HomeMy WebLinkAboutOrdinance No. 16-017 Park Cities YMCA Residential Parking District pdfORDINANCE NO. 16/017 AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF UNIVERSITY PARK, CHAPTER 12, TRAFFIC CONTROL, BY AMENDING SECTION 12.05.042 (a) TO PROVIDE FOR DESIGNATION OF RESIDENT-PARKING-ONLY ZONES FOR THE SOUTH SIDE OF 4007-4005 NORMANDY AND THE EAST SIDE OF THE 4000 BLOCK OF NORMANDY AVENUE, THE NORTH SIDE OF THE 4000 BLOCK OF SHENANDOAH, THE WEST SIDE OF THE 6100 BLOCK OF ST. ANDREWS DRIVE AND 6205 ST. ANDREWS DRIVE, THE EAST SIDE OF THE 6000 BLOCK OF CONNERL Y DRIVE, AND THE WEST SIDE OF THE 6100 BLOCK OF WESTWICK ROAD; PROVIDING THAT THE RESIDENT- PARKING-ONLY RESTRICTIONS HEREIN SHALL BE EFFECTIVE FROM 12:00 AM TO 6:00PM ON SATURDAY, FROM 2:00PM TO 5:00PM ON SUNDAY, AND AT ALL TIMES FROM MONDAY THROUGH FRIDAY; PROVIDING THAT THE CITY COUNCIL WILL REVIEW THE THESE RESTRICTIONS SIX (6) MONTHS FOLLOWING THE EFFECTIVE DATE OF THIS ORDINANCE; ESTABLISHING PROVISIONS WHEREBY THE FIRST UNITARIAN CHURCH MAY REQUEST SUSPENSION OF THE RESIDENT-PARKING-ONLY RESTRICTIONS; PROHIBITING PARKING ON THE SOUTHEASTERN SIDE OF 6101 ST. ANDREWS DRIVE; PROVIDING FOR THE ERECTION OF SIGNS GIVING NOTICE OF THE RESIDENT-PARKING-ONLY RESTRICTIONS AND "NO PARKING" ADOPTED HEREIN; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) FOR EACH OFFENSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. That Chapter 12, Article 12.05 "Parking", Section 12.05.042 (a), of the Code of Ordinances, City of University Park, Texas, is hereby amended in part to designate additional resid ent-parking-only zones, as fo llows: "Sec. 12.05.042 Zones Designated; issuance of permits (a) The fo llowing are designated as resident-parki ng-only zones, to wit: (20) The 3400 bl ock of Normandy A venue, except the so uth side, west from Hi llcrest a di stance of 2 15 feet; the south side of Normandy Avenue abutting 4005- 4007 Normandy A venue; and the east side Normandy A venue from Connerly Drive to St. Andrews Drive, provided that the resident-parking-only restriction for 4005-4007 Normandy Avenue, and the east side of Normandy Avenue from Connerly Drive to St. Andrews Drive shall be effective from 12:00 a.m. to 6:00 p.m. on Saturday, from 2:00 p.m. to 5:00 p.m. on Sunday, and at all times on Monday through Friday; (22) The 3400 block of Shenandoah; the north side of the 4000 block of Shenandoah, provided that the resident-parking-only restriction for north side of the 4000 block of Shenandoah shall be effective from 12:00 a.m. to 6:00p.m. on Saturday, from 2:00 p.m. to 5:00 p.m. on Sunday, and at all times on Monday through Friday; (26) The west side of the 6100 block of St. Andrews Drive and 6205 St. Andrews Drive, effective from 12 a.m. to 6:00p.m. on Saturday, from 2:00p.m. to 5:00p.m. on Sunday, and at all times on Monday through Friday; (27) The east side of the 6000 block of Connerly Drive effective from 12 a.m. to 6:00p.m. on Saturday, from 2:00p.m. to 5:00p.m. on Sunday, and at all times on Monday through Friday; (28) The west side ofthe 6100 block ofWestwick Road effective from 12 a.m. to 6:00p.m. on Saturday, from 2:00p.m. to 5:00p.m. on Sunday, and at all times on Monday through Friday." SECTION 2. The City Council will review the new requirements provided for herein six (6) months following the effective date of this Ordinance. SECTION 3. The First Unitarian Church may request a suspension of the resident- parking-only requirements provided for herein in subsections (20), (22), (26), (27) and (28) in the vicinity of the Church (the "requirements") in accordance with the following procedure: (1) The request for suspension must be scheduled, with no less than three (3) days' advance notice to the City; (2) Suspension of the requirements will be limited to ten (1 0) special events per calendar year, with a maximum duration of four (4) hours per event; (3) The requirements shall be suspended on the following holidays, provided a minimum ofthree days ' advance notice is provided to the City: a. Maundy Thursday b. Good Friday c. Easter Sunday d. Christmas Eve e. Christmas Day; ( 4) The requirements may be suspended with less than three (3) days ' advance notice for funerals or other local tragedies, provided the City is notified as soon as possible; (5) Upon suspension of the requirements: a. The City will notify residents via the City's "group" e-mail; b. The City will cover/uncover signs during normal working hours (Monday -Friday, 7 am -5 pm), at the City's expense; c. The First Unitarian Church will cover/uncover signs outside of the City's normal working hours, at the Church's expense. SECTION 4. It shall be unlawful and an offense for any person to leave, stand or park any motor vehicle at any time on the southeastern side of 6101 St. Andrews Drive. SECTION 5. That all provisions of the Code of Ordinances of the City of University Park, Texas, in conflict with the provisions of this ordinance are hereby repealed. SECTION 6. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this ordinance or of the Code of Ordinances, as amended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 7. Any person, firm or corporation violating any of the provisions ofthis ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas, shall be punished by a fine not to exceed the sum of two hundred dollars ($200.00) for each offense. SECTION 8. That this ordinance shall take effect immediately from and after the publication of the caption, as the law and Charter in such cases provide, subject to the erection of appropriate signs giving notice of the resident-parking-only zone provided for in Section 1 herein and erection of appropriate signs giving notice of "No Parking" as provided in Section 4 herein.
