Nir. Arch Swank, architect for Neiman-Marcus, appeared as spokesman for
that firm. Accompanying AIr Swank were Mr. Edi,rard Marcus; Mr. Robert Ross, Merchandise
Manager; Ivir, Norman Bramley, Secretary and Treasurer of the firm, and Ate. Charles
Eversole,the insurance agent for the company. The .above gentler:.en presented blue
prints, plans and specifications of their proposed building to be constructed in
Varsity Village. They desired to protest that part of the Building Code of University
Park requiring sprinkler system to be installed in fire proof buildings. They pointed
out that it had been their experience and the experience of others handling comparable
merchandise to that handled by them, that in cases of fire more damage had been caused
by water from sprinkler systems than to have been caused by fire had there not been ,
a sprinkler systema They further pointed out that in the particular building they
desired to construct that all machinery, electrical switches and etc., will be housed
in fire proof rooms; further that the store will always maintain on duty a night
watchman who will be required to visit different parts of the store throughout the

night at regular intervals punching an electrical device evidencing his visit to
that part of the store. This particular system or device automatically sends in a
distress call to the proper authorities in the event the apparatus is not visited
and operated by the night matcllm= as per schedule.
After a thorough discussion. of the matter for more than an hour, Commissioner
Coffee moved that parts of Section. 7 of our Building Ordinance passed and approved �.
the 18th day of May, 1931, be amended to include sub -paragraph (a) of Paragraph X,
Section 404 of the National Building Code 1949, as recommended by the'National Board
of Fire Underwriters of New York, be adopted; Trnich is as follows: �
"(a) For fireproof construction and semi -fireproof construction unl4Mited."
Commissioner Coffee's motion further included that the City Engineer be authorized
to tyrant the permit to Neiman-Marcus in accordance i•rith the above. This motion z•ras
seconded by Commi sinner Burleson and carried unanimously.
