AN ORDINANCE OF THE CITY OF UNIVERSITY PARK TEXAS,
ABANDONING WATER LINE EASEMENTS OF THE PRESTON ROAD FRESH
WATER DISTRICT TO THE ABUTTING OWNERS; AUTHORIZING THE MAYOR TO
EXECUTE A QUIT CLAIM DEED OF AN ABANDONED EASEMENT TO THE
ABUTTING OWNERS; PROVIDING FOR THE FURNISHING OF A CERTIFIED COPY
OF THIS ORDINANCE FOR RECORDING IN THE REAL PROPERTY RECORDS OF
DALLAS COUNTY, TEXAS, AND THE QUITCLAIM DEED OF THE CITY AS
AUTHORIZED HEREBY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of University Park, Texas, has determined that
water line easements have been reserved in numerous deeds to property in the City by the Preston
Road Fresh Water District, a discontinued entity, are not needed or necessary for public purposes by
the City, are not the property of the City, and any claims to them should be abandoned to the
abutting owners; Now, Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. The City of University Park hereby abandons and quitclaims, in favor ofthe
abutting owners any claim it may have to a water line easement shown on any recorded plat or in a
recorded easement deed as dedicated to the Preston Road. Fresh Water District.
SECTION 2. The City of University Park does not abandon any other interest other than
described herein, but does hereby abandon all of its right, title, or interest in the described real
property interest, if any, together with any and all improv~ments thereon, if any.
SECTION 3. The City Secretary is directed to prepare a certified copy of this ordinance
and furnish the same upon request of the abutting owners for recording in the Real Property Records
of Dallas County, Texas. A request of an abutting ovmer shall be reviewed by the Director of
Public Works or his designee and a recommendation made to the Mayor with regard to such
request. Upon receipt of a favorable recommendation, the Mayor shall execute a quitclaim deed of
the City of University Park, in a form approved by the City Attorney, of all right, title or interest of
the City of University Park, if any, in and to a water line easement reserved to the Preston Road
Fresh Water District in a recorded plat or easement deed and affecting such abutting property.

SECTION 4. This ordinance shall take effect immediately from and after its passage, as
the law and Charter in such cases provide.
DULY PASSED by the City Council ofthe City ofUni versity Park, Texas, on the 16th day
of September 2014.
