AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS,
AMENDING SECTION 13.05.089 OF THE CODE OF ORDINANCES TO
PROVIDE A STREET USE FEE FOR FRANCHISEES ENGAGING IN
THE BUSINESS OF COLLECTING, TRANSPORTING, AND DISPOSING
OF SOLID WASTE WITHIN THE CITY; PROVIDINGPROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, various entities have been franchised to provide for the collection,
transporting, and disposing of solid waste generated in the City; and
WHEREAS, the City Council desires to amend the street use fee charged to such
entities; Now Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That Section 13 .05.089 of the Code of Ordinances of the City of
University Park is hereby amended to read as follows :
"Sec. 13.05.089 Street use fees
In consideration of the grant contained in section 13.05.081 above, the franchisee agrees
to pay monthly to the city seven (7%) percent of the gross receipts billed to contracted waste
accounts for services rendered under the provisions of this franchise to customers within the City
limits of University Park. City reserves the right to audit Company's records at any time with
seven (7) days' prior notice."
SECTION 2. That all ordinances in conflict with the provisions of this ordinance are
hereby repealed.
SECTION 3. That should any sentence, paragraph, subdivision, clause, phrase or section
of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole, or any part or provision thereof other than the
part so decided to be invalid, illegal or unconstitutional.
SECTION 4. This ordinance shall take effect immediately from and after its passage, as
the law and Charter in such cases provide.
DULY PASSED by the City Council of the City of University Park, Texas, on the 2nd
