AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING
THE CODE OF ORDINANCES OF THE CITY OF UNIVERSITY PARK BY
AMENDING CHAPTER 2, ARTICLE 2.01, "GENERAL PROVISIONS" TO PROVIDE
DEFINITIONS; AMENDING ARTICLE 2.03 "IMPOUNDMENT" BY AUTHORIZING
THE DISPOSITION OF UNREDEEMED ANIMALS; PROVIDING FOR THE 1REPEAL
OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That Chapter 2, Article 2.01, ofthe Code of Ordinances, City ofUniversity
Park, Texas, is hereby amended by amending Section 2.01.001 "Definitions" in part as follows:
"Sec. 2.01.001 Definitions
The following words and phrases shall have the meanings set forth below, unless the context
clearly requires otherwise:
Abandon or Abandoned. The dumping, deserting or leaving any animal on public or private
property negligently or with the intent to terminate any further responsibility for the animal, or the
failure to properly redeem an animal impounded or quarantined by the City or its animal control
contractor.
"
SECTION 2. That Chapter 2, Article 2.03 "Impoundment", of the Code of Ordinances,
City of University Park, Texas, is hereby amended by amending Section 2.03.005 in part as
follows:
"Sec. 2.03.005 Disposition of unredeemed animals; destruction of diseased animals
An impounded animal shall be kept for a minimum of five (5) days, or a longer period at the
discretion of the animal control officer. If the animal has not been redeemed by the owner during
the impoundment period, the animal will be considered to have been abandoned by the owner,
ownership will be divested and the animal will become the property of the City as abandoned
personal property. At that time, a healthy animal may be placed for adoption, sent to a rescue
organization or shelter facility, or humanely euthanized. While impounded, the animal will receive
feeding, care and treatment. If the animal is suffering from rabies or a disease or injury which
cannot reasonably be treated without undue expense, the animal will be humanely euthanized."
SECTION 2. All ordinances of the City of University Park in conflict with the provisions
ofthis ordinance or the Code of Ordinances, as amended hereby, are hereby repealed.
SECTION 3. The provisions of this ordinance are severable and should any such provision
be declared unconstitutional or unenforceable, such declaration shall not affect any of the
remaining provisions hereof or the Code of Ordinances as amended hereby.
SECTION 4. This ordinance shall take effect immediately from and after its passage, as
the law and Charter in such cases provide.
DULY PASSED by the City Council of the City of University Park, Texas, on this 6th
