BACKGROUND:
Since1982,theCityofUniversityParkhasplanted over3,600treeswithinourcommunityaspartof
thesuccessful“TreesforTown”program.Inaneff orttocontinuetodemonstrateourcity’s
commitmenttothehealth,well-beingandaestheticsofourcommunity,staffreques tstheCityCouncil
considerapprovalofaproclamationestablishingFr iday,November16,2012as “ArborDay”inthe
CityofUniversityPark.
Staffbelievesthatthiswillbeanexcellentoppor tunitytoremindresidentsoftheimportanceof
plantingtreesduringthistimeofyear.

BACKGROUND:
PublicWorksstaffmetrecentlywithrepresentative sfromHighlandParkPresbyterianChurchand
ParkCitiesBaptistChurchregardingSundayparking issues.TheCityhastypicallyplacedtemporary
signagealongstreetsnearbothchurchcampusesto addressparkingandtrafficissues.Wehave
recommendedtoHPPCandPCBCthatwediscontinueth atpracticeandinsteadplacepermanent
signagefortheparkingissues.Wehavealsoreque stedthatanoff-dutypoliceofficerhiredbythe
churchesplaceacoupleoftemporarytrafficsigns atspecificlocationsonSundaymornings.Both
churcheshaveagreedwithstaff'srequest.
Theaforementionedrecommendationsaresuggestedto allowustobemoreproductivebyreducing
overtimeandallowingstafftoperformregularduti esduringtheweek.

AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS,
PROHIBITING PARKING ON THE EAST SIDE OF PICKWICK LANE FROM
WENTWOOD TO VILLANOVA AT ANY TIME; PROHIBITING PARKING ON
SUNDAY FROM 7:00 A. M. TO 1:00 P. M. ON THE NORTH SIDE OF VILLANOVA
FROM TULANE TO BALTIMORE AND ON THE SOUTH SIDE OF VILLANOVA
FROM PICKWICK LANE TO TULANE; PROVIDING FOR THE ERECTION OF SIGNS;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO
EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That it shall be unlawful and an offense for any person to leave, stand or
park any motor vehicle:
A. At anytime on the east side of Pickwick Lane from Wentwood to Villanova; or,
B. On Sunday from 7:00 a. m. to 1:00 p. m. on the north side of Villanova from Tulane to
Baltimore, or on the south side of Villanova from Pickwick Lane to Tulane.
SECTION 2. All ordinances of the City of University Park in conflict with the provisions
of this ordinance are hereby repealed.
SECTION 3. Should any sentence, paragraph, subdivision, clause, phrase or section of this
ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the
validity of this ordinance as a whole, or any part or provision thereof, other than the part decided to
be invalid, illegal or unconstitutional.
SECTION 4. Any person violating any of the provisions of this ordinance shall be deemed
guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park,
Texas, shall be subject to a fine not to exceed the sum of two hundred dollars ($200.00) for each
offense.
SECTION 5. That this ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide. The parking
restrictions set out herein shall not be effective until appropriate signs giving notice thereof shall
have been erected as provided by the Code of Ordinances.
DULY PASSED by the City Council of the City of University Park, Texas, on the 16th day
of October 2012.

BACKGROUND:
AttheirJuly17,2012meeting,theCityCouncilap provedacontractwithR.L.Goodsonconsulting
engineers,intheamountof$138,720.Inthatagre ement,RLGprovidedtheengineeringand
surveyingservicesnecessaryforcontractadministr ationandresidentinspectionofautilityand
pavingprojectalongAirlineRoad,northfromBinkl eytotheMcFarlin-Fondrenalley.Althoughthe
projectiswithintheCity'srights-of-way,thewor kwasdrivenbySMU.Tothatend,SMUfunded
boththeconstructionandtheRLGengineeringservi ces.
UPstaffmetrecentlywithSMUstafftodiscussap roposedchangeinthescopeofworkonthe
Airlineproject.Theywanttoextendtheirproject eastfromAirlinealongSMUBlvd.toDublin.
SMUwantstoreconstructSMUBlvdtomakeitarchit ecturallycompatible(landscaping,decorative
lighting,andetc)withthereconstructiondoneby theBushFoundation.Theyproposetofundthe
entireproject.Tothatend,theattachedproposal fromRLGoodsonintheamount
of$31,500providestheengineeringservicesnecess arytotheextendedscopeofwork.
RECOMMENDATION:
StaffrecommendsCityCouncilapprovaloftheRLGo odsonproposalintheamountof$31,500and
authorizetheCityManagertoexecuteacontract.Councilapprovalshouldbesubjecttothedeletion
ofthe"limitofliability"clauseintheproposal.

Inplanningformitigationoftheonlysanitarysew eroverflowsituationwithintheCitylimits,at
GrassmereandLomoAlto,themostdesirableroutei stoextendtheabove-referencedDouglassewer
north.Becauseoftheproximityoftheworktothe currentproject,staffrequestedthatC-P
Engineeringdevelopaproposal,asanaddendumtot heircontract,toperformtherequisitedesign.

SECTION 1. That the “Redflex Agreement” and the “Interlocal Agreement”, true

Scofflaw Services for withholding of motor vehicle registration from persons with outstanding,

SUBJECT: Full-time Building Inspector
Summary
During a recent reorganization of the Community Development Department, I recommended to
replace a part-time clerk position, with a part-time building inspector/plans examiner position.
This part-time position was intended to supplement the two current full-time building
inspectors with plan review and inspection responsibilities. After advertising for this position
and interviewing several candidates, Cyndi Lewis and I determined that none of the candidates
met the plan review and building inspection needs of the department. After reassessing the
position, I am recommending that the position be upgraded to a full-time building inspector
position for the following reasons:
Inspection and permit data for both residential and commercial construction point to
increased demand for inspection and plan review services;
Building inspections for commercial construction has become a greater percentage of the
inspectors’ total workload,
Industry metrics for maximum inspections/inspector/day, seem to show that the City’s current
building inspectors are at the top end of the effectiveness range;
Inspector absences create scheduling problems, which result in one inspector being
overburdened to compensate for the absence of the other inspector; and
Anticipated retirements within the department will result in a significant loss of institutional
memory without overlap between hires.
Background
University Park has experienced a significant increase in construction activity for both
residential and commercial construction since 2009 (See Charts 1 & 2). While inspection totals
still lag historical highs from 2007, the type of construction activity has changed dramatically
(See Table 1). Table 1 identifies the peak inspection months per year since 2005, with
residential and commercial subtotals. While the table shows that mon thly inspection activity is
on the rise, it demonstrates that the percentage of commercial building inspections has
significantly increased as a portion of overall inspections performed.
Community Development
Department
As a general rule of thumb, commercial inspections are larger in scale and more time intensive
than residential inspections. Ongoing and anticipated commercial construction activity will
remain at high levels for the next 36 to 48 months (See Tables 2 & 3). The George W. Bush
Presidential Center and Residential Commons Project have stressed the overall capacity of the
department’s plan review and inspection capabilities. While the Presidential Center is set to
complete construction within the next few months, the Residential Commons project, which is
more than double the square footage of the Presidential Center, will not be complete until
2014. During that time period additional commercial projects are scheduled to begin
construction.
To assess the operational capacity of the City’s inspection services; staff conducted a poll of
North Texas cities regarding inspection activity and staffing efficiencies. Most of the
respondents indicated that a healthy inspection workload per day is between 12 -15 inspections
per inspector. Since July; the City’s two building inspectors have averaged over 14 inspections
per day, with a higher percentage of inspections coming from commercial construction. Since
this workload is at the upper limit for effectiveness, the department experiences significant
problems when an inspector is out sick or on vacation. It is not uncommon for one inspector to
complete between 30-40 inspections per day when the other inspector is absent. It is my fear
that this type of workload can contribute to reduced inspection quality, inspector fatigue, and
lower morale.
One additional challenge the department will be facing in the upcoming years is staff turnover
from retirements. Given the complexities of the City’s zoni ng ordinance and knowledge of
longtime inspectors, it would make sense to hire a full-time inspector to overlap the tenure of
retiring inspectors. At that time, it would be prudent to again evaluate the need for three full-
time inspectors versus just two.
Based upon the information in this report, it would be my recommend ation to hire an
additional building inspector on a full-time basis. This position would replace the part-time
position already budgeted for this fiscal year, and the net anticipated expenditures for a new
full-time building inspector would be approximately $75,000, including benefits and
certifications (See Table 4). If authorized, this new full-time position would flex between plan
review and building inspections as needed. Cyndi and I believe a good base for an inspector to
start learning the zoning ordinance is in plan review. This would allow Cyndi to devote
additional time for evaluating departmental procedures, preparing for upcoming code change
cycles and local amendments, and assisting with the implementation of the department’s new
permitting and inspection software.

BACKGROUND:
TheCityCodeofOrdinancescontainsalong-standin gprovisionforthegrantingoffranchisesforthe
privatecollectionofsolidwastefromcommerciale stablishmentsandconstructionsites.TheCode
makesreferencetotheCity'sBoardofCommissioner sandthefranchiseprovisionshavenotbeen
utilizedforover15years.Recently,afewlarge-scalecommercialdevelopmentshavebeenproposed
thatwouldbenefitsignificantlyfromhavingasing lestationarycompactorforthecollectionofsolid
wasteratherthanamultitudeoftheCity's3-cubic yarddumpsters.Inresponsetotheneedsofthese
developments,staffhasreviewedtheoldcodeprovi sionsforcommercialsolidwastefranchises
withintheCity.
WithsomerevisionstotheexistingCode,stafffee lswecanbetteraccomodatetheneedsofour
commercialresidentswhilestillprotectingtheint egrityofourstreetsandexistingsanitation
operation.Thegrantingofafranchiseallowsaco mpanytousethepublicstreetsandthoroughfares
withintheCityforthepurposeofengaginginali mitedbusinessofcollectinganddisposingofwaste
generatedwithintheCity.Thedemandforresident ialgarbagecollectionandbasiccommercial
dumpstercollectionwithinUniversityParkissuch thatwecanefficientlyoperateafull-time
sanitationdivisiontoprovidetheseservicestoou rresidents.Thereareothercommercialsanitation
servicesneededbysomeofourresidentsthatcanno tefficientlybeprovidedbytheCitygiventhecos t

Grantingafranchisetoprivatecompaniestoprovid ethosecommercialsanitationservicesnotoffered

AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING
ARTICLE 13.05 “SOLID WASTE” OF THE CODE OF ORDINANCES TO REGULATE
COMMERCIAL COLLECTION OF WASTE, INCLUDING PORTABLE TOILETS;
PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City requires a franchise for the collection of waste from commercial
establishments and construction sites; and,
WHEREAS, the City council has determined that portable toilets should be included in
the regulation of waste collection from construction sites; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. The Code of Ordinances, City of University Park, Texas, is hereby
amended by amending Article 13.05 Division 3 in part as follows:
“ARTICLE 13.05 SOLID WASTE

Division 3. Franchise for Collection from Commercial Establishments and
Construction Sites
Sec. 13.05.081 Generally
For and in consideration of compliance by the franchisee with the covenants and conditions
herein set forth, and the ordinances and regulations of the city governing the collecting and
disposing of commercial stationary compactor containers, discarded tire containers, portable
toilets, and construction roll-off containers, and upon application and approval as provided
herein, the city hereby agrees to grant to a select applicant a franchise to use the public streets
and thoroughfares within the corporate limits of the city for the purpose of engaging in a limited
business of collecting and disposing of waste generated within the corporate limits of the city.

Sec. 13.05.083 Rights of city
This franchise shall not be taken or held to imply the relinquishment or waiver by the city of its
power to make reasonable requirements or regulations, and the city hereby expressly reserves the
right to make all regulations which may be necessary to properly secure, in the most ample
manner, the safety, welfare, and accommodation of the public, including, among other things, the
right to adopt and enforce regulations to protect and promote the health and general welfare of
the public from danger and inconvenience in the management and operation of waste collection,
and to provide such service as contemplated by this franchise.

Sec. 13.05.085 Service requirements
It is expressly agreed and understood that the franchisee shall collect and deliver for disposal all
garbage, brush, limbs, bulky items, building materials, and portable toilets from commercial
establishments and construction sites which are contracted by the franchisee, with the sole
exception of hazardous wastes or other prohibited waste as defined by the United States
Environmental Protection Agency and the department of state health services. The franchisee
shall, at its own expense, furnish personnel to collect garbage, solid waste, and portable toilets
and will establish and maintain, in an efficient and business-like manner, such scheduled routes
and special schedules as may be necessary to fulfill the waste service requirements of the city.
Unless otherwise established by ordinance, collection schedules shall be determined by the
franchisee based upon negotiations with the customers. Information on customer locations,
routes and schedules shall be supplied to the city as part of the annual application filing.
Sec. 13.05.086 Award of franchise; performance standards
The franchisee shall submit with its application a standard operating procedure for review. The
City Council shall review the application and procedure and award a franchise if a vacancy exists
and the applicant meets the requirements of this division. The City Council shall act on the
proposed procedure and application within sixty (60) days after filing.

Sec. 13.05.089 Street use fees
In consideration of the grant contained in section 13.05.081 above, the franchisee agrees to pay
to the city seven percent (7%) of the gross receipts collected by the franchisee from contracted
waste accounts for services rendered under the provisions of this franchise, said fees to be paid
monthly.

Sec. 13.05.091 Vehicle identification
All vehicles and equipment used by the franchisee for the collection and transportation of
commercial garbage, solid waste, or portable toilets shall be clearly marked…

(a) The franchisee shall provide, at its own expense, containers to the owner or occupant of
any premises wherein it contracts for commercial storage collection of solid waste or
portable toilets, subject to the following requirements:

Sec. 13.05.093 Disposal of waste
The franchisee agrees to dispose of all waste collected within the city at a site approved by the
state. The franchisee will be responsible for payment of all disposal fees.
Sec. 13.05.094 Revocation
If at any time the franchisee shall fail to perform any of the terms, covenants or conditions herein
set forth, provided such failure is not due to war, insurrection, riot, strike, natural disaster, or any
other cause beyond the franchisee’s control, the city may, after a hearing as described herein,
revoke and cancel the grant given in section 13.05.081 hereof and the franchise shall be null and
void…. The hearing shall be conducted in public by the City Council, and the franchisee shall
be allowed to be present and given full opportunity to answer such charges and allegations as are
set out against him in the notice. If, after the hearing is concluded, the City Council shall
determine that the charges and allegations set forth in the notice are affirmed by the facts
presented at the hearing, they may, by a two-thirds vote of all Council members, revoke and
cancel the franchise, and the same shall be null and void thirty (30) days thereafter.

SECTION 2. Should any sentence, paragraph, subdivision, clause, phrase or section of
this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance or the Code of Ordinances as a whole, or any part or
provision thereof, other than the part so decided to be invalid, illegal or unconstitutional.
SECTION 3. This ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS, AUTHORIZING ADDITION OF A VOLUNTARY DONATION
AMOUNT TO MONTHLY RESIDENTIAL AND COMMERCIAL UTILITY BILLS;
AUTHORIZING THE CITY MANAGER TO TRANSFER THE AMOUNT OF
DONATIONS TO THE COLLEGE SCHOLARSHIP FUND FOR CHILDREN OF CITY
EMPLOYEES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City’s employees and their families are valuable assets to the citizens
of the City; and,
WHEREAS, the City Council wishes to assist City employees in financing of college
educational opportunities for their children; and,
WHEREAS, a college scholarship fund has been established for such purpose by
private donations to the University Park Civic Foundation and the City Council desires to
provide a means whereby citizens may make voluntary monthly donations to such scholarship
fund; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That effective December 1, 2012, the sum of $0.50 will be added to each
monthly residential and commercial City utility account, not including accounts of public
entities or churches, as a voluntary contribution by each customer to the college scholarship
fund established by the University Park Civic Foundation for the children of City employees.
Any utility customer may opt out of the program at any time by contacting the City utility
department, the finance department or the City Manager’s office. Upon notification by a
customer of withdrawal from the program, the utility billing staff will promptly remove the
voluntary amount from the customer’s future billing statements. Refunds will be made,
through a bill adjustment, to an active customer who opts out of the contribution program and
who requests a refund, for up to twelve billing cycles. The City will provide any customer who
requests one a year end charitable contribution statement.
SECTION 2. None of the funds contributed by utility customers in this program may
be used by the City of University Park. The City Manager is authorized and directed to transfer
the total amount of such donations monthly to the college scholarship fund, such fund to be
administered through the Civic Foundation as determined by the City Council, on behalf of the
children of the employees of the City of University Park, and to take such other administrative
steps as may be necessary to further the objectives of this Resolution.
SECTION 3. This Resolution shall take effect immediately from and after its passage,
and it is accordingly so resolved.
