MAIN AGENDA A.PUBLIC HEARING: on the proposed amendment of the detailed site plan for Planned Development District, PD-19, to provide for the expansion of the existing cafeteria and kitchen at the McCulloch Intermediate/Highland Park Middle School located at 3555 Granada, City of University Park. B.CONSIDER AND ACT: on an ordinance amending the detailed site plan for Planned Development District, PD-19 C.CONSIDER AND ACT: on an ordinance granting approval for a conceptual site plan to amend Planned Development District PD-12, to demolish the existing structure and redevelop a 3.72 acre tract more or less, with a new YMCA facility and a below grade parking garage. V. PUBLIC COMMENTS Anyone wishing to address an item not on the Agenda should do so at this time. Page 2 of 67 AGENDA MEMO (3/19/2013 AGENDA) TO:Honorable Mayor and City Council FROM:Councilmember Clark SUBJECT:DISCUSS: possible modification of pool pass ordinance to allow use by former mayors no longer residing within University Park BACKGROUND: At the request of Councilmember Clark, this will provide the Council an opportunity to provide direction to staff regarding possible modification of the ordinance regulating pool passes. Presently, only residents or those who own property in University Park and those living within Highland Park Independent School District are allowed to purchase passes. Councilmember Clark wishes to discuss a modification to the ordinance to allow former Mayors who are not residents or property owners to purchase pool passes also. RECOMMENDATION: Provide appropriate direction to staff. Page 3 of 67 AGENDA MEMO (3/19/2013 AGENDA) TO:Honorable Mayor and City Council FROM:Gerry Bradley, Director of Parks SUBJECT:DISCUSS: donation of scultpture to be installed in Hitzelberger Park BACKGROUND: Staff has recently been contacted by former Mayor Barbara Hitzelberger regarding the installation of a stone sculpture on the east side of Hitzelberger Park. Mayor Hitzelberger has indicated that she will donate the sculpture and associated installation cost to the City, which will be approximately $50,000. Attached, please find the sculpture detail plan and location map. RECOMMENDATION: Staff will take direction from City Council on how to proceed with this request. Adams, Chief of Police SUBJECT:RECOGNITION: of Officer Joel Holley for meritorious conduct exemplifying the highest standards of the law enforcement profession BACKGROUND: On Wednesday, January 30, 2013 Officer Joel Holley was dispatched to the 3400 block of Stanford regarding report of a burglary of a habitation in progress. While en route to the call, responders were advised by the dispatcher that the homeowner had come home and found the suspect inside the residence while he was calling for assistance. Upon arrival at the specified location, Officer Holley approached the back door and heard noises coming from inside the home. The suspect fled from the house and a short foot chase ensued. The suspect was apprehended by Officer Holley and taken into custody. Page 7 of 67 AGENDA MEMO (3/19/2013 AGENDA) TO:Honorable Mayor and City Council FROM:Gene R. Smallwood, P.E.; Director of Public Works SUBJECT:CONSIDER AND ACT: on an ordinance abandoning a utility easement across the property located at 4338 San Carlos BACKGROUND: During the sale of the property located at 4338 San Carlos, a title search revealed an easement running north/south from the alley to the street. Upon further investigation, the City had a water line, now abandoned, connected to the main in the alley and providing service to a fire hydrant in the street. That line is no longer in service, and the City has no further need for the easement. The property owner is requesting the City abandon the easement. To that end, we asked the City Attorney to develop the enabling ordinance. Appraised value of the land is $65 / square foot, and the easement is 312.84 SF. City policy for abandonments calls for easements to be valued at 25% of the appraised value. Therefore, the fair market value (FMV) of the easement is $5,083.65 (312.84 SF x $65 x 0.25 = $5,083.65) RECOMMENDATION: Staff recommends City Council approval of the ordinance abandoning a utility easement across the property located at 4338 San Carlos. ATTACHMENTS: SURVEY EXHIBIT ORDINANCE Page 8 of 67 ¾ Page 9 of 67 59771 ORDINANCE NO. _________________ AN ORDINANCE OF THE CITY OF UNIVERSITY PARK TEXAS, ABANDONING A WATER LINE EASEMENT IN LOT 1R, BLOCK 3, OF THE LOMA LINDA ADDITION, AS MORE PARTICULARLY DESCRIBED AND DEPICTED IN EXHIBIT “A”, TO THE ABUTTING OWNERS; PROVIDING FOR THE FURNISHING OF A CERTIFIED COPY OF THIS ORDINANCE FOR RECORDING IN THE REAL PROPERTY RECORDS OF DALLAS COUNTY, TEXAS, AS A QUITCLAIM DEED OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of University Park, Texas, has determined that a water line easement, as described and depicted in Exhibit “A”, is not needed or necessary for public purposes by the City and it should be abandoned to the abutting owners; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. SECTION 2. That the City of University Park does not abandon any other interest other than described in Exhibit “A”, but does hereby abandon all of its right, title, or interest in the described real property interest, together with any and all improvements thereon. SECTION 3. That upon receipt of such payment, the City Secretary is directed to prepare a certified copy of this ordinance and furnish the same to the abutting owners for recording. The recording of this abandonment ordinance in the Real Property Records of Dallas County, Texas, shall serve as a quitclaim deed of the City of University Park of all such right, title or interest of the City of University Park in and to the water line easement described and depicted in Exhibit “A”. Smallwood, P.E.; Director of Public Works SUBJECT:CONSIDER AND ACT: on an ordinance establishing NO PARKING ANYTIME along the 3000 block of SMU Blvd. BACKGROUND: SMU is funding the cost of reconstruction of SMU Blvd, east from Airline to Bush Ave (formerly Dublin). The redesign of the street eliminated the head-in parking spaces along fraternity row on the north side of the street and along the intramural field on the south side of the street. SMU is requesting that the City establish NO PARKING ANYTIME along both sides of the street. To that end, I asked the City Attorney to develop the enabling ordinance. RECOMMENDATION: Staff recommends City Council approval of the ordinance designating NO PARKING ANYTIME along the north and south curbs of SMU Blvd, east from Airline to Bush Avenue. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas, shall be subject to a fine not to exceed the sum of two hundred dollars ($200.00) for each offense. SECTION 5. That this ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide. Smallwood, P.E.; Director of Public Works SUBJECT:CONSIDER AND ACT: on bids received for screening walls for the Peek Service Center BACKGROUND: The City Council recently rejected bids for screening walls for the Peek Service Center because of non-compliance with project specifications. As a result, staff re-advertised the project. Three bids were received on Thursday, March 7, with the low bid of $89,163.75 received from Superior Concrete Fence Products of Euless, Texas. Staff reviewed Superior's bid documents and references and found all criteria in compliance. I have attached a bid tabulation sheet for the Council's review. RECOMMENDATION: Staff recommends City Council approval of the bid from Superior Concrete Fence of Texas, and authorize the City Manager to enter into a contract. Page 22 of 67 AGENDA MEMO (3/19/2013 AGENDA) TO:Honorable Mayor and City Council FROM:Robbie Corder, Director of Community Development SUBJECT:CONSIDER AND ACT: on an ordinance prohibiting construction activity on certain holidays BACKGROUND: Section 8.01.001 (b) of the University Park Code of Ordinances regulates offensive noises and construction activities. Currently, the code allows construction activity Monday through Saturday between the hours of 7am and 6pm. The code does not regulate construction activity on holidays. After staff received a written request from a resident to prohibit construction activity on holidays, staff brought the item before the City Council on January 15, 2013. During that meeting, the City Council referred the item to the Urban Design and Development Advisory Committee (UDADAC) and the Zoning Ordinance Advisory Committee (ZOAC). Meeting minutes from UDADAC and ZOAC are attached; however, both committees unanimously recommended prohibiting construction on the following holidays: 1.New Year's 2.Memorial Day 3.Fourth of July 4.Labor Day 5.Thanksgiving Day 6.Christmas Eve 7.Christmas Day Both committees' recommendations reflected a desire to match the ordinance recently approved by the Town of Highland Park prohibiting construction on the same holidays. RECOMMENDATION: Staff recommends approval of the ordinance. Call to Order Chairman Culwell opened the meeting at 12:11pm. 2. Review and Discuss Requirements for garage sales and make a recommendation to the City Council Community Development Director Robbie Corder reminded the committee of their previous discussion regarding garage sale regulations and reviewed staff recommendations based on UDADAC’s comments and suggestions. Staff recommendations include the following changes: · Garage sales may be located in the residence, garage, patio, driveway, and / or the front yard (all items in the front yard must be removed at the end of the day); · Residents may hold two (2) sales per calendar year; and · Garage sales can be listed on the City’s website upon completion of an application which will include a list of rules and procedures for sales. Current regulations that would remain in place include: · Permitted hours are 8am to 8pm; · The maximum size of a garage sale sign is 2 feet2; · The maximum number of signs allowed is one (1), and it is limited to the property of the sale; Page 24 of 67 · No permitting or registration will be required. Discussion ensued among the committee members. Rusty Goff moved to approve the recommended changes regarding garage sales. Bruce Collins seconded the motion and all members voted in favor. 3. Review and Discuss Prohibition of construction activity on certain holidays and make a recommendation to the City Council Robbie Corder informed the committee the request to prohibit construction activity on certain holidays was made by a resident and followed by a staff review of the regulations of other municipalities. He reviewed the City’s current ordinance regarding construction activity and provided the committee with information regarding the regulations of other cities. There was discussion amongst the committee members regarding which holidays should be considered for the restriction. It was decided that University Park’s list of holidays should mirror that of Highland Park’s in an effort to reduce confusion among the construction industry. The list of proposed holidays that construction would be prohibited include New Year’s Day, Memorial Day, July 4th, Labor Day, Thanksgiving Day, Christmas Eve, and Christmas Day. Charlie Little moved to approve the recommendation. Tom Weber seconded the motion and all members voted in favor. 4. Review and Approve Minutes of the August 1, 2012 meeting Chairman Culwell asked for approval of the minutes of the August 1, 2012 meeting. Mr. Smellage moved to approve the minutes, and Mr. Weber seconded the motion. All members present voted in favor. In response to a request to tour the Presidential Library, Councilmember Clark noted that all committees should have guided tours of both the Presidential and University Park Libraries. 5. Page 25 of 67 ZONING ORDINANCE ADVISORY COMMITTEE MINUTES February 26, 2013 The Zoning Ordinance Advisory Committee of the City of University Park met on Tuesday February 26, 2013 at 12:00 Noon in the Third Floor Meeting Room of the University Park Public Library, at 8383 Preston Center Plaza, University Park, Texas. Mr. Robbie Corder took the floor and presented a brief PowerPoint regarding the following item: ZOAC - 13-001: Discuss prohibition of construction activity on certain holidays and make a recommendation to the City Council Mr. Corder explained that the Code of Ordinances currently allows for construction Monday through Saturday from 7AM to 6PM, but there is no verbiage in the ordinance to exclude holidays. Mr. Corder presented a letter from a resident, which requested that language be added to restrict construction on holidays. The letter was previously presented to City Council, and they in turn asked UDADAC and ZOAC to review an amendment to the ordinance. UDADAC has already reviewed the item and recommends changing the ordinance to prohibit construction on holidays. In addition, Mr. Corder stated that the Town of Highland Park has recently passed a similar ordinance which also prohibits construction on all major holidays. Mr. Terry Skartsiaris asked Mr. Corder how many letters or complaints the city generally receives regarding construction on holidays. Mr. Corder stated there are approximately a half dozen complaints received over a year, and some of the complainants prefer to remain anonymous. Page 26 of 67 Mr. Skartsiaris expressed concern that restriction of work on holidays may prevent contractors from completing work by a contracted date. In turn, this may penalize contractors. A discussion ensued regarding the effects that the change may cause to both contractors and residents. Mr. Jim Mills stated that, in his opinion, contractors should not be allowed to work on holidays if they cannot work on Sundays. Mr. Skartsiaris agreed and stated his support of a policy similar to Highland Park. A discussion then ensued regarding construction hours on Saturdays. All were in agreement that construction should start later than 7 AM on Saturday mornings. Mr. Spies asked if anyone was opposed to the restriction of construction on holidays. No one was opposed. Mr. Spies then stated that he was primarily worried about the parking implications on major holidays, when residents are most likely to have family and guests visit. If work is not restricted on holidays, then these parking spots could potentially be taken by contractors. He stated that he did not think this was an issue for other holidays such as Memorial Day. Mr. Mills expressed a concern about remaining consistent in the ordinance. Mr. Crews moved to adopt the same policy as Highland Park, with an ordinance prohibiting construction on all major holidays. Mr. Mills seconded the motion. The motion was approved with a 7-0 vote. Mr. Corder then opened the floor to Mr. Harry Persaud to discuss upcoming P&Z cases. Mr. Persaud briefed the committee on three current cases. With there being no further business before the Committee, Mr. Spies adjourned the meeting at approximately 12:45 PM. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. That Article 8.01 “General Provisions” of the Code of Ordinances, City of University Park, Texas, is amended by amending section 8.01.001 (b) to read as follows: “(b) Loading, unloading and handling of construction material and the use of any tools or equipment used in construction, drilling or demolition work shall be permitted only between the hours of 7:00 a. m. and 6:00 p. m., Monday through Saturday, except by special permission given by the community development director. Except in cases of public emergency or convenience, no such permission shall be given by the community development director for any construction activities on the following holidays: New Year’s Day, Memorial Day, July 4, Labor Day, Thanksgiving Day, Christmas Eve, and Christmas Day, and no such construction activities shall be engaged in on such holidays. A person in control of property and the owner of the property commit an offense if they fail to prevent construction activities on the property in violation of this subsection.” SECTION 2. All provisions of the Code of Ordinances of the City of University Park, Texas, in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. Should any word, sentence, paragraph, subsection, clause, phrase or section of this ordinance or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. Any person, firm or corporation violating any of the provisions of this ordinance or the Code of Ordinances, as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas, shall be punished by a fine not to exceed the sum of five hundred dollars ($500.00) for each offense, and each and every day any such violation shall continue shall be deemed to constitute a separate offense. BACKGROUND: HPISD is amending the detailed site plan for PD-19, to provide for the expansion of the existing cafeteria and kitchen located at the McCulloch Intermediate/Highland Park Middle School Campus. The existing campus buildings comprise a total floor area of 163,701 sq. ft. The proposed amendment to the detailed site plan will increase the gross floor area by 6,516 sq. ft., approximately 4%. The expansion will cover an area to include eleven existing parking spaces; however, those spaces will be recovered by redesigning the existing parking lot as shown on the detailed site plan. The Planning and Zoning Commission considered this request at a public hearing on February 12, 2013 and voted unanimously to recommend approval with the following conditions: a. All permanent improvements in this Planned Development District will be constructed or placed and maintained in accordance with the amended detailed site plan attached hereto as Exhibit "A" and made part hereof for all purposes; b. HPISD will provide adequate security lighting during construction of the additions shown on the detailed site plan approved hereby; c. The construction site will be screened with a temporary 8’ screening fence of dark green or black windscreen fabric installed on a chain link frame or of other materials approved by the Director of Community Development; all trash receptacles will be placed within the screened area; d. Staff presented a power point presentation regarding the scheduled case. No action was taken. The work session was closed, and a 10 minute break was taken prior to the public hearing. Chairman West opened the public hearing at 5:00 PM, and read the case before the commission: PZ 13-001: HPISD requesting approval to amend the detailed site plan for Planned Development District, PD-19, to provide for the expansion of the existing Cafeteria and Kitchen located at 3555 Granada, City of University Park. The McCulloch Intermediate School/Highland Park Middle School is located at 3555 Granada and the site is zoned Planned Development District PD-19 in accordance with the comprehensive zoning ordinance of the City of University Park. Mr. West opened the floor for staff presentation. Mr. Harry Persaud provided a brief overview of the proposed expansion. He explained that the requested changes will add needed square footage to the cafeteria and kitchen area of the school. The expansion will result in a loss of 11 parking spaces, but the lot will be reconfigured to gain these spaces back elsewhere. Mr. Persaud stated that notices were mailed to residents but no responses had been received. He then introduced representatives from SHW group, the contractor for the proposed project. Chairman West opened the floor for discussion. There were no further comments or questions. Mr. Mark Aldredge moved to approve the detailed site plan with one special condition, “issuance of a building permit is subject to building plan review and compliance with all applicable codes”. All permanent improvements in this Planned Development District will be constructed or placed and maintained in accordance with the amended detailed site plan attached hereto as Exhibit “A” attached hereto and made part hereof for all purposes; b. HPISD will provide adequate security lighting during construction of the additions shown on the detailed site plan approved hereby; c. The construction site will be screened with a temporary 8’ screening fence of dark green or black windscreen fabric installed on a chain link frame or of other materials approved by the Director of Community Development; all trash receptacles will be placed within the screened area; d. Construction activities on the site will be conducted Monday through Saturday from 7:00 a. m. to 6:00 p. m., unless special permission is granted by the Director of Public Works; e. Background checks will be conducted by the District’s contractors for all employees on the site prior to their working on the project, and the results of the checks provided to the District, which will retain a file of such checks; no convicted felon or pedophile will be permitted to work on the project site; f. The issuance of a building permit is subject to review and approval of building plans for compliance with applicable city codes and ordinances; and, g. Except as amended hereby, the special conditions of the ordinance creating, and those of any ordinance amending, PD 19 shall remain in full force and effect. SECTION 4. All ordinances of the City of University Park in conflict with the provisions of this ordinance are hereby repealed. SECTION 5.
