HomeMy WebLinkAbout2008.04.23 PZ MnPLANNING AND ZONING COMMISSION UNIVERSITY PARK,1'EXAS MINUTES Apri123, 2008 The Planning and Zoning Commission of the City of University Park met on Wednesday, April 23, 2008 at 5:00 P.M. in the City Hall Fire Department Training Room, 3800 University Blvd., University Park, Texas. The following are minutes of that meeting. Commission Members Attending Robert H. Lorna Balser - Planning Assistant Rob I)illard -- City Attorney Mike Brackin - Code Enforcement Officer Mr. West opened the meeting, welcomed everyone in attendance and then read the specif~ics of the first case. PZ 08-003: Hold a public hearing and consider making a recommendation to the City Council to amend Section 22-101 of the Comprehensive Zoning Ordinance to regulate garage doors facing a side street in the Multi Family MF-1, MF-2 and MF-3 zoning districts. Harry Persaud introduced the item with a PowerPoint presentation explaining pictures of various buildings which establishes the need for such ordinance. He explained that the Development Standards Committee and the Zoning Ordinance Advisory Committee had reviewed the proposed amendment and forwarded recommendations to proceed. Mr. West opened the public hearing and asked if anyone wished to speak in approval or opposition of the proposed amendment. Mr. Frank Mclntyre, a resident who lives at 3439 Westminster recommended the proposed ordinance with an exception allowed in the side yard for garage doors in 1 and 2 family dwellings. After Frank Mclntyre illustrated with paper, Harry Persaud explained Mr. McIntyre's architectural standard recommendations to the board. Mr. Persaud further explained that he had taken the exact suggestion to the city council on February 12, 2008. He reported that City Council provided direction to staff that all garage doors facing a side street in the MF districts are to be prohibited. Mr. Persaud advised Mr. McIntyre to discuss his proposal at the public hearing on May 6r" before the City Council. Mr. West asked if anyone else wished to speak. With no one else wishing to speak further, Mr. Wesi closed the public hearing. Jerry Jordan asked Rob Dillard about section 25-105 of the comprehensive zoning ordinance and the exact definition of a side building line. There was discussion among the members concerning the definition of a side building line. Mr. Jordan felt that the section might be inconsistent with the definition. Mr. Dillard stated that he did not feel that it was inconsistent. Mr. West asked if there were any other questions for I~Iarry Persaud or Rob Dillard. Bill Foose asked if there was a definition for a storage structure according to section 25-105. Z~here was discussion among the members concerning this. Doug Roach made a motion to approve the zoning ordinance amendment as proposed and forward it to the City Council. Reed Shawver seconded the motion. With a vote of 5-0, the motion was approved. Mr. West read the specifics of the next case. PL 08-004: Hold a public hearing and consider making a recommendation to the City Council to amend the Comprehensive Loning Ordinance to provide development standards for the construction of Single Family Attached (SF-A) dwelling units in the Multi Family MF-1, MF-2 and MF-3 zoning districts. Harry Persaud introduced the item with a PowerPoint presentation outlining what advantages the changes would provide for the Multi-Family builders in the city in enabling them the ability to build less density and better quality products. Bob West asked if anyone wished to speak in opposition. Frank Mclntyre expressed concerns far density levels and members advised him of the regulations set forth in the zoning ordinance for development standards in a SF-A district which is what would apply with the proposed ordinance change in the MF districts. Bob West advised Frank McIntyre that there is no way ro put more than 2 SF-A units on the present lots. Reed Shawver asked Rob Dillard if the SF-A development standards specifically says that a lot must be 25' x 120'. Rob Dillard answered "yes". There was discussion among the members concerning SF-A development standards, the lots which exist under the required size. Bob West closed the public hearing and asked for a motion. Doug Roach made a motion to approve the recommendation to City Council for the ordinance amendment. Bill Foose seconded, and the motion was passed with a 5-0 vote. Mr. West read the specifics of the next case. PI 08-005: Hold a public hearing and consider making a recommendation to the City Council to amend Section 28-111 (5) of the Comprehensive Zoning Ordinance to regulate gates for swimming pool enclosures. Harry Persaud gave a PowerPoint presentation outlining the current section of the zoning ordinance which pertains to swimming pool enclosure locks and the proposed ordinance. This item had previously gone before the ZOAC committee and had been recommended to Planning and loning with the added required self latching height of 54". Mr. West opened the meeting to discussion and asked for anyone wishing to speak in favor or opposition. Three fence contractors along with Mike Brackin, City Code Enforcement Officer explained and showed t~he board members a self latching lock. Jerry Jordan stated that he personally has a locking devise used by residents now and that it currently works well for him although he does have to have it adjusted each year so that it continues to latch and lock correctly. He also stated that he feels that the proposed ordinance is "overkill". Reed Shawver stated that the current required ]ock works great on steel gates but not very good on wooden gates. He said that it doesn't need very much dryness before it doesn't loek any longer. He asked Harry Persaud and Rob Dillard if they could choose either "locking" or "latching" at the 54". There was discussion concerning the possibility. Charlie Pollard, fence builder in University Park stated that he feels that it is a mistake to put a lock on the fence. He said that every city in the metroplex area uses a"latch" system. The members felt that further research into the International Residential Code requirements for the height of the latch was needed in addition to looking further at Section 25-102 (3) of the comprehensive zoning ordinance. It was felt that Section 25-102 (3) provides a contradiction to Section 28-111 (5). Jerry Jordan motioned to table the item for discussion to continue at the next scheduled Planning & Zoning meeting scheduled for May 13, 2008. Bill Foose seconded the motion and the item was tabled with a vote of 5-0 to be scheduled for the next meeting. Mr. West then asked for approval of the minutes from the January 15, 2008 meeting without any changes. With no comments or changes Doug Roach made a motion to approve the minutes which was seconded by Jerry Jordan. With a vote of 5-0, the minutes were approved.
