A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK,
TEXAS, DELEGATING AUTHORITY TO THE CITY MANAGER OR HIS
DESIGNEE TO SELECT COMPETITIVE SEALED PROPOSALS FOR THE
PURCHASE OF GOODS OR SERVICES, INCLUDING HIGH TECHNOLOGY
ITEMS AND INSURANCE, BY DETERMINING WHICH PROVIDES THE BEST
VALUE FOR THE CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 252.02l(b) of the Texas Local Government Code authorizes the City to
use competitive sealed proposals for the purchase of goods or services, including high
technology items and insurance; and,
WHEREAS, to use such method, the City must determine the method of purchase that
provides the best value for the City; and,
WHEREAS, the City Council is authorized to delegate its authority to make such
determination to a designated representative;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF UNIVERSITY PARK, TEXAS:
Section 1. That the City Council hereby finds and determines that it may be
appropriate on occasion for the City to use the competitive sealed proposal procedure for the
purchase of goods or services, including high technology items and insurance, as authorized
by Section 252.02l(b) ofthe Texas Local Government Code.
Section 2. The City Council finds and determines that it is appropriate to delegate its
authority to the City Manager, or his designee, to consider using a method other than
competitive sealed bids and to determine before notice is given, the method of purchase that
provides the best value for the City.
Section 3. The City Manager or his designee, if the competitive sealed proposals
requirement applies to the contract, shall consider, in determining the best value for the City,
the following items:

(1) The purchase price;
(2) The reputation of the bidder and of the bidder's goods or services;
(3) The quality of the bidder's goods or services;
(4) The extent to which the goods or services meets the City's needs;
(5) The bidder's past relationship with the City;
(6) The impact on the ability of the City to comply with laws and rules relating to
contracting with historically underutilized businesses and non-profit corporations
employing persons with disabilities;
(7) Total long term cost to the City to acquire the bidder's goods or services; and
(8) Any relevant criteria specifically listed in the request for bids or proposals.
Section 4. The City Manager or his designee shall follow the procedures set out in
Section 252.042 of the Texas Local Government Code in requesting proposals under the
terms of this Resolution. In awarding the contract, the City Manager or his designee shall
make a recommendation to the City Council that the contract be awarded to the responsible
offeror whose proposal is determined to be the most advantageous to the City considering the
relative importance of price and the other evaluation factors included in the request for
proposal.
Section 5. This Resolution shall take effect immediately from and after its
passage, and it is accordingly so resolved.
