BACKGROUND:
Staff has received a reservation request from the University Park United
Methodist Church to reserve Smith Park for their annual school carnival on
Saturday, March 28, 2015 from 11: 00 a.m. until2:00 p.m. It is anticipated that
there will be 300 attendees at the event.
The UPUMC has conducted this event for the past several years without any
issues.
RECOMMENDATION:
Staff will take direction from City Council on how to proceed with the reservation
request.

SUBJECT:Amendment to the Residential Parking District
BACKGROUND:
On January 6, 2015, City Council approved a request to include a portion of the 2900
block of Daniel in the Residential Parking District. Upon installation of requisite signage
on the block, staff received a request from the property owner of2925 Daniel requesting
to be removed from the district. To that end, the City Attorney developed an ordinance
amending the existing RPD.
RECOMMENDATION:
Staff recommends City Council approval of the ordinance amending the designationof
the 2900 block of Danielto include 2916 Daniel west to Dublin along the north curb line
and west from 2933 Daniel to Dublin along the south curb line, as Residential Parking
Only.

PARK, CHAPTER12, TRAFFIC CONTROL, BY AMENDING SECTION 12.05.042
(a)(12) TO PROVIDE RESIDENT-PARKINGONLY FOR A PORTION OF THE

PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF

SECTION 1.That Chapter 12,Article 12.05 “Parking”, Section 12.05.042(a),of
the Codeof Ordinances, City of University Park, Texas, ishereby amendedin partas
follows:
"Sec. 12.05.042Zones Designated; issuance of permits
(a)The following are designated as resident-parking-only zones, to wit:

(12) Thatportion of the north side of the 2900block of Daniel Avenue from 2916
Daniel Avenue west to Dublin, and on the south side of the 2900 block of Daniel
Avenue from 2933Daniel Avenue west to Dublin, and the 3000 and 3100 blocks
of Daniel Avenue;

SECTION 2. That all provisions of the Code of Ordinances of the City of
University Park, Texas, in conflict with the provisions of this ordinance are hereby repealed.
SECTION 3. That should any word, sentence, paragraph, subdivision, clause,
phrase or section of this ordinance or of the Code of Ordinances, as amended hereby, be
adjudged or held to be void or unconstitutional, the same shall not affect the validity of the
remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which
shall remain in full force and effect.
SECTION 4.Any person, firm or corporation violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal
court of the City of University Park, Texas, shall be punished by a fine not to exceed the sum
of twohundred dollars ($200.00) for each offense.
SECTION 5.That this ordinance shall take effect immediately from and after the
publication of the caption, as the law and Charter in such cases provide, subject to the
erection of appropriate signs giving notice of the resident-parking-onlyzoneprovided for
herein.

SUBJECT:Resolution Accepting Water Conservation Funding from the DCPCMUD
BACKGROUND:
On January 13, 2015 the Board of Directors for the Dallas County Park Cities Municipal
Utility District (DCPCMUD) authorized disbursement of $648,000 to the City of University
Parktoprovide funding toward the City's water conservationefforts. They requested
that the City affirm by resolution and/or agreement specifically what the funds would be
used for. The City Attorney developed the attached resolution, which identifies the
District's financial support will be earmarked directly for the Advanced Metering
Infrastructure(AMI). The AMI projectincludes purchase and installation of smart water
meters that will provide more detailed data on the City's use of water.
RECOMMENDATION:
Staff recommends City Council approval of the resolution accepting funding from the
DCPCMUD in the amount of $648,000.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK,
TEXAS, AUTHORIZING PARTICIPATION IN A WATER CONSERVATION
FINANCIAL PARTNERSHIP WITH THE DALLAS COUNTY PARK CITIES
MUNICIPAL UTILITY DISTRICT; AND PROVIDING AN EFFECTIVE DATE
WHEREAS,the Dallas County Park Cities Municipal Utility District (“District”) is
required to develop, adopt and submit a Water Conservation Plan to the Texas Commission
on Environmental Quality (TCEQ) every 5 years in accordance with 30 TAC §288.30;
WHEREAS,theBoard of Directors approved the newestWaterConservation Plan atits
April8,2014,meetingandthisplan was submittedto TCEQ;
WHEREAS,thepurposeofthisplan istoimplement programsthatprovideforand
encouragethe reduction of water use by its customers;
WHEREAS,the District is a wholesale provider of drinking water to the City of
University Park (“City”),which controls the distribution and sale of water to its
citizens;
WHEREAS,the City must also develop and adopt Water Conservation Plans;
WHEREAS,District feels that it can obtain the greatest reduction in water usage through
programs geared towards the citizens of the City;
WHEREAS,theDistrictproposesto providefunding,from surplusrevenues,to the City to
assistit in carryingoutits waterconservationprogramprojects;
WHEREAS ,the City has identified and begun the purchase and installation of Advanced
Metering Infrastructure as the project that will give it the greatest impact on reducing water
usage inthe City;and,
WHEREAS,the City is in position to utilize funds that the District proposes for such
projects;
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF UNIVERSITY PARK, TEXAS:
SECTION1. TheCity Council hereby acknowledges and accepts the disbursement of
funds from the District to the City of University Park,Texas,intheamountof $648,000 for
implementation ofthe City’sAdvancedMetering Infrastructure (“SmartMeters”)program
withinitsdistributionsystem. It is the legislative finding of the City Council that the Smart
Meters program will contribute to the reduction in water usage by citizens of the City, a clear
purpose of a water conservation plan.
SECTION 2.This resolution shall take effect immediately upon its passage.

Robbie Corder introduced Assistant to the City Manager George Ertle and
thanked him for his 5 1/2 years of service to the City. He said that George
would be leaving for a job with the City of Clayton, Missouri, and that this
was his last University Park City Council meeting. Mayor Lane and
Councilmember Stewart echoed the appreciation for George's service and
wished him well.

14-265 Consider a request from the Park Cities Historic and Preservation
Society to reserve Goar Park for a Classic and Antique Car Show
A motion was made by Councilmember Taylor Armstrong, seconded by
Councilmember Dawn Moore, to refer this request to the Parks Advisory
Committee. The motion carried by the following vote:

14-263 Consider and act on a Feasibility Study prepared by Ballard King and
Associates, Ltd., to Assess the Viability of Developing Shared Indoor
Pool/Aquatic Facility.
City Manager Corder said that this item is on the agenda at the request of
the City Council to consider and act on the feasibility study prepared by
Ballard King and Associates to assess the viability of developing a shared
natatorium.
Mayor Lane thanked those in attendance for their e-mails. He
recommended that Curtis Park be removed from consideration as a possible
site for a natatorium. Councilmember Moore said that the high school is an
important asset to the community. And, she wants to see how the the City of
University Park and the Highland Park ISD could work together to build a
joint-use natatorium. However, she is leaning towards locating the
natatorium on school property rather than City property as she is not yet sure
about the community demand for a joint-use natatorium. Councilmember
Armstrong echoed Councilmember Moore's remarks. He noted that the
City's land is already built to capacity yet there is ever more demand for
public facilities. He does not feel that the Council has enough information
about the demand for a natatorium at this time. He would like to hear what
the school district has to say about its needs, but does not believe that Curtis
Park is the right place for a natatorium. Councilmember Begert said that he
believes the City should do everything it can to help the school district. He
shared the others' concerns about the feasibility study, especially regarding
the costs and projected resident usage. He said he would encourage the
school district to look at campus options for a natatorium. Councilmember
Stewart said that he agrees with the other council members that Curtis Park
should not be considered as a site for a natatorium. He needs more
answers following the feasibility study and he would like to see some other
consideration by the school district. Mayor Lane summarized that Curtis
Park will no longer be considered as a site for a potential natatorium and that
he awaits a decision from the HPISD Facilities Committee before the Council
proceeds with further consideration. He believes that the City should be of
assistance to the school district as it is a key part of the community and its
way of life.

PUBLIC COMMENTSV.
Pat Black, 4437 Windsor Parkway, made remarks to the City Council. She
suggested that the City Council find a meeting place for seniors.
Don Malouf, 3445 Westminster, thanked the Council for its decision to
remove Curtis Park from consideration as a potential site for a joint-use
natatorium.

BACKGROUND:
Staff has received a reservation request from the HPISD requesting the use of
Germany Park to host a track camp during June 15, 16 and 17 from 6:00 p.m. till
8:00 p.m. Since this type of request is not identified within the current Facilities
Utilization Agreement between the City and the HPISD, staff is seekingdirection
from City Council on how to proceed.
Representatives from HPISDwillbe present at the City Council meeting to
answer questions.
RECOMMENDATION:
Staff will take direction from City Council on how to proceed with the reservation
request.

The Highland Park High School Men and Women’s Track/Field Coaching
Staffs would like to conduct a track/field camp this summer at Germany
Park for the 2015-16 fourth through eighth graders. If possible, we would
like to reserve the park on June 15th, 16th, and 17th from 6:00 pm –8:00 pm.
On the 17th, we would like to extend the infield reservation to 9:00 pm due
to the awards ceremony.

SUBJECT:Public hearing on an ordinance amending the detailed site plan for
Planned Development District, PD-32, to add agreenhouse to the site located at 6601
Turtle Creek Boulevard.
BACKGROUND:
The property owner is requesting approval to amend the detailed site plan for Planned
Development District, PD-32, located at 6601 Turtle Creek Boulevard in order to install a
greenhouseon the subject site. The proposed greenhouse measures approx. 46 feet by
30 feet and will be located south of the existing home with a setback of approx. 55 feet
from the existing fence along Turtle Creek Boulevard, as shown on the amended
detailed site plan. Vertical walls on the sides of the greenhouse are about 6 feet 8
inches and the height to top of ridge is approx. 15 feet 8 inches. Details for utility
connections to the greenhouse will be reviewed and approved by staff before the issue
of a building permit.
A draft ordinance including the amended detailed site plan and construction details of
the proposed greenhouse is attached.
Notices were mailed to property owners within 200 feet of the subject site and public
notices were posted in the Park Cities News in compliance with state law and city codes.
Two property owners responded in favor of the proposed amendment.
RECOMMENDATION:
Planning and Zoning Commission considered this item on December 9, 2014 and
voted unanimously to recommend approval.

WHEREAS, the Planning and Zoning Commission of the City of University Park and the
City Council of the City of University Park, in compliance with the laws of the State of Texas with
reference to the granting of zoning classifications and changes, have given the requisite notices by
publication and otherwise, and have held due hearings and afforded a full and fair hearing to all
property owners generally and to all persons interested and situated in the affected area and in the
vicinity thereof, and the City Council of the City of University Park is of the opinion and finds that
said zoning change should be granted and that the Comprehensive Zoning Ordinance and Map
should be amended; NOW,THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1.Planned Development District No.32, granted by Ordinance No. 06/16for
the property described as Lot 7,Block 7, University Park EstatesAddition to the City of University
Park, Dallas County, Texas, being a6.236 acre tract commonly known as 6601 Turtle Creek
Boulevard, as heretofore amended,is hereby further amended in part by approving an amended
detailed site plan, subject to additional special conditions.
SECTION 2.The amended detailed site plan for PD No. 32, consisting of several pages
attached hereto collectively as Exhibit “A”, ishereby approved as the detailed site plan for said
Planned Development District 32, as required by Section 17-101 (2)of the Comprehensive Zoning

Ordinance of the City of University Park, Texas. That the Planning and Zoning Commission has
reviewedthe amended detailed site plan.
SECTION 3.The amendmentof Planned Development District No. 32 is subject to the
following additional special conditions:
a.Improvements in this Planned Development District will be constructed in accordance
with the amended detailed site plan attached heretoas Exhibit “A”, including the
architectural elevations, site plan, height elevations and other included therein;and,
b.A detailed landscape plan for the property has previously been approved and is
incorporated by reference herein; and,
c.The amended detailed site plan approved hereby includes:
i.a greenhouse of approximately 1,500 square feet in area, including a water closet
and all utility connections;
ii.the greenhouse willbe located in the required front yard of the property, set back
approximately 55 feet from the existing fence along Turtle Creek Boulevard;
iii.the greenhouse will have vertical walls on the sides approximately 6 feet 8 inches
in height; and
iv.the greenhouse will have a maximum height to the top of the ridge of15 feet 8
inches.
d.Except as amended hereby, the special conditions of Ordinance No. 06/16, as
heretofore amended,shall remain in full force and effect.
SECTION 4.All ordinances of the City of University Park in conflict with the provisions
of this ordinance are hereby repealed.
SECTION 5.Should any sentence, paragraph, subdivision, clause, phrase or section of this
ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the
validity of this ordinance as a whole or any part or provision thereof, other than the part so declared
to be invalid, illegal or unconstitutional, and shall not affect the validity of the Comprehensive
Zoning Ordinance and Map as a whole.

SECTION 6.Any person, firm or corporation violating any of the provisions of this
ordinance or the Comprehensive Zoning Ordinance, as amended hereby, shall be deemed guilty of a
misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas,
shall be punished by a fine not to exceed the sum of two thousand dollars($2,000.00) for each
offense, and each and every day any such violation shall continue shall be deemed to constitute a
separate offense.
SECTION 7.This ordinance shall take effect immediately from and after its passage and
the publication of the caption, as the law and Charter in such cases provide.

Mr. Harry Persaud briefed the Commission on the case, presenting a
PowerPoint presentation with photos of the subject property. A discussion
ensued regarding landscaping on the property and visibility of the greenhouse
from the street. Mr. Persaud stated that current landscaping should prevent any
view of the greenhouse from outside of the property, and therefore city staff
recommends approval of the addition of the greenhouse to the site.
Chairman West then briefed the new Commissioners on the standard flow of
Planning and Zoning Commission meetings. No action was taken. The work
session was then closed prior to the public hearing.

The public hearing was opened at 5:00 PM. Mr. Persaud approached the
podium and addressed the Commission. He reiterated that City Staff
recommends approval of the PD Amendment to add a greenhouse to the
site. He explained that the PD Amendment would move on to City Council,
and the greenhouse would then need to be permitted. He added that certain
aspects of the greenhouse such as potential water and gas connections
would be addressed at the time of permitting. He then introduced those
present in favor of the PD Amendment including Stuart Markussen of RL
Goodson, John Sebastian, the contractor for the project, and Gerald Ford,
the property owner.
Commissioner Aldredge asked what color the greenhouse would be. Mr.
Sebastian replied that it will be a very dark copper or black color.
A discussion then ensued regarding Single Family zoning as it applies to the
PD. Mr. Persaud clarified that the greenhouse is considered an accessory
structure per the Single Family zoning.
Chairman West asked for any other speakers to come forward. With no one
present to speak further in favor or opposed to the PD Amendment, the
public hearing was then closed.
Following the vote, Mr. Ford thanked the Commissioners for their
recommendation of approval and stated the greenhouse is a Christmas gift
for his wife.
A motion was made by Commissioner Aldredge, seconded by Commissioner
Farley, that this PD Amendment be recommended for approval. The motion
carried by a unanimous vote.
