Lovers Lane ORDINA1~CE NO. 06/24 L AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS, AMENDING THE COMPREHENSIVE ZONING ORDINANCE AND MAP OF THE CITY OF UNIVERSITY PARK, AS HERETOFORE AMENDED, SO AS TO AMEND THE APPROVED SITE PLAN FOR A PORTION OF PLANNED DEVELOPMENT DISTRICT NO. 2-R FOR APART OF LOT 2, BLOCK C, IDLE WILD NO. 2 ADDITION, COMMOl\TLY KNO'VN AS 4520 WEST LOVERS LANE, MORE PARTICULARLY DESCRIBED IN EXHffiIT "A" ATTACHED; APPROVING A DETAILED SITE PLAN ATTACHED AS EXHIBIT "B", SUBJECT TO SPECIAL CONDITIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission of the City of University Park and the. City Council ofthe City of University Park, in compliance with the laws of the State of Texas with reference to the granting of zoning classifications and changes, have given the requisite notices by publication and otherwise, and have held due hearings and afforded a full and fair hearing to all property owners generally and to all persons interested and situated in the affected area and in the vicinity thereof, and the City Council of the City of University Park is of the opinion and fmds that said. zoning change should be granted and that the Comprehensive Zoning Ordinance and Map should be amended; NOW, THEREFORE, G BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF UNIVERSITY PARK, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Map are hereby amended by amending the approved site plan for a portion of Planned Development District No. 2-R (PD-2-R) for a part of Lot 2, Block C, ldlewild NO.2 Addition, an addition to the City of University Park, Dallas County, Texas, being more particularly described in Exhibit "A" attached hereto and made part hereoffor all purposes, said property being more com~monlY'knciwri cir4520 West Lovers Lane. SECTION 2. That the amended detailed site plan for this portion of PD No. 2-R is attached hereto collectively as Exhibit "B", and is hereby approved as the detailed site plan for said Planned Development District as required by Section 17-101 (2) of the Comprehensive Zoning Ordinance of the City of University Park, Texas, subject to the following special conditions: a. The three (3) 9' x 20' on site parking spaces to be provided at the rear of the property, in accordance with the approved detailed site plan will be maintained by the property owner and L kept open and available for vehicle parking at all times; and, b. The property shall be developed only in conformance with the requirements of this Planned Development Ordinance and the approved detailed site plan. SECTION 3. All ordinances of the City of University Park in conflict with the provisions ~ of this ordinance are hereby repealed. SECTION 4. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance or the Comprehensive Zoning Ordinance and Map, as amended hereby, be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid, illegal or unconstitutional, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SECTION 5. That any person, fIrm or corporation violating any of the provisions of this ordinance or the Comprehensive Zoning Ordinance and Map, as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of University Park, Texas, shall be punished by a fme not to exceed the sum of two thousand dollars ($2,000.00) for .J each offense, and each and every day any such violation shall continue shall be deemed to constitute a separate offense. SECTION 6. That this ordinance shall take effect immediately fi:om and after its passage and the publication ofthe caption, as the law and Charter in such cases provide. G EXHIBIT B LAND USE STATEMENT Agnich Ventures, L.P., has recently purchased the property at 4520 Lovers Lane. The property was for many years a veterinary clinic of approximately 1,530 SF on the ground floor and 485 SF on the second floor. A kennel in the back occupies the remainder of the property. The new owner is planning on building an addition of approximately 1,372 SF, which brings it in line with adjoining properties. This represents a net addition of887 SF. Agnich also plans on increasing the floor to ceiling height to approximately 18' and making extensive exterior improvements as shown on our exhibits. Miracle Mile shopping center parking is virtually all in the public right-of-way. Storefronts are built on the property line and sidewalks and parking are both on City property. Parking is angled and, therefore, not specifically assigned to individual shops. We believe a case can be made that approximately 8 or 9 spaces are available to this property and that 3 additional spaces can be designated in the back of the shop. These three spaces would be 9' x 20' and angled at 90 degrees. Each space would be within the back 20' of the subject property. L The applicant proposes to conform to the City's sign ordinance requirements on its storefront elevation, and may seek treatment as a comer lot on its west elevation which has significant exposure to Lovers Lane and Tollway traffic beyond. The spacing provided by the Chip's parking lot to the west is identical to the conditions at Lomo Alto and Armstrong extensions, both of which have comer signage. It is the applicant's intention to secure a legal agreement with the owner of the Chip's property that would allow this signage subject to any change in property use. Agnich's request for this additional space is predicated on the rental rates he must obtain to justifY the purchase and improvement expenditures.
