The subject site is located at 3220 Daniel Avenue and currently zoned Multi-Family 3ORDINANCE NO. 18-021 AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP OF THE CITY OF UNIVERSITY PARK, AS HERETOFORE AMENDED, BY GRANTING SPECIFIC USE PERMIT NO. 98 (SUP 98) FOR A PLACE OF WORSHIP AT 3220 DANIEL A VENUE, A TRACT OF LAND MORE PARTICULARLY DESCRIBED AS THE EAST ONE-HALF OF THE SOUTH ONE-HALF OF LOT 3, BLOCK F, SMU HEIGHTS, AN ADDITION TO THE CITY OF UNIVERSITY PARK, DALLAS COUNTY, TEXAS (THE "PROPERTY") ZONED FOR MULTI-FAMILY 3 ZONING DISTRICT USES; APPROVING A SITE PLAN FOR SUP 98 ATTACHED AS EXHIBIT A; PROVIDING SPECIAL CONDITIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission ofthe City of University Park and the City Council of the City ofUniversity Park, in compliance with the laws ofthe State ofTexas with reference to the granting of zoning classifications and changes, have given the requisite notices by publication and otherwise, and have held due hearings and afforded a full and fair hearing to all property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof, and the City Council ofthe City of University Park is ofthe opinion and finds that a zoning change should be granted and that the Comprehensive Zoning Ordinance and Map should be amended; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. The Comprehensive Zoning Ordinance and Map of the City of University Park, Texas, as heretofore amended, are hereby amended by granting Specific Use Permit No. 98 (SUP 98) for 3220 Daniel A venue, currently zoned for Multi-Family 3 zoning district uses, a tract of land described as the east one-half of the south one-half of Lot 3, Block F, SMU Heights, an addition to the City of University Park, Dallas County, Texas, and adopting a Site Plan setting forth the land uses proposed for the property, attached hereto as Exhibit "A" and made a part hereof for all purposes, the same as if fully copied herein. SECTION 2. Approval of SUP 98 and the Site Plan is subject to the following special conditions: A. This SUP 98 is to authorize use of the multi-family 3 zoned property for an additional use as a Place of Worship as shown on the Site Plan; B. That the granting of this SUP is authorized by the Use Tables of the Comprehensive Zoning Ordinance, is in addition to, and does not affect, the underlying multi-family zoning (MF-3) of the property. SECTION 3. All ordinances of the City of University Park in conflict with the provisions of this ordinance or the Comprehensive Zoning Ordinance as amended hereby are hereby repealed. SECTION 4. Should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal, or invalid, the same shall not affect the validity of this ordinance or any part or provision hereof other than the part decided to be invalid, illegal or unconstitutional, and the same shall not affect the validity of the Comprehensive Zoning Ordinance. SECTION 5. That any person, firm or corporation violating any of the provisions or terms of this ordinance or of the Comprehensive Zoning Ordinance, as amended hereby, shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of University Park, Texas, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000,00) for each offense, and each and every day such a violation is continued shall be deemed to constitute a separate offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and Charter in such cases provide. Before proceeding with the work, the contractor shall verify all dimensions in the field and notify the Architect of any discrepancies between the drawings and the actual field conditions. 02. The dimensions shown on the drawings are to face of framing, centerline of structure, or object as indicated on the drawings unless noted otherwise. 03. Do not scale drawings; written dimensions govern. Large scale drawings govern over small scale details. Notify Architect of any discrepancies. 04. All work to be done in a professional workmanlike manner and in accordance with the city codes and all other state and local codes that have authority over this project. 05. When required, the contractor shall consult an arborist for preservation of trees both during and after construction. 06. All interior materials and finishes shall be as selected and approved by the Architect. 07. The contractor shall obtain and pay for all permits, inspection fees, and deposits required for the installation of all work. It shall be the contractor's responsibility to call for local inspections and obtain approval from the city inspectors. 08. The contractor shall give all notices and comply with all laws, ordinances, rules, regulations, and lawful orders of any public authority bearing performance of the work. 09. Unless otherwise provided in the contract documents, the contractor shall provide and pay for all labor, materials, equipment, tools, construction equipment, machinery, transportation and other facilities and services necessary for proper execution and completion of the work. 10. All spoils of excavation (piers, footings, trenches, etc.) not reused shall be legally disposed of by the contractor. The contractor shall not store building materials, stage construction operations from, nor gain access to the construction site over adjacent properties. 11.After the foundation has been formed, prior to the pouring of concrete, the contractor shall provide an accurate survey performed by a registered surveyor or a registered engineer showing the location of the forms on the lot and their relationship to the property lines, setbacks, easements, and other relevant structures including, but not limited to existing and/or adjoining structures, retaining walls, and large or significant vegetation. 12. Contract drawings and specifications represent finished structure. They do not indicate method of construction. Contractor shall provide all measures necessary to protect structure and personnel during construction. Such measures shall include, but not be limited to: bracing, shoring of loads due to construction equipment, excavation protection, scaffolding, job site safety, etc. Observation visits to the site by the Architect, owner, or engineer shall not include inspection of above items. 13. It is the responsibility of the contractor to supervise and coordinate various trades on building site to allow sufficient room for all equipment. 14. The typical interior wall construction is to be 5/8" Type X gypsum wall board on No. 2 (or better) kiln dried southern yellow pine 2x studs at 16" o.c. maximum. All tub and shower enclosures shall receive cementitious backer board. Where indicated, provide mass-loaded vinyl or batt sound insulation. 15. There shall be no oriented strand board (osb), chip board, or fiberboard (mdf, hdd) allowed in the construction of this project. 16. If requested, floor flatness testing shall be provided by an independent consultant. Contractor shall coordinate. 17. On-site and off-site utilities are indicated in the civil engineering drawings and MEP drawings if provided. The Contractor shall review these drawings before starting any work. Field verify existing utility conditions and notify the Architect of any discrepancies between the drawings and the actual field conditions before proceeding with the work. 18. No water heaters, or HVAC equipment shall be located in any attic space without prior review and approval of the Architect. All plumbing lines shall be wrapped in insulation. 19. No electrical equipment, lighting fixtures or other miscellaneous electrical items shall be ordered, purchased, or installed without the prior, written approval of the Architect. 20. All weld burns, scratches, etc. on all structural steel and metal deck shall be properly cleaned and repainted. No welding is to be performed after 2:00 PM. 21. All piping, conduit, etc. run on the exterior face of the building shall be painted to match the adjacent surface. 22. All exterior doors shall receive weather stripping and rain drips unless specifically noted otherwise within the contract documents. 23. Penetrations through walls or ceilings noted to be fire rated partitions shall be fire safed and sealed as required to maintain the rating of the wall. Ductwork penetrations through rated assemblies shall be provided with an appropriately rated fire damper. 24. All wood blocking to be fire retardant treated. All wood in contact with masonry or concrete to be pressure treated. 25. The contractor shall provide explosive gas leak detectors. 26. The contractor shall provide lightning protection systems. 27. The contractor shall provide water leak detectors with automatic shut-off valve. Provide DynaQuip WaterCop (or Architect approved equivalent) with freeze detection sensor. 28. Exterior wall faucets (hose bibbs) to be freeze and frost resistant. Provide Woodford Manufacturing Model 16 freezeless wall faucet (or Architect approved equivalent) at each location and install per manufacturer's instructions. 29. To the extent practicable, the contractor shall perform all work as prescribed in these drawings and by the accompanying written manual in complete compliance with all applicable Codes and Ordinances and according to the tenets of good practice. 30. These drawings and any accompanying written manual, provided by the Architect, are to be considered as one; whatever is called for by one shall be as binding as called for by all. Where the drawings and written manual disagree the better quality or greater quantity of the work or materials shall be estimated upon, and unless ordered by the Architect and Owner in writing, shall be performed or furnished. Should discrepancies or doubt occur, the contractor shall not proceed with the work without written clarification from the Architect and Owner. 31. These drawings and any accompanying written material, the intellectual property contained therein, and any and all reproductions of these documents are the sole property of William S.
