HomeMy WebLinkAboutOrdinance No. 13/010 Abandon easement 4338 San Carlos ORDINANCE NO. 13/10 AN ORDINANCE OF THE CITY OF UNIVERSITY PARK TEXAS, ABANDONING A WATER LINE EASEMENT IN LOT 1R, BLOCK 3, OF THE LOMA LINDA ADDITION, AS MORE PARTICULARLY DESCRIBED AND DEPICTED IN EXHIBIT "A", TO THE ABUTTING OWNERS; PROVIDING FOR THE FURNISHING OF A CERTIFIED COPY OF THIS ORDINANCE FOR RECORDING IN THE REAL PROPERTY RECORDS OF DALLAS COUNTY, TEXAS, AS A QUITCLAIM DEED OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of University Park, Texas, has determined that a water line easement, as described and depicted in Exhibit"A", is not needed or necessary for public purposes by the City and it should be abandoned to the abutting owners;Now,Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK,TEXAS: SECTION 1. In consideration of the payment of $5,083.65, the fair market value as determined by an appraisal obtained by the City, the City of University Park hereby abandons and quitclaims, in favor of the abutting owners, David A. Cerutti and wife, Caren R. Cerutti, of Lot 1 R, Block 3, of Loma Linda Addition, according to the plat thereof recorded in volume 96148, page 2425, of the Map Records of Dallas County, Texas, any claim it may have to that certain water line easement, being more particularly described and depicted in Exhibit "A" attached hereto and made a part hereof for all purposes, the same as if fully copied herein, in the City of University Park, Dallas County,Texas. SECTION 2. That the City of University Park does not abandon any other interest other than described in Exhibit "A", but does hereby abandon all of its right, title, or interest in the described real property interest,together with any and all improvements thereon. SECTION 3. That upon receipt of such payment, the City Secretary is directed to prepare a certified copy of this ordinance and furnish the same to the abutting owners for recording. The recording of this abandonment ordinance in the Real Property Records of Dallas County, Texas, shall serve as a quitclaim deed of the City of University Park of all such right, title or interest of the City of University Park in and to the water line easement described and depicted in Exhibit"A". 59771 SECTION 4.
