As the suspect fled, Ms. Isler chased him and pinned him to the ground. Upon hearing the scuffle, a neighbor called 9-1-1 for assistance and came outside to provide help. The suspect remained under their control when the University Park Police Department arrived. The cost of these enhancements will cost $333,529.96. The bid for the projects has been obtained through the Buy Board, which has been approved determined by our Purchasing Division as an acceptable cooperative purchasing agreement. Landscape timbers are not warranted. The Customer is responsible for locating and clearly marking all underground utilities in the installation area before any installation work can begin. The installer is not responsible for damages, repairs, or discontinuance of business due to damaged utilities. If applicable, sprinkler system locates, re-working and repairs are excluded from installation charges. As a precautionary measure, work in progress areas will be taped off at the end of the workday. Pier spoils from installation shall be spread at site, site will be left rough grade. Trash disposal is the responsibility of the Customer. The installer is not responsible for any damages or re-work resulting from after hours events or activities during the work in progress period. Temporary fencing is only provided by specific request, and additional charges will apply. Collectively and/or individually, not the manufacturer, TRP, their representatives, nor the installation company shall be held liable for any damages resulting from misuse, vandalism, or neglect. Any deviations from approved and accepted placement of all items, along with additional work, over and above quoted items, will be chargeable to the customer. Once work is completed the customer will be notified if present at the job site, and all responsibility of any new work will be transferred to the customer. The customer is responsible for maintaining the integrity of completed installation work until all components have seated and/or cured (concrete footings, etc.). Additional charges may be billed for any extra hours or trips needed as a result of the work site not being ready. Repairs to the Holmes Aquatic Center sprayground were approved as part of that program. Staff has received a proposal from Gallagher Construction Services for the sprayground repairs in the amount of $ 95,500 utilizing the TIP/TAPS cooperative purchasing program. To provide the necessary labor and materials required to repair the spray pad at Curtis Park as outlined below, the total cost will be Ninety Five Thousand Five Hundred Dollars ($95,500). The scope of work included in this proposal is as follows: •Remove equipment from Equipment Room as necessary •Demolish, remove and haul-off Equipment Room concrete floor as necessary to make repairs •Excavate and expose water feature piping •Pressure test all water feature lines •Repair any broken piping identified by pressure test •Backfill around piping with pea gravel •Form, reinforce and pour new concrete floor in Equipment Room with broom finish •Reinstall all pool equipment •Install new variable frequency drive on existing spray pad water feature pump •Replace existing carbon steel filter stand with new stainless steel stand •Reroute Baby Pool piping so that salt and Pulsar 1 run uniformly through system without reducing flow through circulation pumps •Rework Baby Pool circulation pump piping below grade so that pumps are not competing and install new circulation pump •Remove and replace sand in all three Baby Pool filters with Mystic White filter sand •Install new gauges on Baby Pool filters •Construct a ½” bleeder line manifold from the two stacked Baby Pool filters down to the ground and install a ½” valve to bleed off air •Tie potable water fill line directly into the suction side of the Baby Pool fountain pump •Rework Baby Pool fountain piping so that the 90 degree suction fitting directly in front of the fountain pump is moved several inches away from the pump •Install new wiper blades on the Splash Pad U.V. system •Replace Splash Pad lower filter multiport valve with a 2” push/pull backwash valve •Install new U.V. bulbs on the Big Pool U.V. system •Install a CO2 system with automatic switch over tank regulator and heater This proposal excludes design fees, permit/inspection fees, impact fees, sales tax, bonds, hazardous materials removal or remediation, accessibility reviews or modifications, wind sensor and programming of water features, equipment replacement and/or repair except as outlined above, or filter sand removal and replacement except as outlined above. SITE SURVEY AND ANALYSIS: Using the property survey, including complete topographical information and tree locations, provided by you as a base we will visit the site to gather additional information, including: • Shade conditions with respect to growing grass and to shade use areas. • Examination of trees with respect to possible removals. • Areas of erosion. • Areas where regrading or introduction of drainage devices may be desirable. • Views into and from the park. • Pedestrian circulation patterns. • Opportunities to add to or improve picnic tables, benches and walks. • Preservation of viable existing landscape planting. 2 2. CONCEPTUAL MASTER PLAN: Using your survey as the base drawing we will prepare a conceptual master landscape plan for the park, drawn to scale, to include: • Unifying walks for overall circulation and to connect use areas. • Additions or upgrades to picnic tables areas. • Bench additions. • Grading of new improvements. • Measures to reduce or eliminate erosion. • Solutions for areas where shade prevents the establishment of grass. • Addition or removal of trees. • Screen planting along the south side of the tennis court. • Planting revisions at sign wall locations. • Any additional planting that would be desirable. These conceptual drawings will be presented to you for review and explanation. After review any revisions will be made. 3. FINAL WORKING DRAWINGS: Upon your approval of conceptual drawings we will prepare final working drawings, to include: • Layout and grading plans for additional paving and walks and for drainage improvements, general construction notes included. • Design intent details where necessary. • Planting plan illustrating new planting by plant name, recommended sizes, spacing and quantity. Included will be planting bed preparation recommendations. 4. COMPENSATION: Design services will be invoiced to you at our standard hourly rates. Time is accumulated to the nearest ¼ hour. It shall be our intent to provide compliance with ADA Requirements regarding paving additions and site furnishings. However, review as required by the State of Texas will be at the expense of the City of University Park. This review shall indemnify the landscape architect of any such compliance issues. It will be the responsibility of the landscape architect to provide alternate solutions at no additional costs to the City of University Park for any non-compliance discovered by the review process. 7. CONTRACT ADMINISTRATION AND OBSERVATION (NOT PART OF THIS AGREEMENT): Upon completion of the Final Working Documents, our services for administration and coordination of construction contracts are available under a separate fee. This will be covered with you in detail upon completion of the plans, and is briefly outlined below. A. Goodson is $28,000. Funding for this project has been identified and approved within the Public Works Department Storm Water Drainage budget by the Capital Projects Review Committee in August 2013. On or about July 15, 2013, Atmos Mid-Tex filed with the City an application to increase natural gas rates pursuant to the Rate Review Mechanism (“RRM”) tariff renewed by the City in 2013 as a continuation and refinement of the previous RRM rate review process. This is the first annual RRM filing under the renewed RRM tariff. The Atmos Mid-Tex RRM filing sought a $22.7 million rate increase system-wide based on an alleged test-year cost of service revenue deficiency of $25.7 million. The City worked with ACSC to analyze the schedules and evidence offered by Atmos Mid-Tex to support its request to increase rates. The Ordinance and attached rate tariffs are the result of negotiations between ACSC and the Company to resolve issues raised by ACSC during the review and evaluation of Atmos Mid-Tex’s RRM filing. The Ordinance resolves the Company’s RRM filing by authorizing additional revenues to the Company of $16.6 million system-wide. For purposes of comparison, this negotiated result is about $11 million less than what ACSC’s consultants calculated that Atmos would have been entitled to if Atmos had filed a case under the Gas Reliability Infrastructure Program (“GRIP”) rather than an RRM case. The settlement is expected to increase the average residential customer’s bill by approximately $0.74 per month. An Average Bill Comparison of base rates has been prepared for residential, commercial, industrial, and transportation customers. The ACSC Executive Committee and ACSC legal counsel recommend that all ACSC Cities adopt the Ordinance implementing the rate change. RRM Background: The RRM tariff was originally approved by ACSC Cities as part of the settlement agreement to resolve the Atmos Mid-Tex 2007 system-wide rate filing at the Railroad Commission. In early 2013, the City adopted a renewed RRM tariff for an additional five years. Atmos Mid-Tex’s July 2013 filing was made pursuant to the renewed RRM tariff. The RRM tariff and the process implementing that tariff were created collaboratively by ACSC and Atmos Mid-Tex as an alternative to the legislatively-authorized GRIP surcharge process. ACSC has opposed GRIP because it constitutes piecemeal ratemaking, does not allow any review of the reasonableness of Atmos’ expenditures, and does not allow participation by cities or recovery of cities’ rate case expenses. In contrast, the RRM process has allowed for a more comprehensive rate review and annual adjustment as a substitute for GRIP filings. ACSC’s consultants have calculated that had Atmos filed under the GRIP provisions, it would have received additional revenues from ratepayers in excess of $28 million. Purpose of the Ordinance: Rates cannot change without the adoption of rate ordinances by cities. No related matter is pending at the Railroad Commission. The purpose of the Ordinance is to approve rates 4166249.1 2 (shown on “Attachment A” to the Ordinance) that reflect the negotiated rate changes pursuant to the RRM process and to ratify the recommendation of the ACSC Executive Committee. Please make sure that the tariffs are attached when the Ordinance is passed by the City Council. As a result of the negotiations, ACSC was able to reduce the Company’s requested $22.7 million RRM increase to $16.6 million. Approval of the Ordinance will result in the implementation of new rates that increase Atmos Mid-Tex’s revenues effective November 1, 2013. Reasons Justifying Approval of the Negotiated Resolution: Consultants working on behalf of ACSC Cities have investigated the support for the Company’s requested rate increase. While the evidence does not support the $22.7 million increase requested by the Company, ACSC’s consultants agree that the Company can justify an increase in revenues of some lesser amount. The agreement on $16.6 million is a compromise between the positions of the parties. The alternative to a resolution of the RRM filing would be a GRIP filing by the Company, based upon the Railroad Commission’s decision in the 2012 rate case. A GRIP filing would entitle the Company to receive more than $28 million in additional revenues, with ACSC being precluded from reviewing the reasonableness of the GRIP filing. The ACSC Executive Committee recommends that ACSC members take action to approve the Ordinance authorizing new rate tariffs. No Changes to Residential Customer Charges: For the first annual filing under the revised RRM tariff, the Company agreed to forgo any change to the residential customer charge. Therefore, for the 2013 RRM, the result of the filing will not increase the residential customer charge, and the entirety of the increase to the residential class will be applied to the commodity (natural gas consumption) component of rates. Explanation of “Be It Ordained” Paragraphs: 1. This paragraph approves all findings in the Ordinance. 2. This section adopts the attached tariffs (“Attachment A”) in all respects and finds the rates set pursuant to the attached tariffs to be just, reasonable and in the public interest. Note that only new tariffs or existing tariffs being revised are attached to the Ordinance. Existing tariffs not being changed in any way are not attached to the Ordinance. 3. This section requires the Company to reimburse ACSC for reasonable ratemaking costs associated with reviewing and processing the RRM application. 4. This section finds that the meeting was conducted in compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551. 6. He reviewed a set of proposed staff conditions for inclusion in an ordinance which would amend the PD-25 site plan to allow lighting at the softball field and tennis courts on Druid. Mr. Persaud said the staff conditions were written to incorporate requests from HPISD and the area residents. Mr. Persaud said the area residents requested that the photometric layout be included as an attachment to the ordinance for compliance. He also said to include the phrase "any other amplified sound system" when discussing sound levels or time of use. The Council suggested several changes to the proposed conditions including the prohibition of PA or amplified sound system use by any and all adult club or league use. They suggested that over 50% of the members of the team renting the field be verified HPISD residents. Councilmember Moore stated that HPISD be allowed 30 minutes after each game to shut down the lights. Mr. Persaud said staff will work with the City Attorney to draft an ordinance incorporating the Council's recommendations and submit for their review at the next Council Meeting. He said the Council will be able to tweak the submitted ordinance at that time and adopt if they wish. Mr. Jerry Sutterfield of HPISD explained non-UIL v. UIL use of the facilities . He said non-UIL use during the school year will be mostly youth groups from grades 3 - 8. He said most UIL use will be from high school teams . Mr. Sutterfield said during the summer all of the use will be non-UIL so high school-age groups will use the facilities under the non-UIL rules. Councilmember Moore requested City Attorney Dillard include a definition of non-UIL and adult use in the ordinance caption . Mayor Davis asked that two versions of an ordinance be submitted, one excluding use of amplified music during games and one allowing its use. He said SMU plans to request a rezoning of the site which requires ownership of the entire plat. He asked the Council to authorize staff to obtain appraisals of the proposed abandonments. The neighborhood also submitted a list of PD conditions dated September 17, 2013. City Council discussed the draft PD conditions at its regular meeting on October 1, 2013 and provided directions to staff. The ordinance attached is forwarded for Council consideration and action. RECOMMENDATION: Planning and Zoning Commission considered this item at its July 9, 2013 meeting and voted unanimously to recommend approval subject to special conditions. WHEREAS, the Planning and Zoning Commission and the City Council of the City of University Park have given the requisite notices and conducted the public hearings required by law, and the City Council is of the opinion and finds that the Detailed Site Plan for PD-25 should be amended as requested; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. That an amended Detailed Site Plan, in the form required by Section 17-101 (2) of the Comprehensive Zoning Ordinance of the City of University Park, Texas, to provide athletic lighting (“athletic lighting”) for a portion of Planned Development District No. 25 for the Highland Park High School (“HPISD”) for the property described as Lot 1R, Block 4, Preston Heights Addition, an addition to the City of University Park, Dallas County, Texas (the “site”), attached hereto as Exhibit "A" and made a part hereof for all purposes, the same as if fully copied herein, is hereby approved in all respects. SECTION 2. That the approval of the amended Detailed Site Plan is subject to the following special conditions: A. Development of the site shall be in accordance with the approved amended Detailed Site Plan (Exhibit “A”), all conditions of the ordinance approving PD-25 and all conditions of previous ordinances amending PD-25 or the approved detailed site plan, except as amended hereby, and all other provisions of the Comprehensive Zoning Ordinance of the City of University Park that are applicable; B. Athletic lighting for the tennis courts and softball field on the site shall be constructed and placed in accordance with the photometric layout and with the specifications of lighting fixtures, equipment, poles and necessary appurtenances, attached collectively hereto as Exhibit “B” and incorporated herein by reference. The athletic lighting shall be maintained by HPISD at all times so as to limit light levels to those shown on the photometric layout; C. During UIL use, the public address system and any other amplified sound system on the site will be locked at an appropriate sound level, not to exceed 60 decibels at the property line of the site, and the system shall not be used before 9:00 a. m. on any day; D. During non-UIL use of the softball field, no inning shall start after 9:00 p. m. on any day and use of the public address or any other amplified sound system shall not be permitted; E. All athletic lights for the batting cage shall be turned off not later than 9:00 p.m.; F. For private, club or adult leagues using the facilities for practice or games, use of athletic lighting or an amplified sound system will not be permitted, provided however, non-UIL games played by HPISD youths (18 years and younger) may use the athletic lights; G. For tennis court use, the public address system or any other amplified sound system, including a portable music system, shall not be permitted before 9:00 a. m. or after 6:00 p. m. on any day and all athletic lights shall be turned off by 9:00 p.m. H. For non-UIL use of the facilities, a majority of the host team members must be residents of, and have permission from, HPISD; I. For a UIL sponsored event, athletic lighting for the softball field and/or tennis courts shall be turned off within 30 minutes after completion of the event; and, J. Use of the public address system for tennis or softball shall be prohibited on Sundays. SECTION 3. All ordinances of the City of University Park in conflict with the provisions of this ordinance are hereby repealed. SECTION 4. Should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part decided to be invalid, illegal or unconstitutional. SECTION 5. Any person, firm or corporation violating any of the provisions of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas, shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each and every day any such violation shall continue shall be deemed to constitute a separate offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide. This event has grown over the past three years and now utilizes seven (7) flatbed trailers to carry children and their families to tour holiday light displays in the City. The requested dates and times for the event are as follows: DATES & TIMES: Tuesday, December 10th Event begins at 5:30 p.m. Hayride is from 7 to 8 pm Wednesday, December 11th Event begins at 5 p.m. Hayride is from 6:45 to 7:45 pm Thursday, December 12th Event begins at 5:00 p.m. Hayride is from 6:45 to 7:45 pm RECOMMENDATION: Staff recommends approval of the Holiday Hayride event with the following stipulations: • There must be two adult chaperones on each trailer throughout the hayride • There must be a follow-up vehicle behind the last trailer; to ensure non-participating vehicles do not cause a safety issue October 9, 2013 Chief Spradlin University Park Police Department 3800 University Boulevard Dallas, TX 75205 Re: UPPA/ABPA/HPA Holiday Hayrides The preschool associations of University Park Elementary School (UPPA), Armstrong and Bradfield Elementary Schools (ABPA) and Hyer Elementary School (HPA) are requesting permission to hold Holiday Hayrides as community fundraising events for our respective schools. This event has taken place for the past 3 years and is something our members and families look forward to immensely. The individual events raise approximately $5,000 for each school. The hayrides take place on consecutive nights for each elementary school December 10th, 11th & 12th. The UPPA and ABPA activities at Goar Park begin approximately at 5 pm and the hayride is from 6:45 pm to 7:45 pm. The HPA event at Smith Park is from 5:30 pm to 7 pm and the hayride is from 7 pm to 8 pm. Southern Botanical generously donates the use of, and professional drivers for 7 flatbed trailers. The flatbeds provide a safe and easy way for approximately 40 UP families (120 to 140 people), from each individual preschool association, to see the holiday lights in University Park each of the three respective evenings. Families sign a release to ensure safety is of utmost concern. We have revised the route map and are resubmitting it to ensure it meets your approval. The revised route does not include any streets within the town of Highland Park. There are two organizers from each of the three preschool associations who serve as volunteers at the event. In addition, each flatbed truck has two volunteers assigned. However it is the responsibility of the parents to provide supervision of their children prior to and during the hayride. Prior to the hayride, families spend approximately one hour at Goar Park enjoying dinner, cookies and hot chocolate provided by a food truck. In addition, a Santa entertains the children while at the park. In conclusion, the preschool associations from University Park, Bradfield, Armstrong and Hyer Elementaries request approval to host this annual event in order to continue a tradition our UP families look forward to each year and from which our schools greatly benefit. Only two companies submitted proposals for the City’s self-insured health plan: Cigna, the City’s current administrator, and Blue Cross Blue Shield of Texas. Both companies also submitted proposals for the Dental PPO and DHMO plans, Life/AD&D insurance, Long Term Disability insurance, and Employee Assistance Program (EAP). Although other companies submitted proposals for these other coverages, the overall pricing was better with Cigna and BC/BS because they were able to “bundle” all of the coverages together as a package. The cost to bundle all of the employee benefits with Cigna while leaving our EAP with the current vendor, Lifesynch, is $238,578 which is $5,842 less than the City paid for the same benefits in 2013. The same program with BCBS would be $265,884, $21,464 higher than the City paid in 2013. The Employee Benefits Committee met October 1, 2013 to review the information presented by Holmes Murphy. The committee voted unanimously to recommend approval for placing health plan administration, dental insurance, Life/AD&D insurance, and Long Term Disability insurance with Cigna for 2014 and renewing the Employee Assistance Program with Lifesynch. The only increase in health care costs other than expected claims is the Individual Stop Loss Fees which will increase 12.1% ($46,785) for a total of $433,834 annually. There is no proposed increase for Aggregate Stop Loss fees so those fees will remain at $17,473 annually. The Employee Benefits Committee also voted unanimously to renew Individual Stop Loss and Aggregate Stop Loss with Cigna. RECOMMENDED ACTION: Staff recommends approval to place the City’s Employee Benefits Plan and Stop Loss Fees with CIGNA and the EAP with Lifesynch for a total annual cost of $689.885. MINUTES Employee Benefits Committee October 1, 2013 A meeting of the Employee Benefits Committee was held on October 1, 2013. Members attending the meeting were Clair Crossland, John Falconer, Angela Fontana, Steve Moore, Blair Mercer, Russell Huber, Stephen Black, and Lance Johnson. Chairman Roger Lambourn had a family emergency and was unable to attend. Also attending the meeting were Councilmember Bob Begert, City Manager Bob Livingston, Human Resources Director Luanne Hanford, and Morgan Young, Benefits Consultant with Holmes Murphy. Ms. Hanford called the meeting to order at 7:35 am. She introduced Morgan Young who is with the City’s broker and benefits consulting firm, Holmes Murphy. Ms. Young told the committee that an RFP had been issued for all of the City’s employee benefits. She then went through a powerpoint presentation detailing the results of the bidding process. After reviewing all of the proposals, Ms. Young recommended that the City stay with Cigna for administration of the health plan, Life/AD&D, LTD and move the dental insurance from Assurant to Cigna. She recommended leaving the EAP with Lifesynch, the current provider. The overall cost of the benefit plan with Cigna and Lifesynch will be reduced from $244,420 in 2013 to $238,578 in 2014, a reduction of almost $6,000. Since dental insurance is voluntary and completely paid by employees, the $38,861 for dental insurance will not be paid by the City. The same bundled program with BC/BS would be $265,884. The committee discussed the information presented by Ms. Young and she answered questions. Blair Mercer moved that the committee recommend to the City Council contracting with Cigna to provide administrative services for the PPO and HDHP, dental insurance, Life/AD&D and Long Term Disability and renewing the contract with Lifesynch for EAP Services. Russell Huber seconded the motion. The vote in favor was unanimous. Ms. Young then went over the Cigna Stop Loss renewal. For 2014, Cigna has proposed a 12.1% increase in Individual Stop Loss (ISL) insurance for an increase of $46,785. Cigna did not propose an increase in Aggregate Stop Loss (ASL), so the total increase to stop loss fees will be $46,785. Ms. Young told the committee that the increase was consistent with medical cost trend. The committee discussed the renewal and Ms. Young responded to questions. After discussion, Clair Crossland moved that the committee recommend to the City Council Individual Stop Loss Fees of $433,834 annually and Aggregate Stop Loss Fees of $17,473 annually. The motion was seconded by Blair Mercer. The vote in favor was unanimous. Following the vote, Councilmember Bob Begert thanked the committee members for the service and told them that the City Council relied on their expertise in matters of employee benefits. There being no further business, the meeting was adjourned at 8:10 am.
