AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING
ORDINANCE NO. 90/6, A SPECIAL SIGN DISTRICT FOR THE PLAZA AT PRESTON
CENTER, TO INCREASE THE MAXIMUM SIZE OF THE TENANT DIRECTORY
SIGN; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE
NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH
OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Zoning and Development Advisory Committee of the City has considered
a request for amendment of Ordinance No. 90/6, the Special Sign District for the Plaza at Preston
Center, as heretofore amended; and
WHEREAS, the Committee believes such amendment will result in benefit to the public
health, safety and general welfare and is in the interest of the City of University Park, and has
recommended to the City Council that such amendment be approved; and
WHEREAS, the City Council has provided notice and a public hearing about such request
and recommendation and is of the opinion and finds that such special sign district should be
amended as requested; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK, TEXAS:
SECTION 1. That the Zoning and Development Advisory Committee has considered a
request for amendment of Ordinance No. 90/6, which granted a Special Sign District for the Plaza
at Preston Center, and such amendment has been approved by the Committee as beneficial to the
public health, safety, and general welfare and in the interests of the City of University Park. The
City Council hereby determines that ordinance No. 90/6, the Special Sign District for the Plaza at
Preston Center, as heretofore amended, should be further amended in accordance with the
following section.
SECTION 2. The Special Sign District is amended to permit increase of the maximum
height allowed for the Tenant Directory Sign to 16' 6" as shown on the Exhibit attached hereto and
made part hereof for all purposes.
SECTION 3. The sign approved hereby may be constructed and placed at the specific
location and on the elevations as shown in said Exhibit.
SECTION 4. Any provision of Ordinance No. 90/6, as heretofore amended, in conflict
with the provisions of this ordinance is hereby repealed.
SECTION 5. Should any word, sentence, paragraph, subdivision, clause, phrase or section
of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance, other than the part decided to be invalid, illegal or
unconstitutional.
SECTION 6. Any person, firm or corporation violating any of the provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of
the City of University Park, Texas, shall be subject to a fine not to exceed the sum of five hundred
dollars ($500.00) for each offense, and each and every day such offense shall continue shall be
deemed to constitute a separate offense.
SECTION 7. This ordinance shall take effect immediately from and after its passage and
the publication of the caption, as the law and Charter in such cases provide.
DULY PASSED by the City Council of the City of University Park, Texas, on the 5th day
of March 2019.
