HomeMy WebLinkAboutOrdinance No. 19-004 PD 16 Hyer ElementaryORDINANCE NO.19-004 AN ORDINANCE OF THE CITY OF UNIVERSITY PARK,TEXAS,AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP,AS HERETOFORE AMENDED,BY AMENDING PLANNED DEVELOPMENT DISTRICT NO.16 FOR THE PROPERTY DESCRIBED AS LOTS 1-18,BLOCK 39,UNIVERSITY HEIGHTS NO.4 ADDITION TO THE CITY OF UNIVERSITY PARK,DALLAS COUNTY,TEXAS, BEING COMMONLY KNOWN AS 3920 CARUTH BOULEVARD;APPROVING AN AMENDED DETAILED SITE PLAN;PROVIDING SPECIAL CONDITIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT;PROVIDING A SEVERABILITY CLAUSE;PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00)FOR EACH OFFENSE;AND PROVIDING AN EFFECTIVE DATE. WHEREAS,the Planning and Zoning Commission of the City of University Park and the City Council of the City of University Park,in compliance with the laws of the State of Texas with reference to the granting of zoning classifications and changes,have given the requisite notices by publication and otherwise,and have held due hearings and afforded a full and fair hearing to all property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof,and the City Council of the City of University Park is of the opinion and finds that said zoning change should be granted and that the Comprehensive Zoning Ordinance and Map should be amended;NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK,TEXAS: SECTION 1.That the Comprehensive Zoning Ordinance and Map are amended by amending Planned Development District No.16 in part by approving an amended detailed site plan, subject to special conditions for the property described as Lots 1-18,Block 39,University Heights No.4 Addition to the City of University Park,Dallas County,Texas,commonly known as 3920 Caruth Boulevard.The plan calls for demolition of the existing Robert S.Hyer Elementary School and construction of a new two story elementary school on the property. SECTION 2.That the amended detailed site plan for PD No.16,attached hereto collectively as Exhibit "A",is hereby approved as the detailed site plan for said Planned Development District 16,as required by the Comprehensive Zoning Ordinance of the City of University Park,Texas. SECTION 3.That this amendment of Planned Development District No.16 is subject to the following additional special conditions: a.All permanent improvements in this Planned Development District will be constructed and maintained in accordance with the amended detailed site plan attached hereto as Exhibit "A"; b.HPISD will provide adequate security lighting during construction of the improvements shown on the detailed site plan approved hereby; d.During construction,HPISD will give notice to residents in the area surrounding the school of the name and telephone number of a liaison appointed by the District to be available to respond to questions and complaints about the construction; e.The construction site will be screened with a temporary 8'screening fence of dark green or black windscreen fabric installed on a chain link frame or of other materials approved by the Community Development Director;all trash receptacles will be placed within the screened area; f.No parking of construction vehicles or equipment will be permitted on City streets except when a street is temporarily closed by authority of the Director of Public Works for necessary construction purposes;at all other times,construction vehicle and equipment parking will be provided on the site; g.Construction activities on the site will be conducted Monday through Saturday from 7:00 a.m.to 6:00 p.m.,unless special permission is granted by the Director of Public Works; h.Background checks will be conducted by the District's contractors for all employees on the site prior to their working on the project,and the results of the checks provided to the District,which will retain a file of such checks;no convicted felon or pedophile will be permitted to work on the project site; I.The issuance of a building permit is subject to review and approval of building plans for compliance applicable city codes and ordinances; J.The project is to demolish the existing building and construct a new building to house the Robert S.Hyer Elementary School of the Highland Park Independent School District. The new building will have a footprint area of 70,700 square feet.The total floor area of all floors will be 139,100 square feet.Underground parking for 80 vehicles will be provided on site.The building will have a minimum setback on the North of 23.9 feet, on the South of 44.8 feet,on the East of285.7 feet,and on the West of 66.8 feet.The building will have a maximum height of 36.9 feet.Other details are provided in Exhibit "A";and, k.That except as amended hereby,the special conditions of the ordinance creating,and those of any ordinance amending,PD 16 shall remain in full force and effect. SECTION 4.That all ordinances of the City of University Park in conflict with the provisions of this ordinance are hereby repealed. SECTION 5.That should any sentence,paragraph,subdivision,clause,phrase or section of this ordinance be adjudged or held to be unconstitutional,illegal or invalid,the same shall not affect the validity of this ordinance as a whole or any part or provision thereof,other than the part so declared to be invalid,illegal or unconstitutional,and shall not affect the validity of the Comprehensive Zoning Ordinance and Map as a whole. SECTION 6.That any person,firm or corporation violating any of the provisions of this ordinance or the Comprehensive Zoning Ordinance,as amended hereby,shall be deemed guilty of a misdemeanor and,upon conviction in the municipal court of the City of University Park,Texas, shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00)for each offense,and each and every day any such violation shall continue shall be deemed to constitute a separate offense. SECTION 7.That this ordinance shall take effect immediately from and after its passage and the publication of the caption,as the law and Charter in such cases provide. As part of the compaction the classroom wings will be designed to be two stories and located on the north end of the site.The administration and fine arts portions of the building will be one story.The gymnastics, library, and cafeteria will be 1.5 stories tall with an adjacent 1 story kitchen.Building heights are indicated on attached elevations. Pavement sub grade for A & B, below: The clay soils encountered near the existing ground surface will probably constitute the sub-gradefor most of the parking and drive areas. Therefore, it is recommended that these soils be improvedprior to construction of the pavements. It is recommended that the existing clay soils in drive and parking areas be excavated to achievefinal sub-grade elevation. The exposed surface of the clays should be scarified to a depth of at least 6inches and mixed with an estimated 7 percent of hydrated lime (by dry unit weight) in conformancewith Texas Highway Department item 260. Assuming an in-place unit weight of 100 pcf for the pave-ment sub-grade soils, this percentage of lime equates to about 32 lbs of lime per sq yard of sub- gradetreated. The actual amount of lime required should be determined by additional laboratory tests. It isrecommended that the lime stabilization procedures extend at least 4 ft beyond the edge of thepavement to minimize the effects of seasonal shrinking upon the extreme edges of pavement. Thesoil-lime mixture should then be compacted to at least 95 percent of standard proctor maximum drydensity (ASTM D698) within 3 percentage points of the optimum moisture content. In all areas wherehydrated lime is used to stabilize the sub-grade soils, routine atterberg-limit tests should be performedto assure that the resulting plasticity index of the soil-lime mixture is at/or below 15. The client should be aware that mechanical lime stabilization of the pavement sub-grade soils willnot prevent deep seated movement of the underlying untreated materials. Future maintenance ofpavements should be expected over the life of the structure.II. Paving A. ConcreteSub grade shall be as indicated in section I. Concrete driveway approaches shall be a minimum of 8 inches thick. Concrete driveway ap-proaches shall have a rise of not less than 6 inches nor more than 9 inches from the flow line of thegutter to a point 10 feet behind the face of the gutter. Concrete for driveways shall be a min- imum of3,600 psi in 28 days concrete with 4-6 percent entrained air. The grade below the drive- way, including4 foot outside of the outer edge of the driveway shall be compacted to 95% stand- ard proctor density,and as indicated in the "pavement sub-grade notes". Driveways shall have contraction joints not morethan 15 feet, apart, both transversely and longitudinally one-half inch expansion joint shall be placedon the property lines between the approach and the driveways. The joints shall be filled withpremolded gray bituminous expansion joint filler and shall extend the entire depth and length of theconcrete sections.Finishing shall be as indicated in section III. Exposed surfaces of sidewalks shall have a mono- lithic finish by trawlingwith a steel trowel and brushed lightly with an approved broom. The edge of all concrete shall beneatly rounded to the required radii with an edging tool.The exposed surface of curbs and curbs with gutter shall be shaped with a "mule" and brushed with awet brush at right angle to the line of the curb to produce a uniform textured surface. The edges shallbe neatly rounded off to the required radii. Use of grout over a rough finished texture will not beallowed.
