes, and Mr. Biddle seconded the motion. With a
vote of 5-0, the minutes were approved. With there being no further business before the board,
Mr. West adjourned the meeting at 6:15 PM.

ARTICLE 6.03 OF THE CODE OF ORDINANCES TO CHANGE THE NAME
NEIGHBORHOOD INTEGRITY OFFICER TO CODE COMPLIANCE OFFICER;
PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City employees who currently inspect and enforce City codes and
ordinances are referred to as Neighborhood Integrity Officers; and,
WHEREAS, such employees’ actual duties entail an effort to gain compliance with city
codes and ordinances; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. The Code of Ordinances, City of University Park, Texas, is hereby
amended by amending Article 6.03 in part as follows:
“ARTICLE 6.03 CODE COMPLIANCE OFFICERS
Sec. 6.03.001 Office created
There is hereby created the office of code compliance officer for the city. The code compliance
officer shall be employed by and under the direction and control of the Director of Community
Development, and shall have the duties and responsibilities as provided herein.
Sec. 6.03.002 Duties
The code compliance officer shall have the responsibility…
(4) Enforcement of other city ordinances as required by the Director of Community
Development.

SECTION 2. That should any sentence, paragraph, subdivision, clause, phrase or
section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same
shall not affect the validity of this ordinance as a whole, or any part or provision thereof other
than the part so decided to be invalid, illegal or unconstitutional.
SECTION 3. An offense committed before the effective date of this ordinance is governed
by prior law and the provisions of the ordinance in effect when the offense was committed and the
former law is continued in effect for this purpose.

AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS,
AMENDING THE 2011-2012 FISCAL YEAR BUDGET, ORDINANCE NO. 11/20, TO
CARRY FORWARD ENCUMBRANCES FROM THE 2010-2011 FISCAL YEAR
BUDGET, INCLUDING TOTAL GENERAL FUND ENCUMBRANCES OF $711,398,
UTILITY FUND ENCUMBRANCES OF $254,397, AND SANITATION FUND
ENCUMBRANCES OF $18,131; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of University Park has determined that it is in
the public interest to amend Ordinance No. 11/20 to carry forward encumbrances of funds from
the 2010-2011 fiscal year budget and transfer funds from fund balances of the General Fund,
Utility Fund, and Sanitation Fund into specific accounts;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF UNIVERSITY PARK, TEXAS:
SECTION 1. That Ordinance No. 11/20, the 2011-2012 fiscal year budget ordinance of
the City of University Park, Texas, be, and the same is hereby, amended to carry forward to the
2011-2012 fiscal year encumbrances authorized in the 2010-2011 budget, but not expended
during such fiscal year. That a complete listing of such encumbrances, as they existed as of the
beginning of the current fiscal year, is attached hereto as Exhibit “A” and made a part hereof for
all purposes. That all of such encumbrances, totaling $712,398.00 of general fund
encumbrances, $254,397.00 of utility fund encumbrances, and $18,131.00 of sanitation fund
encumbrances, be, and the same are hereby, approved and carried forward into and made a part
of the 2011-2012 fiscal year budget of the City.
SECTION 2. This ordinance shall take effect immediately from and after its passage,
as the law and Charter in such cases provide.

BACKGROUND:
Overthepastseveralmonths,aLibraryGovernance Committeehasmettodetermineanoperational
structurefortheUniversityParkPublicLibrary.I nearly2013theLibrarywillmovetoafloorinan
officebuildingcurrentlyunderconstructioninthe PrestonCenterPlazaShoppingCenter.Onefloor
ofthefive-storybuildingwillbeownedbytheCit yofUniversityParkandwasacquiredwiththe
intentofprovidingapermanentlocationfortheLi brary.TheGovernanceCommitteeconsistedoffive
individuals:
KentAustinandBobLivingstonprovidedstaffsuppo rtfortheCommittee'swork.TheCommittee's
goalwastodevelopanoperationalplanfortheLib raryonceitmovestothenewCity-owned
location.TheresultistheattachedAgreement.
TheessenceoftheAgreementisthattheCitywill assumeoperationoftheLibraryoncetherelocation
iscompleted.TheFOLwillcommittobeingthefun draisingarmoftheoperationandhascommitted
tousingitsbesteffortstoraise$500,000ayear topayaportionoftheoperatingcostsoftheLibr ary.
TheCitycurrentlycontributes$196,000fromthean nualbudgettothecurrentUPlibrary;ongoing
supportfromtheFOLwillallowtheCitytoprovide animprovedlibrarywithoutincreasingthe
burdentotaxpayers.
TheAgreementandoperationalplanappeartobeuni queamongpubliclibraryoperations.Libraries
aretraditionallyacityfunction,usuallyinfree-standingfacilities,withtaxdollarsmakingupthe bulk
oftheoperatingbudget.Asaresult,duringecono micdownturns,publiclibrarieshavebeenthetarge t
ofmanybudgetcuts.
IftheFriendsareabletoraisesufficientfundst osupportthecommitmentasoutlinedinthe
Agreement,itwillhelpinsulatetheUPLibraryfro mthereductionsmanyotherlibrarieshavehadto
endure.
