07/14
AN ORDINANCE OF THE CITY OF UNIVERSITY PARK, TEXAS,
AMENDING THE CODE OF ORDINANCES OF THE CITY OF UNIVERSITY
PARK, AS HERETOFORE AMENDED, BY AMENDING THE TEXAS FOOD
ESTABLISHMENT RULES WITH REGARD TO CATERING TRUCKS;
REQUIRING THE NAME OF THE CATERING SERVICE TO BE PERMANENTLY
AFFIXED ON THE TRUCK AND REQUIRING THE PERMIT HOLDER TO
PERMANENTLY DISPLAY THE HEALTH PERMIT IN THE CATERING TRUCK;
PROVIDING FOR THE REPEAL OF ALL ORDINANCES IN CONFLICT;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY OF
FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00)
FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
UNIVERSITY PARK, TEXAS:
SECTION 1. That Chapter 6 "Health and Sanitation" of the Code of Ordinances, City
of University Park, Texas, is hereby amended by amending Section 6.302 "Regulation" in part,
as follows:
"Sec. 6.302 Regulation; Amendments
A.
B. That Section 229.169(a)(1) of the Rules is amended to add the following:
"Catering trucks operating as mobile food establishments and permitted by the City
shall have the name of the catering service permanently affixed on both sides of the
truck at all times when operating in the City. Each permit holder for a mobile food
establishment shall permanently display its permit in the catering truck."
SECTION 2. That all provisions of the Code of Ordinances of the City of University
Park, Texas, in conflict with the provisions of this ordinance are hereby repealed.
SECTION 3. That should any word, sentence, paragraph, subdivision, clause, phrase
or section of this ordinance or of the Code of Ordinances, as amended hereby, be adjudged or
held to be void or unconstitutional, the same shall not affect the validity of the remaining
portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain

in full force and effect.
SECTION 4. That any person, firm or corporation violating any of the provisions of
this ordinance or the Code of Ordinances, as amended hereby, shall be deemed guilty of a
misdemeanor and, upon conviction in the municipal court of the City of University Park,
Texas, shall be punished by a fine not to exceed the sum of two thousand dollars ($2,000.00)
for each offense, and each and every day any such violation shall continue shall be deemed
to constitute a separate offense.
SECTION 5. This ordinance shall take effect from and after its passage and the
publication of the caption, as the law and Charter in such cases provide.
