Smallwood, P.E.; Director Public Works SUBJECT:Drainage -MaintenanceAgreement BACKGROUND: The City Council,through prior action,agreed to operate the privately-owned collapsible dam across Turtle Creek, south of McFarlin Blvd. Additionally, that agreement provided that the City would be responsible for silt removal from the creek channelnorth of the dam to McFarlin Blvd. The attached agreement grantsaccess for thatpurpose from one of thetwo adjacentproperty ownersTrevor Reese-Jonesgenerally along the eastside of the creek.Council approved the agreement for the Locke property along the west side of the creek at their March 17th meeting. RECOMMENDATION: Staff recommends City Council approval of the drainageagreementfor the Trevor Reese-Jonesproperty. DRAINAGE AND MAINTENANCE EASEMENT Date: ____________________ Grantor: TREVOR DAVID REES-JONES, TRUSTEE OF THE JAN AND TREVOR REES- JONES REVOCABLE TRUST, CREATED PURSUANT TO TRUST AGREEMENT DATED AUGUST 27, 2008 Grantor’s Mailing Address: 3801 McFarlin Blvd., University Park, Dallas County, Texas 75205 Grantee: City of University Park, Texas Grantee’s Mailing Address (including county): 3800 University Blvd., University Park, Dallas County, Texas 75205 Property (including any improvements): A tract of land in the City of University Park, Dallas County, Texas, more particularly described in Attachment “A” attached hereto and made part hereof for all purposes. Consideration: Grantor, for and in consideration of TEN AND NO/100 DOLLARS ($10.00) and other good and valuable consideration in hand paid by the Grantee, the receipt and sufficiency of which are hereby acknowledged, has dedicated, granted, sold and conveyed, and by these presents does dedicate, grant, sell and convey unto the said Grantee a non-exclusive drainage and maintenance easement over, along, across and under the Property, including the right of ingress, egress, and regress therein, to collect and direct ground water and storm water over the Property from upstream of the Property and to remove silt from the Property. Notwithstanding anything contained herein to the contrary, (a) use of the Property pursuant to this easement agreement shall be exclusively within the creek bed of Turtle Creek located on Lots 5 and 8, Windsor Park Addition (for the avoidance of doubt, the City shall not be permitted to access or place any equipment on any portion of the property now owned or hereafter acquired by Grantor that is outside of such creek bed (the “Grantor’s Premises”)), (b) Grantee shall provide Grantor with written notice at least ninety (90) days prior to Grantee’s entry onto the Property for a purpose contemplated by this easement, and such notice shall include the scope of work to be accomplished during such entry, (c) any such silt removal or other necessary maintenance shall be performed in a timely manner within the time allowed by the Grantee’s contract for the same (and in any event as quickly as reasonably practicable) and in such a way so as not to interfere with Grantor’s use and enjoyment of Grantor’s Premises, (d) Grantee shall bear the cost of any such maintenance and silt removal operations, and (e) no silt removed from the Property or any portion of the creek bed shall be placed on any portion of Grantor’s Premises. Drainage and Maintenance Easement – Page 1 Indemnification: With respect to work to be performed hereunder, Grantee agrees to indemnify, defend and hold harmless Grantor and his employees, agents, servants and invitees (the “Grantor Parties”) from any and all loss, damage, liability, cost or expenses, including, but not limited to, reasonable attorneys’ fees, court costs and other sums which the Grantor Parties may pay or become obligated to pay on account of (a) any, all and every demand or claim, or assertion of liability, or any claim or action founded thereon arising or alleged to have arisen out of any act, omission or breach of Grantee, or its agents, servants, employees or contractors, whether such claim or claims, action or actions be for damages, injury to person or property, including the property of the Grantor Parties, or death of any person, made by any person, group or organization or (b) any mechanics’, materialmen’s and laborers’ liens and all cost, loss, expenses and liabilities arising from Grantee’s performance of its obligations under this easement agreement. Insurance or Risk Transfer: During performance of all of its obligations under this easement agreement, Grantee agrees that it shall, at its own expense (and shall cause any third party contractor to) maintain in force a policy or policies or a similar Liability Coverage Document written by one or more responsible insurance carriers licensed to do business in the State of Texas, or by the Texas Municipal League Intergovernmental Risk Pool (the “Pool”), which shall insure or protect Grantee against liability for bodily injury to and/or damage to property of any person or persons, with coverage limits in an amount reasonably acceptable to Grantor. Moreover, Grantee will endorse its Pool Liability Coverage Document to include the Pool's Indemnification Under Contract Endorsement EL217, with specific reference to this easement agreement. Grantee will also take all steps necessary to make sure that the Pool adds all necessary classifications to its General Liability schedule of exposures to make sure that the subject-matter of this easement agreement is covered. To have and to hold the above described property for drainage, silt removal and other maintenance purposes deemed necessary by Grantee, with the right of ingress, egress, and regress therein, together with all and singular the usual rights thereto in anywise belonging, unto the said Grantee, forever, and Grantor does hereby bind itself, its successors and assigns, to warrant and forever defend, all and singular, the said premises unto the said Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof. The Grantee shall not have the right to assign this grant in whole or in part without prior written consent of the Grantor. When the context requires, singular nouns and pronouns include the plural. These servers provide critical services to the employees of the City and have reached the end of their 5 year lifespan. Staff has obtained cost proposals from Dell Computer Corporation and Sungard Public Sector, Inc to replace these servers. The FY15 Capital Projects budget includes $140,000 of funding for these projects. The city manager said that this is a contract with Kimley-Horn to conduct a traffic study associated with the George W. Bush Presidential Center (GWBPC). The zoning process that was approved for the GWBPC required that traffic studies be performed at 6 months, 18 months and 36 months following the issuance of the certificate of occupancy. The total cost of the study is $11,000 with the GWBPC reimbursing the City $8,800. This proposal was approved 14-300 Consider approval of a drainage and maintenance agreement with a property owner adjacent to Turtle Creek, south of McFarlin Blvd. City Manager Corder said that this is a maintenance agreement with the property owner of 3805 McFarlin Blvd. This agreement will allow the City to access the privately-owned collapsible dam that will be constructed across Turtle Creek south of McFarlin Blvd. The City will operate the dam and be responsible for silt removal from the creek channel north of the dam to McFarlin Blvd. This agreement was approved Page 2City of University Park March 17, 2015City Council Meeting Minutes 14-302 Consider approval of an amendment to an agreement between the City of University Park and the Estate of Adele N. The agreement allows the City to construct retaining walls along Turtle Creek associated with the collapsible dam and McFarlin Bridge reconstruction project. Under the terms of the agreement, the Estate of Adele N. Seybold agreed to pay for seventy-five percent (75%) of the construction costs associated with the retaining walls located on property located at 3805 McFarlin, up to a maximum of $75,000. The City has nearly completed the design of the retaining walls, and the Estate has requested to amend the agreement to allow it to pay for its portion of the walls now. Mayor Lane opened the public hearing. Chief Planning Official Harry Persaud said that this public hearing is to discuss an amendment to PD-33 to allow 52 apartment units on the subject tract. The number of people living in the complex would be around 104 people. Tommy Mann, representing Winstead PC, said that a 2006 proposal for development at this site would have allowed 88 units to be developed. This development never occurred, but the 2006 allowance remains and guides the latest proposed development. There are currently 91 units on the site. Their new proposal is to build only 52 units. John Ausburn of 3401 Southwestern, represented Lang Partners. He described his company's vision for the development and provided details about the character and quality of the apartments. Carl Malcolm of JHP Architecture, spoke about the project. He said that there will be one, two, and three bedroom apartments. Each apartment will have its own garage. There are tandem spaces behind the units for additional parking. He said that all of the required parking is onsite. There will also be some existing public parking on Hyer. No garage doors will face public streets. Councilmember Armstrong asked about the density of the project. He wanted to know if this development was geared toward retirees or families with children. Mr. Malcolm said that the assumption is one person per bedroom will live in each unit. Councilmember Moore asked if the Fire Department needs the alleyway for fire protection. Mr. Persaud said that this development proposal was reviewed and approved by the Fire Department. Fire Chief Howell agreed, saying that the Fire Department would not need to put its apparatus in the alley. Councilmember Armstrong asked about parking in the residential parking district. Chief of Police Spradlin said that the ordinance does not differentiate multi-family dwellings, so the Police Department in practice gives parking passes to each resident to park on the street and guests could obtain parking placards. Councilmember Stewart asked about the utility poles. Mr. Malcolm said that the developer will put the lines underground when this project is underway. Councilmember Begert asked if Mr. Mann knew the demographics of the existing units on the site. Mr. Mann said he knew that children currently live in the apartments, but he did not have specific details. The Mayor closed the public hearing. HPISD is requesting an amendment of the PD detailed site plan to allow for the installation of a practice tennis court and shade structure on the vacant tract. The proposed shade structure measures approx. 20’X16’ with a 9’X8” pergola attached on the north side. It is intended to be used for tournaments and high school matches, as well as socials and an outdoor meeting room. The proposed court will be used by7-10 year olds for private and group tennis lessons. It will relieve the current overcrowding experienced on the courts in the afternoons. One resident is requesting changes to the existing PD conditions relating to athletic lighting which was adopted on October 15, 2013(attached). A copy of the email requesting that athletic lights should not be turned on before 7:00 AM and be turned off no later than 9:00 PM, is attached. HPISD has responded to the request in a letter to staff dated February 17, 2015, attached. Notices were mailed to property owners within 200 feet of the subject siteand public notices were posted in the Park Cities News in compliance with state law and city codes. Chairman West opened the formal public hearing in accordance with the published agenda, welcomed everyone in attendance, and introduced the members of the commission present. He then read the case before the commission: PZ 15-002: PZ 15-002: Hold a public hearing and consider a request to amend the detailed site plan for Planned Development District, PD-25 to add a practice tennis court and shade structure to the site. The subject tractis located north of Glenwick and east of Westchester and currently zoned Planned Development District, PD-25 in accordance with the City of University Park Comprehensive Zoning Ordinance. Mr. Persaudbriefed the commission, using a power point presentation, on the specifics of the case. He then stated that there were fifty-sevennotices mailed. There were five responses received, three opposed and two in favor. He then introduced staff members of the HPISD that were present. Mr. Westinquired if there was anyone to speak in favor or opposition of the case. Christie Haggard, resident at 4112 Druid Ln.She stated that there were previousdiscussions that none of the fields would be lit. Then they came back and wanted to light the fields. She felt that the residents were deceived. She expressed concerns that there were adults using the fieldsand not just students. Numerous times she has called the police and has been told that there was no way to enforce and that The City’s hands were tied. She stated that she was invited to speak at the meeting to discuss her concerns.She said that when herhome was purchased there were residential lots on that side of the street. Mr. West explained that this was not the meeting to express the concerns she had. She felt that The City was not being responsive. Mr. Dillard 2 suggested that she voice her concerns at the open session portion of the next city council meeting. Mr. West inquired if there were any other individuals present that wished to speak, nonecame forward. He then stated that the public hearing was closed. LizFarley inquired if the shade structure would be of cedar. Mr. Persaud stated that it would be a natural stain cedar. She inquired about the existing chain link fence and the Holley and Mr. Persaud confirmed the existing conditions. Mr. West asked for a motion. Mr. Aldredge made a motion to approve the request. BACKGROUND:City Council conducted a public hearing on this item at its regular meeting on March 17, 2015. The hearing was closed and after a discussion on the subject, the item was tabled for further consideration at the regular meeting on April 7, 2015. The detailed site plan including specific development standards relating to parking, utility services, landscape plan and color rendering of the proposed development areappended to the draft ordinance attached. The subject tract is owned by Intercity Investments Inc., represented by Winstead PC, with Lang Partners, LLC requesting the proposed zoning amendment to construct 52 units on the subject site. The proposed multifamily development complies with the approvedplate line and building heightsand reduces the overall development density by 41%. In order to facilitate the proposed development as per design shown on the detailed site plan, the developer is proposing to purchase the Alleyway right-of-ways located between Lovers and Hyer and between Hyer and Grassmere. The developer will then grant the City a 16 feet public access and utility easement to allow for maintenance of utilities and provide for unrestricted public access at all times. Notices were mailed to property owners within 200 feet of the subject site and public notices were posted in the Park Cities News in compliance with state law and city codes. A total of 15 property owners responded with 8 opposed, 6 in favor and 1 undecided. RECOMMENDATION:Planning and Zoning Commission held a public hearing and considered this item on February 10, 2015 and voted unanimously to recommend approval. ORDINANCE NO. This configurationmay be altered during construction, plus or minus 2 of each type unit, byapprovaloftheDirector of Community Development. The developmentshallprovide118off-streetparking spaces, with not less than 2 spaces for each unit or 1 space for each bedroom, whichever is greater, plus10parkingspacesat gradeon the site and located along the north-south commercialalley, reserved for commercial uses located on the west side of Preston Road and not included in the parking calculations for this PD-33.Thebuildingsshallnot exceed47feetinheight,norhaveatopplateline heightexceeding38feet8inches. The minimum building setback from a public street shall be 25 feet from the property line. The minimum setback from a garage door to the opposite side of the pavementshall be 21 feet, with a minimum of 5 feet radius for a drivewayapproach, as shown on the approved detailed site plan. The maximum width for balconies and bay windows shall be 16 feet. A leasing office and swimming pool are to be located near the northeast corner of the property. All external facades shall be constructed with a minimum of 80% masonry materialwith a minimum thickness of three and a half inches; d.Thedevelopershallberesponsibleforupgrading and extending water and sanitary sewer lines in accordance with the approved detailed site plan. Developer will request the City Council to abandon the existing alleysbetween Lovers Lane and Hyer and between Hyer and Grassmere, provided the developer will grantby plata 16’ defined publicaccess and utility easement along each of the alleys to accommodatethe City’scommercialsanitationvehicles,provide adequateturningradiifor garbage pickup, and for the retention and future maintenance of utilities. The developer shall be responsible for the paving and full maintenance of the public access and utility easements; e.Detailedcivilplansfor the paving of the north-south commercial alley, paving of the public access and utility easements, installation and extensionof utilities, including vaults, meters and taps, and location of fire hydrants mustbesubmittedforstaff engineeringreviewand approval by the Director of Public Works before issuance of a building permit. Mechanical, electrical, and plumbing plans must be stamped and signed byaTexas RegisteredProfessionalEngineer; f.The development shall besubject to the approved landscape plan, attachedaspartofthedetailed siteplan. The plan requires retention of 7 existingtrees and a total of 183 new canopy and mid-story trees to be installed in accordance with the included planting schedule. Shrubs,vinesand ground coverwill be installed in accordance with the planting schedule; g.Waste and recycling shall be collected from each unit and deposited in appropriate dumpsters by the property’smanagement. Five recycling dumpsters and six waste dumpsters shall be provided at the locations indicated on the detailed site plan. The Director of Public Works may authorize deviations from the detailed site plan if necessary for the provision of waste and recycling services to the property; h.Permeable coverage calculations are shown on the detailed site plan as 63%, including certain areas which are to be engineered with a substrate base and covered with pavers. Paved areas must be confinedwith a reinforcedconcrete curb or a reinforced concrete edge as shown on the detailed site plan and constructed in accordance with the approved drawings to insure maximum permeability; i.All external light fixtures shall be fitted with a cut-off luminaire so that illumination shall not exceed0.5 foot-candles when measured 3feet above grade at the property line; j.Except as otherwise provided by this ordinance or the approved amended detailedsite plan made a part hereof, the area regulations applicable to the MF-3 District shall apply to the development.
