BACKGROUND:
Inresponsetoarequest,staffpolledtheresident salongthe3500blockofRosedaleonenacting
parkingrestrictionsalongtheirblock.Thesurvey askedforopiniononplacinga"2-Hour,Monday-
Friday,8a.m.-4p.m."restrictionalongboththe northandsouthcurbs,westfromDickensto
Thackery.Theresultsofthesurvey,asdetailedo ntheattachedspreasheet,show75%oftheresident s
alongthesouthsideofthestreetareinfavorof theproposedchange.Alongthenorthsideofthe
street,57%oftheresidentswereinfavorofthep arkingdesignation.Responseswerereceivedfrom
87.5%ofthehouseholdsonthesouthsideandfrom 80%ofhouseholdsonthenorthside.
Withaclearmajorityoftheresidentsinfavor,st affaskedtheCityAttorneytodrafttheenabling
ordinance.
RECOMMENDATION:
StaffrecommendsCityCouncilapprovaloftheordin anceplacinga"2-Hour,Monday-Friday,8a.m.

P. M., MONDAY THROUGH FRIDAY, IN THE 3500 BLOCK OF ROSEDALE;
PROVIDING FOR THE ERECTION OF SIGNS; PROVIDING FOR THE REPEAL OF
ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO
HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That it shall be unlawful and an offense for any person to leave, stand or
park any motor vehicle for more than two (2) hours, from 8:00 a. m. to 4:00 p. m., Monday through
Friday, in the 3500 block of Rosedale.
SECTION 2. All ordinances of the City of University Park in conflict with the provisions
of this ordinance are hereby repealed.
SECTION 3. Should any sentence, paragraph, subdivision, clause, phrase or section of
this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not
affect the validity of this ordinance as a whole, or any part or provision thereof, other than the part
decided to be invalid, illegal or unconstitutional.
SECTION 4. Any person violating any of the provisions of this ordinance shall be deemed
guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park,
Texas, shall be subject to a fine not to exceed the sum of two hundred dollars ($200.00) for each
offense.
SECTION 5. That this ordinance shall take effect immediately from and after its passage
and the publication of the caption, as the law and Charter in such cases provide. The parking
restrictions set out herein shall not be effective until appropriate signs giving notice thereof shall
have been erected as provided by the Code of Ordinances.

BACKGROUND:
AttheAugust21,2012CityCouncilmeeting,staff reviewedarequestfromFidelityNationalTitle
InsuranceCompanytoabandonautilityeasementalo ngtheeastsideofthepropertylocatedat2632
Westminster.Thewaterlineinthateasementisno longerinservice.TheFNTIrepresentative
previouslyrequestedtheCitynotfollowitsusual abandonmentpolicy,whichrequirespaymentoffair
marketvalue(FMV)foritsinterestintheeasement orright-of-waybeingabandoned.Fidelity'soffer
of$7,500wasrejected,andtheCouncildirectedst afftocontactthecompanytorestatetheCity's
desiretomaintainconsistencyintheabandonmentp rocess.Followingthosediscussions,Ireceiveda
letter,includedforyourreview,withanoffercom mensuratewiththeCity'scalculationoftheFMV
at$20,150.27.
IrequestedtheCityAttorneydeveloptheenabling ordinance.Uponreceiptofpaymentstaffwill
provideacertifiedcopyoftheabandonmentordinan ce,whichmustbefiledatDallasCounty.
RECOMMENDATION:
StaffrecommendstheCityCouncilapprovetheordin anceabandoningtheutilityeasementalongthe

AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS,
ABANDONING A 1,770 SQUARE FEET UTILITY EASEMENT TO THE ABUTTING
OWNERS, WILLIAM A. INMAN AND LAUREN L. INMAN, FOR A CASH
CONSIDERATION OF $20,150.27; PROVIDING FOR THE FURNISHING OF A
CERTIFIED COPY OF THIS ORDINANCE FOR RECORDING IN THE REAL
PROPERTY RECORDS OF DALLAS COUNTY, TEXAS, AS A QUITCLAIM DEED OF
THE CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of University Park, Texas, has determined that a
certain utility easement is no longer needed or necessary for public purposes by the City and should
be abandoned to the abutting owners in consideration of payment of the fair market value; Now,
Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. The City of University Park hereby abandons and quitclaims, in favor of the
abutting owners, William A. Inman and Lauren L. Inman, a married couple, a 1,770 square feet
utility easement described as:
“A strip of land ten feet in width running North and South along the entire East line of Lot 4
in Block D of Compton Heights Addition to the City of University Park, as recorded in
Volume 6, page 82 of the Map Records of Dallas County, Texas”.
SECTION 2. In exchange for the abandonment of this real property interest, the abutting
owners will pay the City of University Park a cash consideration of $20,150.27, such amount being
the fair market value of the easement being abandoned, as determined by an appraisal obtained by
the City for such purpose.
SECTION 3. That the City of University Park does not abandon any other interest other
than described in Section 1 above, but does hereby abandon all of its right, title, or interest in the
described real property interest, together with any and all improvements thereon.
SECTION 4. That the City Secretary is directed to prepare a certified copy of this
ordinance and furnish the same to the abutting owners for recording upon receipt of the cash

consideration required hereby. The recording of this abandonment ordinance in the Real Property
Records of Dallas County, Texas, shall serve as a quitclaim deed of the City of University Park of
all such right, title or interest of the City of University Park in and to the utility easement described
in Section 1 above.
SECTION 5. This ordinance shall take effect immediately from and after its passage, as
the law and Charter in such cases provide.

RESOLUTION NO. _________________________
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS, APPROVING A MEMORANDUM OF AGREEMENT FOR VEHICLE
IDLING LIMITATIONS IN THE NORTH CENTRAL TEXAS AREA; AUTHORIZING
THE MAYOR TO EXECUTE THE MEMORANDUM OF AGREEMENT ON BEHALF
OF THE CITY; AUTHORIZING THE CITY MANAGER TO IMPLEMENT THE
LIMITATIONS AS PROVIDED IN THE AGREEMENT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Dallas/Fort Worth area is a federally-designated nonattainment area for
the pollutant ozone; and
WHEREAS, air quality impacts the public and economic health of the citizens of the
City of University Park; and
WHEREAS, the City has previously entered into a Memorandum of Agreement with the
Texas Commission on Environmental Quality (TCEQ) for Enforcement of Vehicle Idling
Limitations; and
WHEREAS, the City Council believes that it is in the best interest of the public health,
safety and general welfare of the citizens of the City that the City participate in an amended
Memorandum of Agreement to implement the latest revised rules of the TCEQ regarding vehicle
idling limitations in the City;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That the “Memorandum of Agreement For Vehicle Idling Limitations In
The North Central Texas Area”, revised with rules adopted by the TCEQ in 2011 and 2012, a
true copy of which is attached hereto as Exhibit “A” is approved in all respects for execution on
behalf of the City.
SECTION 2. That the Mayor is authorized to execute the Memorandum of Agreement
on behalf of the City of University Park and to deliver executed copies thereof to the necessary
parties.
SECTION 3. That the City Manager is authorized to implement the terms of the
Memorandum of Agreement as provided therein.
SECTION 4. This Resolution shall take effect immediately from and after its passage,
and it is accordingly so resolved.

FRIDAY, NOVEMBER 16, 2012, 4:00 P.M.
The City Council Meeting was called to order at 4:20 p.m. Present were Mayor Dick Davis,
Mayor Pro Tempore Bob Clark, Councilmember Bob Begert, and Councilmember Tommy
Stewart. Also present were City Attorney Rob Dillard and City Manager Bob Livingston.
Councilmember Dawn Moore arrived at 4:40 p.m.
Staff present included Chief Planning Official Harry Persaud, Director of Finance Kent Austin,
City Secretary Liz Spector, Director of Public Works Bud Smallwood, Director of Community
Development Robbie Corder, Community Information Officer Steve Mace, and Assistant to the
City Manager George Ertle.
Mayor Davis addressed the audience. He stated unless the Council has questions for concerned
parties in the audience, there will be no formal chance for those parties to address the Council.
Mayor Davis asked Community Development Director Corder to display a slide detailing
proposed PD conditions where disagreement exists between the YMCA, neighborhood interests
and City staff. He suggested that Mr. Corder go through the items as listed alphabetically on the
document.
Mr. Corder began with Item A. Permitted Land Use. He said square footage allowed for
specific uses at the YMCA are not defined in the proposed conditions as suggested by staff and P
& Z but, he stated the neighbors want uses defined in this manner. Mr. Livingston suggested
using the definitions as originally submitted by the YMCA. Mr. Persaud stated these specific
uses will be on the Detailed Site Plan that must be approved by the Council. Mayor Davis then
agreed to leave this detail out of the PD conditions until the Detailed Site Plan is submitted.
Councilmember Begert said the PD conditions should detail specific definitions for activity and
non-activity uses as approved by the Council at the last meeting. He reiterated that the non-
activity space shall not exceed 13,670 feet.
Mr. Corder discussed Item B. Maximum Building Size. Mr. Corder said there is a question
about how the square footage of the building should be defined. He said some of the questions
are related to how “air conditioned space” is defined. Mayor Davis suggested this question
should be answered in the Detailed Site Plan. Councilmember Begert said he wanted to know
how Gross Floor Area is defined in the City Ordinance. Mr. Corder said the Zoning Ordinance
calculates it using exterior building dimensions but the YMCA site plan has always defined it
using interior dimensions. Mr. Corder said Mr. Duncan Fulton, the architect for the YMCA,
calculated using exterior building dimensions would create a 2,600 square foot deficiency in
their allowed space. Mr. Corder said the conditional site plan submitted with the YMCA’s
application requested to use “air conditioned” space to calculate square footage. He said this has
evolved from the initial application through hearings at P & Z and City Council from “air
conditioned” space to the present term of “gross floor area.” Council members Begert and Clark
stated they thought exterior measurements should be used for the calculations since that is how
the City’s Ordinance reads.
Mayor Davis said the application from the YMCA does not stipulate using exterior or interior
dimensions. City Attorney Dillard said although the Zoning Ordinance calculates gross floor
area using exterior dimensions, Planned Development Districts can define them differently. He
said they use the approved site plan plus any adopted conditions. Mr. Dillard said the City has
done so in other instances, for instance, when calculating building setbacks and heights. He said
the Council has the authority to use either inside or outside measurements. Councilmember
Begert asked if the City has ever calculated gross floor area using interior measurements, and
Chief Planning Official Persaud said not to his knowledge.
Mr. Persaud expressed concern over changing the customary way gross floor area is calculated.
Mayor Davis asked to move to Executive Session on this single issue later in the meeting. He
then requested to move forward to the next issue.
Mr. Corder discussed D. Building Standards. He said the Council approved 291 parking spaces
at their last meeting, but he said this total included seven (7) drop-off spaces. He requested the
site plan be drawn with 284 spaces in the parking garage. YMCA representative John Bunten
said this is acceptable to the Y.
Mayor Pro Tem Clark mentioned he had a question under Item C. Building Setbacks, (e)
related to height of the screening wall for outdoor storage and dumpsters. He said he requested
the height of the stored items not exceed the height of the screening wall.
Mr. Corder moved to Item E. Parking. Mr. Corder said most items included in this category are
not in contention, except the neighbors suggest deleting the section related to not counting “air
conditioned space in the parking garage” towards the maximum above grade square footage. Mr.
Corder said this will be somewhat difficult as the Zoning Ordinance excludes parking garages
from gross floor area calculations. He said this could be an opportunity for direction from the
Council as it is somewhat ambiguous. Mr. Corder said the elevator shaft and any vestibule for
the elevator will be air conditioned and this should not count against the gross floor area.
Resident Nick Kuntz said his concern is if underground space is air conditioned and doesn’t
count towards the 57,200 that the YMCA may find a way to fit an activity space there. Mr.
Livingston said this could be defined in the Detailed Site Plan. Mr. Persaud said the conditions
could be written to state no activity like exercise or any other function be allowed in the parking
garage. Mayor Davis said that will be important to include.
Mr. Corder discussed item N. Traffic Study. Mayor Davis asked that when writing the PD
conditions, the clause provided by the YMCA be amended as follows: “The YMCA is required
to pay the full cost for a comprehensive traffic study to be conducted approximately 2 months
after any such notice. Such traffic study shall be performed by a consultant selected by the City
Council. The YMCA shall pay the cost for any future traffic control measures or studies deemed
necessary by the City Council.” Councilmember Begert asked what actions the City could take
if traffic counts at completion of the project are higher than projected. Mr. Livingston said the
YMCA can be required to make changes to improve traffic flow such as add traffic signals and
stop signs, but the City cannot require them make changes to their activities. Director of Public
Works Bud Smallwood said traffic engineer Kevin St. Jacques suggested the YMCA not
schedule concurrent basketball games. He suggested including this language in the PD
conditions. Mr. Livingston suggested language could be added to clarify whether activities can
be limited to mitigate traffic issues. Mayor Davis asked for input from YMCA representatives.
Mr. Fulton asked the Council to remember that the traffic study indicated the size of the YMCA
could double before traffic problems would occur.
Councilmember Moore asked if language could be added to the PD ordinance stating activity
may be limited at peak times. City Attorney Dillard suggested the PD ordinance could be
written to state the YMCA will use its best efforts to rearrange or reschedule activities during
high traffic flow times. He also suggested including language stating concurrent games could be
limited during peak times.
Mr. Corder asked Mr. Dillard to take Ms. Moore’s suggestion and include language in the
proposed PD ordinance that will be acceptable to the YMCA.
Mr. Corder moved to Item O. Hours of Operation. He said the neighbors have requested no
games or practices be held on the YMCA outdoor fields on Sundays. Mayor Davis suggested the
ordinance be written to require approval by the City Council for exceptional uses, such as
triathlons or other organized activities involving activity fields or other outside areas on Sundays.
Mr. John Bunten expressed concern about a requirement for City Council approval for all after-
hours use at the facility. Mr. Fulton said makeup games are allowed to be conducted at other
City parks and local school fields without Council approval. Councilmember Clark said this
does not seem equitable. He said the YMCA playing fields should be treated the same as other
local park spaces. Councilmember Moore said the YMCA field is not a City park. She thinks
no games should be allowed on Sundays in consideration of the neighbors. Mr. Bunten said the
YMCA is willing schedule no games or practices on Sundays, but he said special events like
CHAMPS or the kids’ triathlon should be allowed. Mayor Davis said since such events are
scheduled long in advance there should be no problem having to request City Council permission
prior to the event. Mr. Bunten said certain events are scheduled long in advance, but other
family events may not be. Mayor Davis said he would like more information before making a
determination.
Mr. Corder continued to Item Q. Vehicles Parked in the Service Area. Councilmember
Stewart said he wanted to include a condition that no overnight parking of YMCA vehicles on
the property will be allowed unless they are located in the enclosed service area or in the
underground parking structure. Mr. Bunten agreed to this condition but said the service area
fence height will need to be increased from 10 ft. to 11 ft. to screen the bus.
The Council agreed that Item R. Construction Standard is acceptable as written.
After some discussion among the Council. Mr. Corder determined that Item T. Delivery During
Contruction will read “All deliveries of construction materials to the construction site will begin
no earlier than 9 a.m. and end by 4:00 p.m..” He said conditions related to construction vehicles
will be included in Item W. Construction Vehicles. Mr. Corder said Item W includes details
regarding parking of construction vehicles on City streets. Mayor Davis asked if YMCA
representatives or the neighbors had any comments related to items covered under T. Delivery
During Construction, U. Staging, or V. Full-Time Liaison. Mr. Corder mentioned that no
construction vehicles or equipment will be allowed to park on city streets. It was also discussed
that until such time as the site workers can park in the underground facility, they will be parked
off-site and bused in. Mr. Bunten asked about the intent of Item U, no continuous staging of
construction work or materials on residential streets. Mr. Corder said that language came from
the east side neighbors who want to ensure that any construction staging is behind the site
screening wall.
Mr. Corder said Item Z. Explosives states that no explosives may be used in construction
operations. The YMCA representatives agreed.
Mr. Corder discussed Item AA. Security with the Council. It was decided to add clarifying
language to this clause as follows: “The developer shall provide and pay the costs for adequate
security and traffic control around the site for all functions during construction.”
After some discussion amongst the City Council, it was decided to delete YMCA Item BB.
Modifications to the Site Plan.
Mr. Corder said the City’s Item BB. Screening Fence is acceptable as written to be an eight ft.
(8 ft.) painted green plywood construction fence.
The Council members agreed to include Item CC. Traffic Control Plan. Mr. Corder said the
YMCA will submit a traffic control plan to the Director of Public Works as described.
Mr. Corder addressed Item DD. Elevator Access & Playfield Bleachers. He said staff added
these conditions based on prior City Council direction. He said the Council requested the
YMCA add a second elevator to allow those using the playing field to directly access the field.
He said after a review by the YMCA and staff it was determined that this second elevator will be
situated on the north side of the building, adjacent to the playing field. The YMCA has also
agreed to place the bleachers as close as possible to the secondary elevator.
Resident Gil Brown asked if it would be possible to flip the Fire Lane from the residential curb
side to the YMCA side. Mr. Smallwood thought this would make sense and said he will check
with Fire Chief Howell. Mr. Bunten said the First Unitarian Church may have an issue with
Sunday parking if these spaces are eliminated. Mr. Corder said he will talk to church
representatives about how many spaces they anticipate needing.
Mayor Davis said he feels there is a general understanding of what needs to be done. He stated
the Council members need to put more time into crafting the PD conditions and anticipates a
Closed Executive Session will need to be held in the future.
In response to a question from Mr. Brown, Councilmember Begert asked how YMCA patrons
can be deterred from entering the parking garage from the back side, rather than from Preston
and Normandy. Mr. Smallwood stated there is nothing in the current plan that would preclude
this from happening. Mr. Brown asked the City Council to look at options to ensure direct
ingress/egress from Preston Road. Mr. Livingston suggested eliminating a right turn from
Normandy into the parking garage and to reconfigure the entrance ramp to make such a right turn
difficult. He asked Mr. Smallwood to discuss this with the traffic engineers and possibly redraw
the site plan to retain church parking, help the neighbors and make it more difficult for parking
garage users to enter from the right-turn side.
Mayor Davis asked Mr. Smallwood to provide a brief overview of possible Normandy/Preston
Road intersection configurations. Mr. Smallwood said based on studies done by DeShazo and
St. Jacques, the current offset works based on the anticipated maximum capacity. Mr.
Smallwood said Mr. St. Jacques opined it would be safer to have a more traditionally aligned
intersection. Mr. Smallwood said there have been four (4) reported accidents at this intersection
during the last 2 years and only two were related to crossing at Normandy. He said a major issue
in reconfiguring the intersection is who would pay for costly improvements. Mr. Smallwood
said based on a safety issue, he would like to see the intersection realigned, but he doesn’t know
if the YMCA can be required to pay for this. He also stated based on anticipated capacity, the
current alignment works. He said there are many issues to evaluate in determining whether the
intersection should be realigned and the City Council will need to decide if the City should pay
for the improvements. He stated the YMCA will be responsible for the cost of signal
improvements should the traffic studies show such improvements are warranted.
Mr. Smallwood said the neighbors have said they want the intersection realigned. Mr. Fulton
said he has concerns that such realignment may be less safe.
Mayor Davis said he will adjourn the meeting. He said notice of meeting and additional
information will be provided to interested parties prior to the next meeting, as promptly as
feasible. Mr. Corder said there are additional neighbor conditions that have not been discussed.
Mayor Davis said these will be reviewed and discussed at a future meeting.
Mayor Davis adjourned the meeting at 5:45 p.m.

Staff was asked recently whether the dedicated left-turn lane can be constructed within
the existing Preston right-of-way. There is sufficient right-of-way, however, the
improvements would come at a cost. Two alternatives are available:
x Move the east and west curbs back 5-feet, north from Normandy to Shenandoah,
this would create the 10-foot DLT lane. The widening would result in the loss of
4 parallel parking spaces in front of 5915-19-21-29 Preston, and 8 head-in
spaces in front of 6001-05-09-13 Preston. All of the aforementioned
condominiums have additional parking along the alley west of their residences.
x Leave the west curb where it is and widen the east side of the street by 10-feet.
This however, would create an unsafe situation leaving a 5-foot sidewall
immediately adjacent to a travel lane on Preston to the west and the YMCA fence
along the east side of the sidewalk. Safety is a concern.
Parking garage ingress-egress. During a recent discussion of the site plan, a concern
was raised by one of the residents just east of the YMCA. Given the geometry of the
garage ingress-egress, patrons accessing the garage can easily use Shenandoah,
Connerly, and Normandy from the east. The attached driveway detail has been
modified to address this concern.

The City of University Park received design/build proposals for the above referenced project on Wednesday,
November 7, 2012. Please refer to the following proposal tabulation for results.
After evaluating each proposal in accordance with the established selection criteria, Gallagher Construction Services
recommends that the City of University Park award a contract to Greenscape Pump Services, Inc. in the amount of
One Hundred Ninety Eight Thousand Six Hundred Forty Six Dollars ($198,646) which represents the base
proposal less the specified landscape allowance.
We recommend that the City award this contract contingent upon further negotiations with the City’s Representative
and receipt of the required insurance and bonds and if the awarded contractor does not provide them, award is
made to the next responsible low proposer pending successful price negotiation.

IMPORTANT TERMS AND CONDITIONS: READ CAREFULLY
1. rices are good for 60 days from date of proposal.
2. Pricing does not include tax. Purchaser to supply copy of tax exempt certificate for exempt status.
3. Price includes line items as defined in proposal body. Any additional materials or labor required is not included.
4. Freight is FOB job site -as shown
5. Please allow 4 to 5 weeks for pump equipment installation in vault & delivery to job site.
6. Purchaser to Provide:
• Permits and associated fees for pump station installation -if required.
• Access at job site for equipment & GPSI personnel
Appropriate 230 volt, 30, 60 Hertz, 200 amp power source for pump station operation.
• City personnel to provide for safety cones & traffic guidance personnel during the crane operation time period
• City personnel to provide assistance in locating sprinkler system piping &wiring
• City personnel to provide assistance in locating underground utilities (i.e. electrical & sanitary I storm sewer lines)
• City personnel to provide for lowering Turtle Creek so wall penetrations can be made underneath the normal water level and for refilling
Turtle Creek once the installation has been completed.
7. Exclusions:
• Pricing is based upon wall structure being a concrete wall wI piers, an outer rock veneer and has no tie backs or "dead man" anchoring
system installed behind the wall so excavation can be made up next to the wall without hindrance.
Taxes are not included with this proposal.
PRODUCT WARRANTY: Warranty for products sold by Greenscape Pump Services, Inc. is provided by the manufacturer.
For those products manufactured by Greenscape Pump Services, Inc,:
Greenscape Pump Services, Inc. hereby warrants subject to the conditions herein below set forth, that should the product prove defective by reason of
improper workmanship at any time during two 2 years from date of installation, Greenscape Pump Services, Inc. will repair or replace the product as may be
necessary to restore it to satisfactory operating condition. without charge for materials or labor necessarily incident to such repair or replacement, except as
expressly excluded herein below, provided that:
1) Greenscape Pump Services, Inco has received payment in full and the prod ucts have not been altered. repaired, or serviced by anyone other than
Greenscape Pump Services, Inc. : and
2) The products have not been subjected to lightning strikes and other Acts of God, vandalism. freezing-in, aCCident, misuse or abuse, and have been
operated and maintained in accordance with the Manufacturer's Owner's Manuals shipped with products.
Exclusions: The cost of the removal, installation, and transportation of any defective part shall be paid by the purchaser. Repair to surrounding
landscape and/or other hardscape disturbed by such warranty repair shall remain the responslbllity/cost of the purchaser,
No implied warranties of any kind are made by Greenscape Pump Services, Inc. in connection with the product, and no other warranties, whether expressed
or implied, including implied warranties of merchantability and fitness for a particular purpose, shall apply to this product.
