AN ORDINANCE OF THE CITY OF UNIVERSITY PARK,TEXAS,CREATING
SCHOOL TRAFFIC ZONES ON BALTIMORE DRIVE FROM A POINT 85 FEET
NORTH OF THE INTERSECTION OF THE NORTH-EASTERN RIGHT-OF-WAY
LINES OF LOVERS LANE AND BALTIMORE DRIVE NORTH 465 FEET AND
AMHERST AVENUE FROM A POINT 230 FEET WEST OF THE INTERSECTION OF
THE NORTH-WESTERN RIGHT-OF-WAY LINES OF AMHERST AVENUE AND
BAL TIMORE DRIVE EAST 465 FEET,WITH A MAXIMUM SPEED LIMIT OF
TWENTY MILES PER HOUR DURING SCHOOL TRAFFIC ZONE HOURS
EFFECTIVE 7:15 A.M.TO 8:30 A.M.AND 2:45 P.M.TO 4:15 P.M.ON SCHOOL DAYS;
PROVIDING FOR A SEVERABILITY CLAUSE;PROVIDING A PENALTY OF FINE
NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00)FOR EACH
OFFENSE;AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,based on a traffic and engineering study,the City Council finds that the
maximum lawful prima facie speed limit should be reduced in a school traffic zone serving
University Park Elementary School;NOW,THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY
PARK,TEXAS:
SECTION 1.That the following school traffic zones are created:
a.Baltimore Drive from a point 85 feet north of the intersection of the north-eastern right-
of-way lines of Lovers Lane and Baltimore Drive north 465 feet,and
b.Amherst Avenue from a point 230 feet west of the intersection of the north-western right-
of-way lines of Amherst Avenue and Baltimore Drive east 465 feet.
SECTION 2.It shall be unlawful and an offense for any person to drive or operate a motor
vehicle more than twenty miles per hour (20 m.p.h.)in the school traffic zone created hereby
during the effective days and times set out herein.The effective times for all school traffic zones
in the City are from 7:15 a.m.to 8:30 a.m.and from 2:45 p.m.to 4:15 p.m.on school days.
SECTION 3.Should any sentence,paragraph,subdivision,clause,phrase,or section of
this ordinance be adjudged or held to be unconstitutional,illegal,or invalid,the same shall not
affect the validity of this ordinance,or any part or provision hereof other than the part so decided
to be invalid,illegal,or unconstitutional.
SECTION 4.Any person violating any of the provisions or terms of this ordinance shall
be subject to the same penalty as provided for in the Code of Ordinances of the City of University
Park,Texas,and upon conviction shall be punished by a fine not to exceed the sum of two hundred
dollars ($200.00)for each offense.
SECTION 5.This ordinance shall take effect from and after its passage and the
publication of the caption as the law and Charter in such cases provide,subject to the erection of
signs complying with the requirements of the Texas Uniform Manual of Traffic Control Devices
and giving notice of the speed limits established hereby.
Duly passed by the City Council of the City of University Park,Texas on the 2nd day of
November 2021.
