Deputy Director of Public Works Jacob Speer recognized Ronny Traylor of the Infrastructure Maintenance Division. Ronny worked for the City for 26 years. CONSENT AGENDAIII. 15-379 Consider approval of cooperative purchasing agreement with Physio Control. City Manager Robbie Corder said that this is a Participating Addendum with Physio Control to facilitate cooperative purchasing of defibrillators and maintenance plans for the Police and Fire Departments. A contract with this vendor exists through the National Association of State Procurement Officials (NASPO) cooperative purchasing program. This agreement was approved. 15-384 Consider approval of the minutes of the July 7 City Council meeting, with or without corrections. The motion carried by the following vote: Aye:Mayor Lane, Councilmember Armstrong, Councilmember Begert, and Mayor Pro Tem Stewart 4 - Page 2City of University Park July 21, 2015City Council Meeting Minutes MAIN AGENDAIV. 15-373 Second Public Hearing for the 2014 Consumer Confidence Report. Mayor Lane opened the public hearing. City Manager Corder said that this public hearing is on the agenda every year as part of state and federal requirements to submit an annual report regarding the City's drinking water quality. As part of those requirements, the City must conduct two public hearings to allow University Park residents to comment on the report. As in past years, the City’s drinking water quality meets or exceeds all federal (EPA) requirements. This is the second of two public hearings. There were no speakers, and the Mayor closed the public hearing. 15-381 Consider approval of a right-of-way abandonment at 3945 Amherst. City Manager Corder said that the property owner at 3945 Amherst requested that the City abandon right-of-way (R-O-W) along Tulane Avenue, adjacent to 3945 Amherst. The Tulane R-O-W is considerably wider than most streets in the community, with the property line about seventeen feet back of sidewalk. Because the existing franchise utilities are located within the street, the area behind the sidewalks is excess R-O-W. City Manager Corder explained that approval of this item would authorize staff to seek a fair market value appraisal of the right-of-way (at the property owner's expense), not the actual sale. When the value is determined, the Council would consider a R-O-W abandonment ordinance. Councilmember Begert said he was concerned about this request and the other R-O-W abandonment request at 3945 Purdue on the agenda as there are around 20 other properties along Tulane that might make similar requests. He recommended that the Planning and Zoning Commission review these R-O-W abandonments before the Council considers them further. A motion was made by Councilmember Bob Begert, seconded by Mayor Pro Tem Tommy Stewart, to refer this item 15-381 and the next item 15-382 to the Planning and Zoning Commission for further review. Page 3City of University Park July 21, 2015City Council Meeting Minutes 15-380 Discuss License Plate Reader (LPR) Systems. City Manager Corder said that this a discussion about purchasing a License Plate Reader system (LPR). LPR are increasingly being used as an investigative tool in law enforcement. LPR systems can facilitate the identification and location of stolen vehicles and wanted persons. The Council was briefed on this item in the pre-session. Staff recommends sending this item to the Public Safety Committee for review. A motion was made by Councilmember Bob Begert, seconded by Councilmember Taylor Armstrong,to refer this item to the Public Safety Committee for further review. The motion carried by the following vote: Aye:Mayor Lane, Councilmember Armstrong, Councilmember Begert, and Mayor Pro Tem Stewart 4 - 15-383 Consider approval of a contract for a Pool Master Plan for the Holmes Aquatic Center. The city manager said that this is a contract with Davis and Davis for development of a master plan at the Holmes Aquatic Center. Development of a master plan was prompted by an increase in structural damage to the supporting buildings at the Holmes Aquatic Center and the desire to plan for the facility’s future needs. The Parks Advisory Committee and staff both support the expenditure. The contract is in the amount of $58,700. A motion was made by Councilmember Bob Begert, seconded by Mayor Pro Tem Tommy Stewart, to approve this contract. BACKGROUND:A companion action item, to consider adoption of an amending Ordinance on this issue, is on this same agenda. RE:Planning Commission Case File PZ 15-004: University Park United Methodist Church requesting approval to amend the detailed site plan for Planned Development District, PD 20, to install a 4 feet high wrought iron fence around a children’s playground located on the northwest corner of the subject site. GENERAL INFORMATION APPLICANT:George O’Reilly, representing the University Park United Methodist Church LOCATION:Planned Development District, PD-20 situated at 4024 Caruth Boulevardand located North of Caruth Boulevardand east of Preston Road. REQUEST:Requesting approval to amend the detailed site plan for Planned Development District, PD-20 to install a 4 feet high wrought iron fence around a children’s playground located on the northwest corner of the subject site. The concept plan shows two phases of development and waived the requirement for detailed site plan approval at P&Z. The detailed site plan for the multi-purpose building, parking lot and landscaping off of Pickwick Lane andColgate Avenue was approved by City Council on July 6, 2010. City Councilalso approved a detailed site plan amendment on July 7, 2012 which provided fora playground designed for children 6 months to 23 months of age. University Park United Methodist Church is accredited by the NationalAssociation for the Education of Young Children (NAEYC). The Church is nowseeking approval to install a fourfeet (4’) high wrought iron fence around a children’splayground located on the north west corner of the subject site. The proposedplayground is shown on the detailed site plan attached and provides for thefollowing features: 1.The playground measures approximately215 feet along Colgate and 180 feet along Preston Road and setback 20 feet from the property line. A new 4 high wrought iron fence will be installed around the perimeter of the playground as shown on theattached detailed site plan. The fence will be constructed with redbrick columns and white capstone, spaced 18 feet on center and 3½ inch spacing between pickets to match the existing fence on the east side. The fence will include three gates equipped with child proof safety latches. 2.A planting bed with landscaping will be installed on the outside of the fence facing the public street. A total of 565 one gallon size liriope will be installed on 8 inch center as shown on the detailed site plan. Seasonal color landscaping will be established at the corner of Preston Road and Colgate Avenue and the church private drive as shown on the detailed site plan. 3.No additional outdoor lighting, signage or permanent structures shall be installed on the site. 4.The proposed playground will be used during normal business hours and special daytime functions of the Church and Weekday School. At the time of this report no one has responded. Staff will provide an update at the meeting. The Planning Commission conducted a public hearing on July 14, 2015 to receive comments on the proposed amendment to allow the playground fence. No persons in attendance offered comments during the hearing. The proposed amending Ordinance is attached. Staff will be present at the Council meeting to respondto questions. RECOMMENDATION: The Planning Commission recommends that the City Council conduct a Public Hearing to receive comments on the ordinance amending PD-20 to allow the playground fence. ORDINANCE NO. AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP OF THE CITY OF UNIVERSITY PARK, AS HERETOFORE AMENDED, BY AMENDING PLANNED DEVELOPMENT DISTRICT NO. 20, DESCRIBED AS LOT 1A, BLOCK 45, FOURTH SECTION, OF UNIVERSITY HEIGHTS SUBDIVISION, AN ADDITION TO THE CITY OF UNIVERSITY PARK, DALLAS COUNTY, TEXAS, AND COMMONLY KNOWN AS 4024 CARUTH; APPROVING AN AMENDED DETAILED SITE PLAN AS EXHIBIT "A" FOR PD-20; PROVIDING SPECIAL CONDITIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. The Comprehensive Zoning Ordinance and Map of the City of University Park, Texas, as heretofore amended, are hereby amended by amending Planned Development District No. 20 for the University Park United Methodist Church on Lot 1A, Block 45, Fourth Section, of University Heights Subdivision, an addition to the City of University Park, Dallas County, Texas, and more commonly known as 4024 Caruth Boulevard, University Park, Texas, by adopting an amended detailed site plan ("site plan") setting forth the land uses proposed for the amended PD-20, attached hereto as Exhibit "A" and made a part hereof for all purposes, the same as if fully copied herein. That such amended detailed site plan contains the data required by Section 17-101(2) of the Comprehensive Zoning Ordinance, and is hereby approved in all respects. SECTION 2. Approval of the amended detailed site plan for Planned Development District No. 20 is subject to the following special conditions: A. Development of the property shall be in accordance with the amended detailed site plan submitted and approved in accordance with Section 17-101(2) and all other provisions of the Comprehensive Zoning Ordinance of the City of University Park, as amended hereby, and, unless otherwise defined herein, all terms used shall have the respective definitions assigned to them in the Comprehensive Zoning Ordinance; B. The uses on the property shall be those allowed in the ordinance granting Planned Development District 20, PD-20, as previously amended and as amended hereby, as shown on Exhibit "A"; C. The addition of a fence on the northwest corner of the property to enclose a children's playground is subject to the following special conditions: 1. The children's playground measures approximately 215 feet along the Colgate Avenue property line and 180 feet along the Preston Road property line as shown on the site plan; 2. The playground will be enclosed by a four feet high wrought iron fence painted satin black, having red brick columns with white capstones, spaced eighteen feet (18’) on centers and having 3 1/2 inches between pickets, to match the existing fence on the east side enclosing the infants and toddlers playground; 3. The wrought iron fence will be set back a minimum of twenty feet (20’) from adjacent City right-of-way on Colgate Avenue and Preston Road. The fence will have three gates with child-proof latches, as shown on the site plan; 4. Five hundred sixty-five (565) one gallon size liriope will be planted on eight inch (8”) centers to provide landscape screen around outside of the wrought iron fence, and seasonal color landscaping will be established at the corner of Preston Road and Colgate Avenue and the Church's private drive, as shown on the site plan; 5. No additional outdoor lighting, signage, or permanent structure, except as shown on the site plan, will be permitted; 6. Hours of operation for the playground will be during the normal business hours and special daytime functions of the Church and Weekday School; and 7. Primary access to the playground will be through gates located on the north side along Colgate Avenue and on the south side off of the Church's private drive. SECTION 3. All ordinances of the City of University Park in conflict with the provisions of this ordinance or the Comprehensive Zoning Ordinance as amended hereby are hereby repealed. SECTION 4. Should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part decided to be invalid, illegal or unconstitutional, and the same shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. Any person, firm or corporation violating any of the provisions or terms of this ordinance or of the Comprehensive Zoning Ordinance, as amended hereby, shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of University Park, Texas, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each and every day such a violation is continued shall be deemed to constitute a separate offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide. The wrought iron fence will be set back a minimum of twenty feet (20’) from adjacent City right-of-way on Colgate Avenue and Preston Road. The fence will have three gates with child-proof latches, as shown on the site plan; 4. Five hundred sixty-five (565) one gallon size liriope will be planted on eight inch (8”) centers to provide landscape screen around outside of the wrought iron fence, and seasonal color landscaping will be established at the corner of Preston Road and Colgate Avenue and the Church's private drive, as shown on the site plan; 5. No additional outdoor lighting, signage, or permanent structure, except as shown on the site plan, will be permitted; 6. Hours of operation for the playground will be during the normal business hours and special daytime functions of the Church and Weekday School; and 7. Primary access to the playground will be through gates located on the north side along Colgate Avenue and on the south side off of the Church's private drive. SECTION 3. All ordinances of the City of University Park in conflict with the provisions of this ordinance or the Comprehensive Zoning Ordinance as amended hereby are hereby repealed. SECTION 4. Should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part decided to be invalid, illegal or unconstitutional, and the same shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. Any person, firm or corporation violating any of the provisions or terms of this ordinance or of the Comprehensive Zoning Ordinance, as amended hereby, shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of University Park, Texas, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each and every day such a violation is continued shall be deemed to constitute a separate offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide. This recommendationis consistent with best practices promulgated by the Government Finance Officers Association. While thereis nothing in either the policies or the GFOA best practices mandating the City change external auditorsat the expiration of their initial contract term, it has generally been the practice of the City to limit external auditors to two five-year terms before seeking new providers. Weaver and Tidwell, L.L.P. haveserved as the City’s external auditor for the past ten fiscal years. In late March, the City published a Request for Proposals (RFP) for audit services. Responses were received from eleven audit firms. Five of the responding firms were identified as finalists based on the scoring criteria established in the RFP. Of the five, two firms were selected for interviews by the Finance Advisory sub-committee tasked by the Finance AdvisoryCommittee Chairman with recommending a suitable firm. At the completion of an exhaustive review process, the sub-committee recommended the selection of Crowe Horwath LLPto the Finance Advisory Committee. As can be seen in the attachment, the “bestand final” offer terms includea five-year contract (two- year base contract with three optional yearly renewals) at a total “not-to-exceed” price of $207,200. An electronic poll of the Finance Advisory Committee membership was conducted on July 29, 2015. Themembers unanimously agreed with the sub-committee recommendation. RECOMMENDATION: Both the Finance Advisory Committee and City Staff recommend selecting Crowe Horwath LLP as the City’s auditor for fiscal 2015 and 2016. BACKGROUND: State law requires that all taxing unitscomply with “truth-in-taxation”, a concept embodiedin both the Texas Constitution and the Tax Code. Truth-in-taxation requires the calculation and publication of both the Effective Tax Rate (ETR), acalculated rate that would provide the taxing unit with same amount of revenue it received the year beforeon properties taxed in both years, and the “Rollback” Tax Rate (RTR), a calculated maximum tax rate (ETR x 1.08) allowed by law without voter approval. The city’s tax collector, the Dallas County Tax Office (DCTO), calculates the ETRand the RTR for the City. When a proposed tax rate exceeds the lower of 100% of the ETR or the RTR, the Council must adopt a maximum proposed tax rate that it will consider. State law requires that the vote to adopt a proposed maximum rate be a roll call vote. The applicable tax rates for the 2015 tax year (FY2016) are as follows: 2015 ETR = 25.3335 cents per $100 of taxable value 2015 RTR = 27.3601cents per $100 of taxable value 2014 University Park property tax rate= 26.979cents per $100 of taxable value. If Council votes to consider a maximum proposed rate that exceeds the effective rate of 25.3335cents per $100 of taxable value, it must also schedule and conduct two public hearings on the proposed tax rate. To comply with state law, the first public hearing will be conducted at 5:00 p.m. during the regular scheduled Council meeting of August 18, 2015and take place at University Park City Hall, 3800 University Blvd., University Park, TX.
