HomeMy WebLinkAboutOrdinance No. 16-011 SUP47 AmendmentORDINANCE NO. 16-11 AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING SPECIFIC USE PERMIT NUMBER 47 FOR THE PROPERTY AT 4057 GRASSMERE, DESCRIBED AS LOT 1! BLOCK 2, UNIVERSITY PARK ESTATES, AN ADDITION TO THE CITY OF UNIVERSITY PARK, TEXAS; AUTHORIZING A SCREENING FENCE ALONG PRESTON ROAD; PROVIDING SPECIAL CONDITIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission and the City Council of the City of University Park have given the requisite notices and conducted the public hearings required by law; and WHEREAS, the City Council is of the opinion and finds that Specific Use Permit 47 should be amended as requested to alleviate noise and visual clutter from Preston Road, a high automobile and truck traffic thoroughfare; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. That Specific Use Permit Number 47, heretofore granted as permitted by Section 16-103 of the Comprehensive Zoning Ordinance of the City of University Park, Texas, to permit a screening fence for 4057 Grassmere Lane, the property being described as Lot 1, Block 2, University Park Estates Addition, an addition to the City of University Park, Dallas County, Texas (the "site"), is hereby amended in its entirety to permit construction of an eight feet (8') tall stucco wall along the western side of the property adjacent to Preston Road. SECTION 2. That the approval of the amended Specific Use Permit Number 47 is subject to the following special conditions: A. Specific Use Permit 47 will allow for the construction of an 8 feet hi gh concrete block (CMU) wall with stucco finish (See Section A L4.06 attached) along the west property line as shown on the site plan. The wall shall be white in color, installed on private property and located outside the visibility triangle at the corner of Grassmere and Preston and extend south to the visibility triangle at the alleyway as shown on the attached site plan. B. The property owner will install 5 inch caliper Cathedral Live Oaks (Quercus Virginiana) that are 17-18 feet in height, on sixteen feet (16') centers along the parkway on Preston Road abutting this site. Installation and maintenance of landscaping as shown on the attached site plan will be the sole responsibility of the property owner. SECTION 3. All ordinances of the City of University Park in conflict with the provisions of this ordinance are hereby repealed. SECTION 4. Should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part decided to be invalid, illegal or unconstitutional. SECTION 5. Any person, firm or corporation violating any of the provisions of this ordinance or the Comprehensive Zoning Ordinance, as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas, shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense, and each and every day any such violation shall continue shall be deemed to constitute a separate offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide.
