AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK,
TEXAS, AMENDING ARTICLE 8.01 "GENERAL PROVISIONS" BY AMENDING
SECTION 8.01.001 (b) TO PROHIBIT CONSTRUCTION ACTIVITIES ON CERTAIN
HOLIDAYS; PROVIDING FOR THE REPEAL OF ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK,
TEXAS:
SECTION 1. That Article 8.01 "General Provisions" of the Code of Ordinances, City of
University Park, Texas, is amended by amending section 8.01.001 (b) to read as follows:
"(b) Loading, unloading and handling of construction material and the use of any tools or
equipment used in construction, drilling or demolition work shall be permitted only
between the hours of 7:00 a. m. and 6:00 p. m., Monday through Saturday, except by
special permission given by the community development director. Except in cases of
public emergency or convenience, no such permission shall be given by the community
development director for any construction activities on the following holidays: New
Year's Day, Memorial Day, July 4, Labor Day, Thanksgiving Day, Christmas Eve, and
Christmas Day, and no such construction activities shall be engaged in on such holidays.
A person in control of property and the owner of the property commit an offense if they
fail to prevent construction activities on the property in violation of this subsection."
SECTION 2. All provisions of the Code of Ordinances of the City of University Park,
Texas, in conflict with the provisions of this ordinance are hereby repealed.
SECTION 3. Should any word, sentence, paragraph, subsection, clause, phrase or section
of this ordinance or of the Code of Ordinances, as amended hereby, be adjudged or held to be void
or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance
or the Code of Ordinances, as amended hereby, which shall remain in full force and effect.
SECTION 4. Any person, firm or corporation violating any of the provisions of this
ordinance or the Code of Ordinances, as amended hereby, shall be deemed guilty of a
misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas,
shall be punished by a fine not to exceed the sum of five hundred dollars ($500.00) for each
offense, and each and every day any such violation shall continue shall be deemed to constitute a
separate offense.
SECTION 5. This ordinance shall take effect from and after its passage and the
publication of the caption, as the law and Charter in such cases provide.
DULY PASSED by the City Council of the City of University Park, Texas, on the 19th day
