HomeMy WebLinkAboutOrdinance No. 19-007 amend the Special Sign District standards for Southern Methodist UniversityORDINANCE NO. 19-007 AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING THE SPECIAL SIGN DISTRICT FOR THE UNIVERSITY CAMPUS-1 AND UNIVERSITY CAMPUS-2 ZONING DISTRICTS WHICH ARE THE PROPERTY OF SOUTHERN METHODIST UNIVERSITY, BY PERMITTING CHANGEABLE MESSAGE SIGNS AT THE HILLCREST PARKING CENTER IN SUBSECTION 3B 1 d; AMENDING SECTION 3 TO ADD SUBSECTION F PERMITTING FIELD LEVEL SCOREBOARDS/VIDEOBOARDS AT GERALD J. FORD STADIUM; PROVIDING CONDITIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED ($500.00) DOLLARS FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Zoning and Development Advisory Committee of the City has considered a request for amendment of the special sign district for the Southern Methodist University property granted by Ordinance 94/10 and has recommended to the City Council the amendment of the ordinance; and WHEREAS, the provisions of the Sign Ordinance have been complied with and the City Council has provided notice and a public hearing about such request and recommendation and is of the opinion and finds that such special sign district should be amended as requested; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. The Zoning and Development Advisory Committee has considered amendment of the special sign district created by Ordinance 94/10, as requested by Southern Methodist University, to authorize additional signage for the University campus as part of an overall graphics program. That such request was accompanied by a plan which provided such details and specifications as were required by the Committee and in the opinion of the Committee, such graphics programs will result in the signage appearance of the area being beneficial to the public health, safety and general welfare and in the interest of the City of University Park. That the Committee has recommended to the City Council that Ordinance 94/10 be amended in part to permit signs and other graphics in accordance with the plan. SECTION 2. After notice and public hearing, and in the best interest of the public health, safety and general welfare of the City, Ordinance 94/10 is hereby amended in part as follows: "SECTION 3 .... A. Permitted Signs. B. Sign Definitions 1. Identification signs d. Changeable Message - A double-faced, double-sided, single pole, internally illuminated, permanent exterior sign which provides changeable message information for temporary events, which may be generally located adjacent to the entries of McFarlin Memorial Auditorium, Meadows School of the Arts, Hillcrest Parking Center, Hughes-Trigg Student Center, Morrison-Bell Track Stadium, Moody Coliseum, Joe Perkins Natatorium and Mustang Band Hall. Text on these signs will be limited to announcement of the event, participants, date, time and organizer. F. Field Level Scoreboards/Videoboards at Gerald J. Ford Stadium 1. Three (3) field level scoreboards/videoboards shall be permitted in Gerald J. Ford Stadium. 2. The scoreboards/videoboards shall be located as follows: a. One (1) scoreboard near the north end zone; and b. Two (2) scoreboards near the south end zone. The locations and heights of the scoreboards/videoboards shall be as shown on the drawing attached as Exhibit "A" to the ordinance amending the Special Sign District as stated herein. 3. The north end scoreboard/videoboard shall be 138.58 feet by 3.67 feet, an area of 509 square feet. The south end scoreboards/videoboards shall be 71.39 feet by 3.67 feet, an area of 262 square feet each." SECTION 3. All ordinances of the City of University Park in conflict with the provisions of this ordinance are hereby repealed. SECTION 4. Should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of -this ordinance, or any part or provision thereof other than the part thereof decided to be unconstitutional, illegal or invalid. SECTION 5 . Any person, firm or corporation violating any of the provisions or terms of this ordinance shall be given the right to correct the violation within a seven-day period or otherwise shall be deemed guilty of a misdemeanor and, upon conviction in the Municipal Court of the City of University Park, Texas, shall be punished by a fine not to exceed the sum of five hundred ($500.00) dollars for each offense, and each day such violation is continued shall be deemed to constitute a separate offense. SECTION 6. This ordinance shall take effect immediately from and after its passage and the publication of the caption as the law and charter in such cases provide.
