AN ORDINANCE OF THE CITY OF UNIVERSITY PARK TEXAS, ABANDONING
AN ALLEY EASEMENT OF 445 SQUARE FEET, MORE PARTICULARLY DESCRIBED
AND DEPICTED IN EXIllBIT "A" ATTACHED HERETO, TO THE ABUTTING
OWNERS, EDOUARD AND JOULIA PROUS, FOR $54,290 CONSIDERATION;
PROVIDING FOR THE FURNISHING OF A CERTIFIED COPY OF THIS ORDINANCE
FOR RECORDING IN THE REAL PROPERTY RECORDS OF DALLAS COUNTY,
TEXAS, AS A QUITCLAIM DEED OF THE CITY; AND PROVIDING AN EF~CTIVE
DATE.
WHEREAS, the City Council of the City of University Park, Texas, has determined that a
certain alley easement, as described herein, is not needed or necessary for public purposes by the City
and any claim to it should be abandoned to the abutting owners, subject to the provisiops of this
ordinance; Now, Therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. The City of University Park, Texas, hereby abandons and quitclaims, in favor
of the abutting property owners, Edouard and Joulia Prous ("Owner"), a 445 square feet alley that is
no longer needed or necessary for public purposes by the City, said easement being more particularly
described and depicted in Exhibit "A" attached hereto and made a part hereof for all purposes, the
same as if fully copied herein, in the City of University Park, Dallas County, Texas (the "abandoned
area").
SECTION 2. That the City of University Park does not abandon any other interest other
than described and depicted in Exhibit "A", but does hereby abandon all its right, title, or interest in
the abandoned area, together with all improvements thereon, if any, subject however, to the conditions
of this ordinance.
SECTION 3. That upon delivery of payment to the City by Owner of $54,290, the City
Secretary is directed to prepare a certified copy of this ordinance and furnish the same to the Owner
for recording in the Real Property Records of Dallas County. The recording of this abandonment
ordinance in the Real Property Records of Dallas County, Texas, shall serve as a quitclaim deed of
Texas, shall serve as a quitclaim deed of the City of University Park of all such right, title or interest
ofthe City ofUniversity Park in and to the abandoned area, plus all improvements thereon, if any.
SECTION 4. This ordinance shall take effect immediately from and after its passage, as
the law and Charter in such cases provide.
DULY PASSED by the City Council ofthe City of University Park, Texas, on the 16th day
of October 2018.

Being 445 square feet of land located in the JOSIAH BARKER SURVEY, Abstract No. 80, Dallas
County, Texas, and being a part of a 10' wide public alley right-of-way dedicated by Revised First
Section University Heights, an addition to the City of University Park, Dallas County, Texas, according
to the plat thereof recorded in Volume 3, Page 383, Map Records, Dallas County, Texas;
BEGINNING at a point for corner in Turtle Creek, in the South line of said 10' wide public alley
right-of-way, at the North common corner of lot 13 and 14 of said Block B of Revised First Section
University Heights, same being the Northeast corner of land described in deed to Good Marital Trust,
recorded in Instrument No. 20070330686, Official Public Records, Dallas County, Texas and the
Northwest corner of land described In deed to Edoward and Joulia Prous, recorded in Instrument No.
201300264123, Official Public Records, Dallas County, Texas;
Thence North 00°59'13" West, passing through said 10' wide public alley right-of-way, a distance of
5.00' to a point for corner in said Turtle Creek and the centerlinellne of said alley;
Thence North 89°00'47" East, along said centerline, a distance of 88.98' to a 1/2" iron rod with a yellow
plastic cap stamped "RPLS 5310" set for corner in said public alley right-of-way;
Thence South 00°59'13" East, passing through said 10' wide public alley right-of-way, a distance of
5.00' to a 1/2" iron rod with a yellow plastic cap stamped "RPLS 5310" set for comer In the North line of
said Prous land;
Thence South 89°00'47" West, along said North line of Prous land and the South line of said 10' wide
public alley right-of-way, a distance of 88.98' to the PLACE OF BEGINNING and containing 445 square
feet or 0.010 of an acre of land.
